MINUTES March 14th, 2016 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN GORHAM

Mayor Nicol announced that any member of the public wishing to audio or video record a Council Meeting must give notice to the Borough Clerk prior to the meeting being recorded.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator, who had advised Council of a procedural matter; the agenda had to be rearranged to introduce the budget subsequent to the introduction of the ordinance to exceed the CAP.

The Mayor then read a Proclamation re: “Wear Purple Day”

Whereas, Alcohol is the most commonly used addictive substance in the United States; and
Whereas, One in every 12 adults suffers from alcohol abuse or dependence and more than half of all adults have a family history of alcoholism or problem drinking; and
Whereas, 100,000 persons die each year from alcohol-related causes (drunk driving crashes, other accidents, falls, fires, alcohol-related homicides and suicides); and
Whereas, Teens who start drinking before the age of 14 are 7 times more likely to develop alcohol problems by the time they are 21 (14-7-21); and
Whereas, The month of April has been recognized as Alcohol Awareness Month by NCADD (National Council on Alcoholism and Drug Dependence), the founder and sponsor of Alcohol Awareness Month; and
Whereas, The color that NCADD uses is in the purple/violet family a color that is similar to the amethyst. Here is the reasoning behind the amethyst color: AMETHYST is the most beautiful and valuable form of Quartz. The word ‘amethyst’ stems from a Greek word meaning without drunkenness,” for in ancient times it was believed that anyone carrying or wearing this stone could not become intoxicated.” Anyone who displays the amethyst color announces that they know someone whose life has been improved through alcoholism treatment.
Now, Therefore, Be it Resolved that the Borough of Brielle and The New Jersey Association of County Alliance Coordinators has declared that Friday April 15th is “Wear Purple Day” in recognition of Alcohol Awareness Month and encourages all of the members, partners, contributors, and participants of the 544 Municipal Alliance Committees throughout the State of New Jersey to join in wearing purple.

There being no further comment, work session was adjourned at 7:32 p.m. on a motion by Councilman Shaak, seconded by Councilman Nolan.

MINUTES March 14th, 2016 START: 7:33 P.M.

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN GORHAM

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the February 22nd Regular Meeting were approved on a motion by Councilman Gianforte seconded by Councilman Visceglia; all aye; no nays. Passed

Councilman Gianforte seconded by Councilman Nolan introduced Resolution 16-22 for Passage of the Consent Agenda.

Resolution:
A. To reaffirm the hourly rate of $15.00 for School Crossing Guards employed in 2015 & 2016.
B. (See insertion).
C. To approve the Waypoint 622 Fire Zone as per the plan approved by the Fire Chief, Fire official & chief of Police.
D. (See insertion)
E. To observe the month of April as “Child Abuse Prevention Month” and to authorize the placement of pinwheel gardens by the Woman’s Club of Brielle.
F. (See insertion).
Vote: Council Members Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye, No nays. Passed

Councilman Visceglia seconded by Councilman Shaak introduced Resolution 16-23 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of March 14th, 2016, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gianforte, Nolan, Shaak & Visceglia: all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of “AN ORDINANCE TO AMEND CHAPTER FOUR OF THE CODE OF THE BOROUGH OF BRIELLE TO CREATE A NEW SECTION TO BE ENTITLED “DEALERS IN PRECIOUS METALS AND OTHER SECOND HAND GOODS”.

Councilman Garruzzo seconded by Councilman Nolan introduced Resolution 16-24 for passage on introduction and first reading of the foregoing ordinance. Vote: Council members Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed

Councilman Garruzzo seconded by Councilman Nolan, introduced Resolution 16-25 to authorize publication in the Coast Star for a hearing to be held on March 28th, 2016 @ 7:30 pm, at Borough Hall. Vote: Council members Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of ‘CALENDAR YEAR 2016, AN ORDINANCE TO EXCCED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK”.

Councilman Garruzzo seconded by Councilman Nolan, introduced Resolution 16-26 for passage on introduction and first reading of the foregoing ordinance. Vote: Council members Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed

Councilman Garruzzo seconded by Councilman Nolan introduced Resolution 16-27 to authorize publication in the Coast Star for a hearing to be held at 7:30 pm, on March 28th, 2016, at Borough Hall. Vote: Council members Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed

Councilman Nolan seconded by Councilman Garruzzo, introduced Resolution 16-28 for the introduction of the municipal budget (see insertion). Vote: Council members Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed

Councilman Gianforte seconded by Councilman Garruzzo introduced Resolution 16-29 (see insertion). Vote: Council members Garruzzo, Gianforte, Nolan, Shaak & Visceglia; all aye. No nays. Passed

Mayor Nicol then called for Committee Reports and recognized Councilman Gianforte who had no report.

