PRESENT: MAYOR NICOL, COUNCILMEN GIANFORTE, GORHAM, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN

ABSENT: COUNCILMAN GARRUZZO

Mayor Nicol announced that any member of the public wishing to audio or video record a Council Meeting must give notice to the Borough Clerk prior to the meeting being recorded.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator, who advised Council that he had nothing to report.

The Chair then recognized Board of Recreation Member Thomas McManus who announced the winners of the Board’s annual scholarship program, an award that was based on, not only academic achievement, but in volunteerism and giving back to the community. The winners were Ms. Kelly Nolan and Mr. Kevin Kinneally, both received checks in the amount of $500.00.

Recreation Board Chairman, John Devereux made a presentation of the proceeds of the North vs. South Competition to Doug Emich, in memory of his wife, Sharon and her contributions to the Board and the Brielle Community.

The event had raised $12,000 through a series of events that saw the South defeat the North taking ten of the eighteen scheduled events.

There being no further comment, work session was adjourned at 7:39 p.m. on a motion by Councilman Nolan seconded by Councilman Shaak.

Councilman Visceglia, seconded by Councilman Gorham introduced Resolution 15-62 for Payment of Bills. Mayor Nicol announced that the time had arrived for a hearing and passage on final reading of “AN ORDINANCE TO AMEND CHAPTER THIRTEEN, SECTION THIRTEEN OF THE CODE OF THE BOROUGH OF BRIELLE”.

Councilman Gianforte seconded by Councilman Nolan, introduced Resolution 15-63 for passage on first reading. Vote: Councilmen Gianforte, Gorham, Nolan, Shaak & Visceglia; all aye. No nays. Passed

Councilman Gianforte seconded by Councilman Gorham, introduced Resolution 15-64 to authorize publication in the Coast Star for a hearing to be held at 7:30 pm, on June 22nd, 2015, at Borough Hall. Vote: Councilmen Gianforte, Gorham, Nolan, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol called for Committee Reports and recognized Councilman Gianforte who thanked the Council for their support of the Special Events Ordinance.

Councilman Nolan advised that the Library’s Summer Reading Club Program would begin on June 1st. An “iRead/iWin” Summer Reading Challenge for grades 4 through 12 will sponsor an essay contest with a $300 Apple Gift Card as the prize in each competitive category.

Councilman Nolan also cited the success of the North South competition and he reminded the public of the upcoming Mets vs. Padres baseball trip.

Councilman Shaak informed the public that Robert McArthur & Jeffrey Weiss were in the first graduating class in the State of New Jersey Clean Communities Coordinator class.

The Borough was now accepting PVC Pipe for recycling. Sections are free to Brielle homeowners. The capital improvements to the Water Utility continue to be on schedule and just today the top was placed on the new water storage tank.

Councilman Gorham & Visceglia had no reports.

The meeting was opened to the public and Janice Hendricks, 615 Leslie Avenue, asked when the Water Main project on Union Lane would be completed. The Administrator advised the end of the month (June). Ms. Hendricks also questioned the Borough’s diligence in enforcing the “No-Knock” ordinance insofar as the New Jersey Youth Club had been in town again and appeared to ignore the list. Ms. Hendricks also produced a copy of an Asbury Press article that indicated the state had shut them down. She added that in Wall Township fines were levied against violators.

Mr. James Aloi, 108 Ocean Avenue, advised Council of an on-going drainage condition at his location that extended along a number of properties. Mr. Aloi’s neighbor, Mr. Thomas Stuhrmann was also present and shared the concern.

Mr. Aloi acknowledged that both the Public Works Department and the Borough Engineer had been to the site, and a curb-line survey had been completed, but no action had been taken by the Borough.

Mr. Aloi added that his property/driveway was three inches below the street level; he had been advised that there were possible solutions, such as the installation of a storm drain, or regarding as part of a street improvement project, but funding was an issue. Both Mr. Aloi and Stuhrmann were asking for relief.

Council offered to investigate the situation with an eye toward remediation and Councilman Nolan, an engineer, offered to visit the site with both gentlemen, right after the meeting concluded.

