MINUTES June 27th, 2016 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, GORHAM, NOLAN & VISCEGLIA, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN SHAAK

Mayor Nicol announced that any member of the public wishing to audio or video record a Council Meeting must give notice to the Borough Clerk prior to the meeting being recorded.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator, who had advised Council that he had nothing to report.

The Chair then recognized Mr. McManus of the Board of Recreation who announced the recipients of the Board’s 2016 Scholarship Awards. The selected students were Brian Lembo and Brianne Lauria. Both students had distinguished themselves both academically and through active participation in community affairs, including assistance at Recreation sponsored activities.

There being no further comment, work session was adjourned at 7:32 p.m. on a motion by Councilman Gorham, seconded by Councilman Garruzzo.

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, GORHAM, NOLAN & VISCEGLIA, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN SHAAK

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the June 13th Regular Meeting were approved on a motion by Councilman Nolan seconded by Councilman Garruzzo; all aye; no nays. Passed (Note: Councilmen Garruzzo & Gianforte abstained).

Councilman Garruzzo seconded by Councilman Nolan introduced Resolution 16-55 for Passage of the Consent Agenda.

Resolution:
A. To appoint Morgan R. Montano as an Alternate Prosecutor for the Brielle Municipal Court.
B. To accept a proposal from Realty Data Systems, LLC to provide added Assessment/Omitted Assessments at a cost not to exceed $2,500.00.

Vote: Council Members Garruzzo, Gianforte, Gorham, Nolan & Visceglia; all aye, No nays. Passed (Note: Councilman Garruzzo abstained on “D”).

Councilman Visceglia seconded by Councilman Gorham introduced Resolution 16-56 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of June 27th, 2016, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Councilmen Garruzzo, Gianforte, Gorham, Nolan & Visceglia: all aye. No nays. Passed

The Mayor then announced that the time had arrived for a hearing and further consideration of AN ORDINANCE TO AMEND CHAPTER TWENTY, SECTION SIX, SUB-SECTION SEVEN (20-6.7) OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED “LAND USE FEES”.

The hearing was opened on a motion by Councilman Gianforte seconded by Councilman Gorham.

The Administrator explained that the ordinance would bring Planning Board application fees into line with those charged in neighboring municipalities and ensure that the appropriate cost of application review was differed by the applicant.

The hearing was closed on a motion by Councilman Gianforte seconded by Councilman Nolan.

Councilman Garruzzo seconded by Councilman Nolan introduced Resolution 16-57 for passage on final reading of the foregoing Ordinance. Vote: Councilmen Garruzzo, Gianforte, Gorham, Nolan & Visceglia; all aye. No nays. Passed.

Councilman Nolan seconded by Councilman Garruzzo, introduced Resolution 16-58 to authorize publication of passage and adoption in the Coast Star according to law. Vote: Councilmen Garruzzo, Gianforte, Gorham, Nolan & Visceglia; all aye. No nays. Passed.

The Mayor then called for committee reports and recognized Councilman Visceglia who had no report. Councilman Gorham having no report, Councilman Garruzzo cited the Police Department’s participation in the National Seat Belt Enforcement Mobilization “Click It or Ticket” between May 23rd and June 5th. The Department clocked 98 additional hours and issued 376 summonses, 3 being D.W.I. Of the total 119 were seat belt violations.

Councilman Garruzzo added that, during a recent incident, where both personal privacy and sensitivity are at issue, Sergeant Boyd, and Patrolmen Lovgren and Aridas responded to a call and I would be remiss in not recognizing the “caring, patient, calm and comforting” presence of Patrolman Lovgren as he aided a person in distress. He noted Chief Palmer had received a letter wherein the officer’s conduct was praised, but lamented the fact that it had not been filmed as it would have made a perfect training film on how to response in this type of situation.

Councilman Nolan and Gianforte having no reports, and there being no public comment, the meeting was adjourned at 7:42 pm on a motion by Councilman Garruzzo, seconded by Councilman Nolan.

Resolution 16-55-C

Borough of Brielle Resolution


Whereas, an application for the renewal of Plenary Retail Consumption License #1308-33-012-013, has been submitted by Brielle Union Partners, LLC. , and

Whereas, the applicant has submitted renewal application on-line as required and the form is complete in all respects, the renewal fees for the Borough of Brielle and the New Jersey Division of Alcoholic Beverage Control have been paid, and

Whereas, the applicant is qualified to be licensed according to all standards established by Title 33 of New Jersey Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions, and

Whereas, no objection to the renewal of this license has been made, and

Whereas, the applicant understands that this renewal is being made subject to the provisions of N.J.S.A.33:1-20 and is being treated as a "conflict" renewal, and the applicant has filed the required form with the Division of Alcoholic Beverage Control.

Now Therefore Be It Resolved, that the Governing Body of the Borough of Brielle does hereby approve, effective this date, the renewal of License #1308-33-012-013 for the license year July 1st, 2016 through June 30th, 2017, by the Director of the State of New Jersey Division of Alcoholic Beverage Control.

Resolution of the Borough of Brielle

Whereas: on June 16th, 2016 The Rotary of Spring Lake/Brielle, 218 Club Drive, Wall, NJ 07719 submitted Raffle Application No. 2016-10 ID, No. 475-8-29469 for an on-site 50/50 raffle, to be held at Rotary Food Tent, 610 South Street Brielle NJ 08730 on Saturday, September 10th, 2016 at 4pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

Resolution of the Borough of Brielle

Whereas, the Borough of Brielle did advertise in the Asbury Park Press for bids for Improvements to Brielle Library Parking Lot, and

Whereas, bids were received by the Borough on June 23rd, 2016, and

Whereas, the lowest responsible bidder was, Vision Construction Group, Inc. Edison, N.J., and

Whereas, the Bid Bond and Consent of Surety were found to be in order, and funds are available to undertake this work.

Now Therefore Be It Resolved, that the bid submitted by Vision Construction Group, Inc., 33 Gross Avenue, Edison, N.J. 08837 in the amount of $313,408.50 is hereby accepted.

Be It Further Resolved, that the Municipal Clerk is hereby authorized to initiate the contract.

Vote: Councilmen Garruzzo, Gianforte, Gorham, Nolan & Visceglia; aye. No nays. None abstained.

Absent: Councilman Shaak