Councilman Nolan cited the Board of Recreation’s preparation of a five year capital program and the upcoming Easter Egg Hunt. The Library would be hosting a program entitled New Jersey Women in World War II, Miss Eloise’s Adventures and on April 2nd, a visit by Star Wars Characters.

Councilman Garruzzo gave the Fire Report and advised the public that Chief Callahan had conducted three drills, one was an equipment check, the second a Bloodborne Pathogens seminar and the third saw the company visit Blewett’s Junk Yard where they were permitted to conduct vehicle extrication drills. The company’s Water Rescue Team also assisted Manasquan during the Polar Bear Plunge.

Councilman Shaak noted that Leaf Season will resume on April 1st and he urged residents

to be patient as the DPW was currently engaged in pothole repair, but he asked the public to call in any pot halls they were aware of.

Councilman Visceglia having no report, and there being no public comment, the meeting was adjourned at 7:46 pm on a motion by Councilman Shaak, seconded by Councilman Gianforte.

RESOLUTION OF THE BOROUGH OF BRIELLE

BE IT RESOLVED, that the Borough Administrator, Thomas F. Nolan, is hereby authorized, by the Governing Body of the Borough of Brielle, to execute a Change Order for the Brielle Library Parking Lot Project, designated as Change Order No. 2. This change is for various project modifications and there is a decrease to the contract price of $24.22.

Whereas: on March 4th, 2016 Mercy Center, 1106 Main Street Asbury Park, NJ 07712 submitted Raffle Application No. 2016-4 ID, No. 12-4-29836 for an off-site Merchandise raffle, to be held at Manasquan River Golf Club, 843 Riverview Drive Brielle NJ 08730 on Friday, May 6th, 2016 at 1pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

Whereas, the document attached to this Municipal Budget Notice shall constitute the Municipal Budget for the year 2016.

Be It Resolved, that the following statements of revenues and appropriations shall constitute the Municipal Budget for the year 2016;

Be It Further Resolved, that said budget be published in the Coast Star in the issue of March 24th, 2016.

Resolution No.:16-29

Borough of Brielle: Self-Examination of Budget Resolution

WHEREAS, N.J.S.A. 40A:4-78b has authorized the Local Finance Board to adopt rules that permit municipalities in sound fiscal condition to assume the responsibility, normally granted to the Director of the Division of Local Government Services, of conducting the annual budget examination; and

WHEREAS, N.J.A.C. 5:30-7 was adopted by the Local Finance Board on February 11, 1997; and

WHEREAS, pursuant to N.J.A.C. 5:30-7.2 through 7.5, the Borough Of Brielle has been declared eligible to participate in the program by the Division of Local government Services, and the Chief Financial officer has determined that the local government meets the necessary conditions to participate in the program for the 2011 budget year.

NOW THEREFORE BE IT RESOLVED by the governing body of the Borough Of Brielle that in accordance with N.J.A.C. 5:30-7.6a & 7.6b and based upon the Chief Financial Officer's certification, the governing body has found the budget has met the following requirements:

1. That with reference to the following items, the amounts have been calculated pursuant to law and appropriated as such in the budget:
a. Payment of interest and debt redemption charges
b. Deferred charges and statutory expenditures
c. Cash deficit of preceding year
d. Reserve for uncollected taxes
e. Other reserves and non-disbursement items
f. Any inclusions of amounts required for school purposes.

2. That the provisions relating to limitation on increases of appropriations pursuant to N.J.S.A. 40A:4-45.2 and appropriations for exceptions to limits on appropriations found at N.J.S.A. 40A:4-45.3 et seq., are fully met (complies with CAP law).

3. That the budget is in such form, arrangement, and content as required by the Local Budget Law and N.J.A.C. 5:30-4 and 5:30-5.

4. That pursuant to the Local Budget Law:
a. All estimates of revenue are reasonable, accurate and correctly stated,
b. Items of appropriation are properly set forth
c. In itemization, form, arrangement and content, the budget will permit the exercise of the comptroller function within the municipality.
5. The budget and associated amendments have been introduced and publicly advertised in accordance with the relevant provisions of the Local Budget Law, except that failure to meet the deadlines of N.J.S.A. 40A:4-5 shall not prevent such certification.
6. That all other applicable statutory requirements have been fulfilled.

BE IT FURTHER RESOLVED that a copy of this resolution will be forwarded to the Director of the Division of Local Government Services upon adoption.