Janice Hendricks was again recognized and noted that she had been remiss in forgetting to advise Council of her appreciation for the DPW’s rescue of baby ducklings from a storm drain over the weekend.

The meeting was then adjourned at 8 pm on a motion by Councilman Visceglia seconded by Councilman Nolan.

Now Therefore Be It Resolved, that the application of JP'S River House, Inc. for premises located at 1 Ocean Avenue, Brielle, New Jersey, is hereby approved and the Clerk is authorized to renew the license from July 1st, 2015 through June 30th, 2016, subject to the following conditions:

1. Alcoholic Beverage may be sold, served, delivered or consumed on the open exterior deck of the premises from 12:00 p.m. to 11:00 p.m., Sunday through Thursday, and from 12:00 p.m. to 1:00 a.m. on Friday.

2. Live entertainment may be permitted on Saturdays and Sundays from 1:30 P.M. to 12:00 a.m. (Midnight). Live entertainment shall be limited to a piano player, a guitar player or a band (not to exceed a duo). A Disc - Jockey shall not be permitted.

3. Controlled Background Music may be permitted in the above mentioned deck area during the hours of 12:00 p.m. to 10:00 p.m., Sunday through Thursday, and from 12:00 p.m. to 1:00 a.m. on Fridays and Saturdays, providing that said music is in compliance with the provisions of Chapter 3, Sections 3-1.1 through 3.1-11 of the Code of the Borough of Bridle entitled "Noise Control" and is compliance with all other Ordinances of the Borough.

4. A singer shall he permitted to entertain on the deck on Friday and Saturday evenings from 9:00 p.m. until 12:00 a.m. (Midnight) and on Sunday from 3:00 p.m. until 10:00 p.m. provided that such activity is in compliance with the provisions of Borough Ordinances.

5. No doors or windows can remain open while any live entertainment or background music is utilized on the deck.

6. On the Sunday prior to Memorial Day & on the Sunday prior to Labor Day, the deck may remain open until 1:00 am. The deck may also remain open until 1:00 a.m. on July 3rd. These exceptions are granted subject to the provisions of this resolution.

BOROUGH OF BRIELLE RESOLUTION

WHEREAS, N.J.S.A. 40A: 5-4 requires the governing both of every local unit to have made an annual audit of its books, accounts and financial transactions, and

WHEREAS, the Annual Report of Audit for the year 2014 has been filed by a Registered Municipal Accountant with the Municipal Clerk of the Borough of Brielle, Thomas F. Nolan as per the requirements of N.J. S. 40A: 5-6, and a copy has been received by each member of the governing body, and

WHEREAS, R. S. 52:271313-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs, and

WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled "Comments and Recommendations; and

WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled "Comments and Recommendations" as evidenced by the group affidavit form of the governing body attached hereto: and

WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and

WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as Stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board, and

WHEREAS, failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52 -to wit:

R.S. 52:27BB-52 A local officer or member of a local governing body who, after a date fixed for compliance, fills or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may he fine not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year or both, in addition shall forfeit his office.

NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of Brielle hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

Whereas, the Borough of Brielle has determined that the property described on Schedule A attached hereto and incorporated herein is no longer needed for public use, and

Whereas, the Local Unit Technology Pilot Program and Study Act (P.L.2001,c.30) authorizes the sale of surplus personal property no longer needed for public use and/or unclaimed property through the use of an on-line auction service, and

Whereas, the Borough of Brielle intends to utilize the online auction services of Alfred's Auctions, Inc., PO Box 861, Hightstown, N.J. 08520, and

Whereas, the sales are being conducted pursuant to the Division of Local Government Service’s Local Finance Notice 2008-9.

Now Therefore Be It Resolved, by the Borough of Brielle, in the County of Monmouth, State of New Jersey, that the Borough of Brielle is hereby authorized to sell the surplus property and the unclaimed property as indicated on Schedule A on an online auction website entitled Alfred's Auction, Inc., and be it further

Resolved, that the terms and conditions of the agreement entered into between Alfred's Auctions, Inc. and the Borough of Brielle are available at the Brielle Police Department and in the Borough of Brielle at the Municipal Clerk's Office, and be it further resolved that said items shall be available for auction during the period July 6th through July 13th, 2015 and
