MINUTES October 26th, 2015 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, GORHAM, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN.

ABSENT: NONE

Mayor Nicol announced that any member of the public wishing to audio or video record a Council Meeting must give notice to the Borough Clerk prior to the meeting being recorded.

Mayor Nicol then opened the Work Session in compliance with the Open Public Meetings Act and recognized the Administrator who had advised Council that he had nothing to report.

There being no further discussion, the work session was adjourned at 7:32 pm on a motion by Councilman Shaak seconded by Councilman Gianforte.




MINUTES October 26th, 2015 START: 7:33 P.M.

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, GORHAM, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN.

ABSENT: NONE

Following the announcement on recording devices, a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the October 12th, 2015 meetings were approved on a motion by Councilman Garruzzo seconded by Councilman Gorham; all aye; no nays. Passed

Councilman Garruzzo seconded by Councilman Nolan, introduced Resolution 15-82 for Passage of the Consent Agenda.

B. To authorize the renewal of the Animal Control Contract with Associated Humane Societies for the period 1/1/16 to 12/31/16.

Councilman Visceglia seconded by Councilman Gorham introduced Resolution 15-85 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of October 26th, 2015, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gianforte, Gorham, Nolan, and Shaak: all aye. No nays. Passed

Mayor Nicol announced that the time had arrived for a hearing and passage on first reading of “AN ORDINANCE TO AMEND CHAPTER III OF THE CODE OF THE BOROUGH OF BRIELLE, ENTITLED “POLICE REGULATIONS”

Councilman Garruzzo seconded by Councilman Gorham, introduced Resolution 15-86 for passage on first reading. Vote: Council members Garruzzo, Gianforte, Gorham, Nolan, Shaak & Visceglia; all aye. No nays. Passed.

Councilman Garruzzo, seconded by Councilman Nolan, introduced Resolution 15-87 to authorize PAGE 96

publication in the Coast Star for a hearing to be held at 7:30 pm, on November 9th, 2015, at Borough Hall.. Vote: Councilmen Garruzzo, Gianforte, Gorham, Nolan, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol called for Committee Reports and recognized Councilman Gianforte who had no report.

Councilman Nolan advised that author Jennifer Donnelly would be at Library on October 29th @ 6:00 pm to discuss her book “These Shallow Graves”. The Board of Recreation’s Fall Festival raised $819.00 for the Long Blue Line and Kevin Kinneally was the winner of the Chili Cook Off.

Councilman Garruzzo cited the Fire Company for another exceptional Haunting Hayride and he urged anyone who had not experienced the thrills to attend next season.

Councilman Garruzzo then advised the public of an IRS scam whereby callers pose as IRS agents and indicate that an individual will be sued or arrested for non-payment of taxes. Immediate payment is then requested and instructions are given over the telephone as to how payment is to be made. The IRS always contacts citizens by mail never by telephone.

These scammers are sophisticated, have phony identification, and may know the last four digits of a social security number. If you receive such a call contact the IRS at 1-800-829-1040 if you need tax advice, if you know that your taxes are in good standing, you should notify IRS @ 1-800-366-4484 to report the incident.

Councilman Shaak reported that the Department of Public Works and a local electrician were working to resolve a circuit problem that has impacted the decorative lighting on a portion of Higgins Avenue near Grieco Beverage,

Councilmen Gorham & Visceglia having no reports, the meeting was open to the public and representatives of Boy Scout Troop #360 asked why there was no bike rack at Brielle Park.

Mayor Nicol called the inquiry the most intelligent question he had had in some time and promised to look into the matter.

Board of Recreation Chairman John Devereux being present, he asked where the Scouts would recommend placing the rack and they responded the “basketball courts”.

Margaret Herman, 208 Homestead Road, cited a recent statement in the Coast Star that Homestead Road had been made into a one-way street by the Council.

Mayor Nicol advised that it took place some twenty years ago. Ms. Herman said that the Mayor was correct, but the change had been brought about by former Councilman Leonared Lenzen.

The Mayor said that was correct and the statement was not meant to imply that the current Governing Body was responsible.

There being no further comments, the meeting was adjourned at 7:46 pm on a motion by Councilman Garruzzo seconded by Councilman Nolan.

Resolution No: 15-84-A
Date: October 26th, 2015


WHEREAS, the State of New Jersey, Department of Transportation has notified all municipalities of the availability of funding under the Transportation Trust Fund Municipal Aid Program for the Fiscal Year 2016; and

WHEREAS, the Borough of Brielle is desirous of submitting an application under this program for the following purpose:
Improvements to the Valley Road Phase II from Birch Drive to Riverview Drive

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of Brielle, County of Monmouth, State of New Jersey, formally approves the grant application for the above stated project; and

FURTHER BE IT RESOLVED that the Borough Engineer, Mayor and Municipal Clerk are hereby authorized to submit an electronic grant application identified as MA-2016-¬Valley Road - Phase 2 - 00451 to the New Jersey Department of Transportation on behalf of the Borough of Brielle; and

FURTHER BE IT RESOLVED that the Mayor and Municipal Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of Brielle and that their signatures constitute acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.
