MINUTES MARCH 9th, 2015 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GORHAM, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN

ABSENT: COUNCILMAN GIANFORTE

Mayor Nicol announced that any member of the public wishing to audio or video record a Council Meeting must give notice to the Borough Clerk prior to the meeting being recorded.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator, who had nothing to report.

There being no further comment, work session was adjourned at 7:35 p.m. on a motion by Councilman Shaak, seconded by Nolan.


MINUTES MARCH 9th, 2015 START: 7:36 P.M.

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GORHAM, NOLAN, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN

ABSENT: COUNCILMAN GIANFORTE

Following the announcement on recording devices, a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the February 23rd, 2015 meetings were approved on a motion by Councilman Shaak seconded by Councilman Nolan; all aye; no nays. Passed

Councilman Garruzzo seconded by Councilman Nolan, introduced Resolution 15-30 for Passage of the Consent Agenda.

C. To appoint Kim Numcia, Alternate #1on Brielle Environmental Commission to fill the unexpired term of Annette Kavanaugh through December 31st, 2017.

Vote: Councilmen Garruzzo, Gorham, Nolan, & Shaak; all aye, No nays. Visceglia abstained Passed

Councilman Visceglia, seconded by Councilman Gorham introduced Resolution 15-31 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of March 9th, 2015, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gorham, Nolan, Shaak & Visceglia: all aye. No nays. Passed

Mayor Nicol announced that the time had arrived for the introduction and passage on first reading of “AN ORDINANCE TO AMEND CHAPTER II, SECTION SEVENTEEN OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED “LENGTH OF SERVICE AWARD PROGRAM”.

Councilman Garruzzo, seconded by Councilman Gorham moved resolution 15-32 for passage on first reading. Vote: Councilman Garruzzo, Gorham, Shaak & Visceglia; all aye. No nays. Passed.

Councilman Nolan, seconded by Councilman Garruzzo, introduced resolution 15-33 to authorize publication in the Coast Star for a hearing to be held on March 23rd, 2015 @ 7:30 pm, at Borough Hall, according to law. Vote: Councilmen Garruzzo, Gorham, Shaak & Visceglia; all aye. No nays. Passed

The Mayor then announced that the time had arrived for the introduction and passage on first reading of “CALENDAR YEAR 2015: AN ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A.4-45.14)”.

Councilman Garruzzo seconded by Councilman Nolan introduced Resolution 15-34 for passage on first reading. Vote: Councilmen Garruzzo, Gorham, Nolan, Shaak & Visceglia; all aye. No nays. Passed

Councilman Garruzzo seconded by Councilman Gorham introduced Resolution 15-35 to authorize publication in the Coast Star for a hearing to be held on March 23rd, 2015 @ 7:30 pm, at Borough Hall, according to law. Vote: Councilmen Garruzzo, Gorham, Nolan, Shaak & Visceglia; all aye. No nays. Passed.

The Mayor then called for Committee Reports and recognized Councilman Nolan who advised that Pee-Wee Soccer sign-ups began on March 3rd @ 1:00 pm. The Annual Easter Egg Hunt would begin @ 1:00 pm sharp on Saturday March 28th, with a Sunday, March 29th as the rain date.

On March 14th the Library would host author Alphie McCourt who would discuss his new book “The Soulswimmer” and the “Yoga Girl” would visit the Shore on March 25th.

Councilmen Garruzzo, Shaak, Gorham & Visceglia had no reports.

The meeting was then adjourned at 7:46 pm on a motion by Councilman Visceglia seconded by Councilman Nolan.

Resolution of the Borough of Brielle

Whereas, the Borough of Brielle has been formed in compliance with the applicable statutes, and
Whereas, State Statute (N.J.S.A.33:1 et seq.) permits a municipality to issue an unlimited Number of Club Licenses to organizations who meet the established criteria, and
Whereas, the Manasquan River Yacht Club has made application to the Governing Body of the Borough of Brielle for a Club License, and
Whereas, a background check by the Brielle Police Department has found no impediment to the issuance of this license, and
Whereas, notice of this requested action appeared in the Asbury Park Press on December 27th, 2014 and on January 3rd, 2015, and no objections have been received from the public or any interested party, and
Whereas, a state fee of $200.00 and a municipal fee of $66.00 have been paid and the applicant has assured the Borough, in writing, of their intention to abide by the record requirements of N.J.A.C.13:2-8.7 and N.J.A.C. 13:22-8.8.

Now Therefore Be It Resolved, that the Mayor & Council of the Borough of Brielle do hereby authorize the issuance of a Club License to the Manasquan River Yacht Club, 405 Riverview Lane, Brielle, New Jersey.

Vote: Councilmen Garruzzo, Gorham, Nolan & Shaak aye; no nays. Councilman Visceglia abstained. Councilman Gianforte was absent. Passed

Resolution of the Borough of Brielle

Whereas: on February 23rd, 2015 Ocean Medical Center Foundation, 1345 Campus Pkwy Suite A2, Neptune, NJ 07753 submitted Raffle Application No. 2015-3 ID, No. 54-4-38544 for an on-site 50/50 raffle, to be held at Manasquan River Golf Club, 843 Riverview Drive Brielle NJ 08730 on Monday, June 15th, 2015 at 7pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

The foregoing is a true copy of a Resolution passed by the Mayor & Council of the Borough of Brielle at a meeting held at Borough Hall, 601 Union Lane, Brielle, New Jersey, on March 9th, 2015.
