MINUTES MARCH 13th, 2017 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN GORHAM

Mayor Nicol announced that any member of the public wishing to audio or video record a Council Meeting must give notice to the Borough Clerk prior to the meeting being recorded.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator, who advised that Chairman Nolan and the Public Resource Committee had completed their review of the three engineering design proposals received on March 1st for the construction of a new water storage tank, the demolition of the existing tank and improvements to the Union Lane Water Plant. Three firms had made submissions, PS&S, Mott McDonald and H2M. The committee recommended H2M.

There being no questions from Council or from the public, there was no further discussion and the work session was adjourned at 7:32 pm on a motion by Councilman Shaak seconded by Councilman Nolan.

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN GORHAM

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the February 27th regular meetings were approved on a motion by Councilman Gianforte seconded by Councilman Nolan; all aye; no nays. Passed.

Councilman Garruzzo seconded by Councilman Nolan, introduced Resolution 17-24 for Passage of the Consent Agenda.

Councilman Visceglia seconded by Councilman Shaak introduced Resolution 17-25 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of March 13th, 2017, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gianforte, Shaak & Visceglia: all aye. No nays. Passed

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of “Calendar Year 2017-AN ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLSIH A CAP BANK”.

The Administrator explained that, although the ordinance had been introduced on February 27th, due to a miscommunication, it was not published in the press and therefore the hearing had to be carried to March 27th.

Councilman Garruzzo, seconded by Councilman Nolan, introduced resolution 17-26 to carry the adoption of the foregoing ordinance and to republish it in the Coast Star for a hearing to be held at 7:30 pm on March 27th, 2017.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of ‘AN ORDINANCE TO AMEND CHAPTER FOUR OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED “GENERAL LICENSING”.

Councilman Garruzzo, seconded by Councilman Gianforte introduced resolution 17-27 for passage on introduction and first reading of the foregoing Ordinance. Vote: Councilmen Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed.

Councilman Garruzzo seconded by Councilman Nolan, introduced resolution 17-28 to authorize publication of the foregoing ordinance in the Coast Star for a hearing to be held on March 27th, 2017, at 7:30pm, at Borough Hall. Vote: Councilmen Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed.

Councilman Visceglia, seconded by Councilman Shaak, introduced resolution 17-29 for the introduction of the 2017 Municipal Budget (insert). Vote: Councilmen Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Councilman Gianforte who advised that his committee was reviewing the proposed amendments to the Protection of Natural Resources ordinance and he hoped to have a report to Council in the near future.

Councilman Nolan advised the public that the Board of Recreation was sponsoring a scholarship for Brielle high school seniors. Applications were due by May 1st.

Given the pending snow storm, the annual snowman contest had been extended to March 20th.

Councilman Garruzzo cited the Fire Company’s 6 calls in February for a total of 13 in 2017. He also reminded residents that when they turn their clocks back it is a good time to check the batteries in their smoke alarms. He also complemented the Fire Company on their recent Comedy Night.

Councilman Garruzzo cited the impending snow event and reminded drivers to wear their seatbelts, allow extra time to reach their destination, clear snow and ice from the entire car, hood, roof, trunk, turn signals, tail and headlights, windows, mirrors and fender wells; it is the law. Do not attempt to pass a snowplow while they are engaged in plowing, make sure that you have a full fuel tank, have a personal safety kit in the vehicle along with a blanket and a snack and water. If you begin to skid do not brake or accelerate, remove your foot from the gas and steer in the direction of the skid. If your vehicle becomes disabled, pull to the side of the road, put on your flashers and await assistance. Residents should bring in pets, run water at a trickle to keep pipes from freezing, vent fuel burning equipment to the outside, keep garage doors closed, set thermostat at same temperature day and night to prevent pipes freezing, consider your physical condition before undertaking strenuous tasks in cold weather, wear loose fitting, lightweight clothing in several layers. Stay indoors if possible and help those who require special assistance, the elderly living alone, people with disabilities and children.

Councilman Shaak reminded residents to keep all vehicles off the roadways to facilitate snow plowing and he alerted residents with a scheduled trash pick-up that the Tuesday Route would be moved to Saturday due to the storm.

Councilman Visceglia having no report the meeting was open to the public and Beth Rosen, Osprey Point Drive, asked the status of the tree ordinance revisions?

Councilman Gianforte explained that his committee was still looking into the matter and he thanked her for the materials that she had provided to his committee.

The meeting was then adjourned at 7:42 pm on a motion by Councilman Shaak seconded by Councilman Gianforte.

Resolution of the Borough of Brielle


Be It Resolved, the Municipal Budget of the Borough of Brielle, County of Monmouth, for the Year 2017.

Be It Resolved, that the following statements of revenue and appropriations shall constitute the Municipal Budget for the year 2017.

Be It Further Resolved, that said budget be published in the Coast Star in the issue of March 30th, 2017.

The Governing Body of the Borough of Brielle does hereby approve the following as the budget for the year 2017.

Vote: Councilmen Garruzzo, Gianforte, Gorham, Nolan, Shaak & Visceglia; all aye. No nays. None absent. None abstained.

Notice is hereby given that the budget and Tax resolution, in the amount of $6,575,460.85 was approved by the Governing Body of the Borough of Brielle on March 13th, 2017. A Hearing on the Budget and Tax Resolution will be held at the Municipal Building on April 10th, 2017 at 7:30pm at which time and place objections to said Budget and Tax Resolution for the year 2017 may be presented by taxpayers or other interested parties.

Resolution No.:17-24-A

Resolution of the Borough of Brielle


Whereas, the Borough of Brielle did solicit RFP's for the design and construction services for a three hundred thousand gallon water storage tank, the demolition of an existing water tank and improvements to the Union Lane Water Plant, and

Whereas, RFPs were received by the Municipal Clerk on March 15th, 2017 and subsequently reviewed by the Public Resource Committee, and

Whereas, the Committee has recommended that the RFP submitted by H2M architects and engineers be accepted.

NOW THEREFORE BE IT RESOLVED, that the three proposals received from H2M, 2380 Route 9, Howell, N.J. 07731 are hereby accepted and that H2M be authorized to proceed with the work as specified and at the cost itemized in the individual proposals for an aggregate amount of $276,810.00.
