MINUTES JANUARY 26th, 2015 WORK SESSION START: 4:00 PM

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, GORHAM & NOLAN, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN SHAAK & VISCEGLIA

Mayor Nicol announced that any member of the public wishing to audio or video record a Council Meeting must give notice to the Borough Clerk prior to the meeting being recorded.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator, who had no formal report, but asked permission to add a resolution to the consent agenda to authorize the release of a tax lien and another resolution to authorize Change Order #4 re: water tower replacement project, that represented a deduction of $7,529.00. Council gave their approval.

Mayor Nicol then read a Proclamation on Arbor Day. (See insertion).

ARBOR DAY CELEBRATION

Whereas, The State legislature has designated the last Friday in April as Arbor Day, and

Whereas, it is the purpose of this designation to encourage the planting of shade and forest trees, to encourage the harvesting of forest crops by approved conservation measures, and to encourage the protection of forests from the scourge of devastating fires, insects, and diseases that destroy the beauty and usefulness of our woodlands as well as endangering the wildlife that inhabit them, and

Whereas, public endorsement of the foregoing measures, through the observance of Arbor Day, will help to preserve the natural resources of our forests and ensure that this heritage endures for future generations.

Now Therefore, Be it proclaimed, that Friday, April 24th, 2015 be observed as Arbor Day in the Borough of Brielle, and the Governing Body hereby urges all Brielle residents to plant one or more trees in honor of the day and to actively participate in all sponsored Arbor Day activities within the Borough of Brielle.

There being no further comment, work session was adjourned at 4:32 p.m. on a motion by Councilman Gianforte, seconded by Nolan.

PRIOR TO THE MEETING BEING CONVENED THE MUNICIPAL CLERK READ THE FOLLOWING RESOLUTION (INSERT). THE RESOLUTION WAS MOVED BY COUNCILMAN GARRUZZO SECONDED BY COUNCILMAN NOLAN. VOTE: COUN. GARRUZZO, GIANFORTE, GORHAM, NOLAN; ALL AYE. NONE OPPOSED. PASSED



RESOLUTION OF THE BOROUGH OF BRIELLE



WHEREAS, an Emergency has been declared due to a snowfall of epic proportions, and

WHEREAS, it is the opinion of the Mayor & Council that the need to hold the scheduled council meeting is in the public interest, as action has to be taken on the passage of a bond ordinance to ensure that NJITF funding was not compromised, and

WHEREAS, the Governor had earlier declared a state of emergency and it was deemed inadvisable to wait until the regularly scheduled time as it could pose a potential hazard to those attending, and

WHEREAS, the Open Public Meetings Act provides for such an emergency and the Municipal Clerk did cause notice of the change in time to be posted electronically on the Borough's Electronic Sign, the Municipal Web-Site, and Facebook, as well as being posted at Borough Hall and being disseminated to the press.

NOW THEREFORE BE IT RESOLVED, that the January 26th Meeting of the Brielle Mayor & Council shall now be held at 4:00 pm prevailing time.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the January 5th, 2015 meetings were approved on a motion by Councilman Gianforte seconded by Councilman Garruzzo; all aye; no nays. Passed

Councilman Garruzzo seconded by Councilman Nolan, introduced Resolution 15-17 for Passage of the Consent Agenda.

Councilman Garruzzo, seconded by Councilman Nolan introduced Resolution 15-18 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of January 26th, 2015, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gianforte, Gorham & Nolan: all aye. No nays. Passed

Mayor Nicol announced that the time had arrived for a hearing and further consideration of “A BOND ORDINANCE PROVIDING FOR VARIUOS WATER-SEWER UTILITY IMPROVEMENTS, AND AUTHORIZING THE ISSUANCE OF $2,200,000 THEREFORE AND AUTHORIZING THE ISSUANCE OF $2,200,000 BONDS AND NOTES TO FINANCE A PORTION OF THE COSTS THEREOF, AUTHORIZED IN AND BY THE BOROUGH OF BRIELLE, IN THE COUNTY OF MONMOUTH, NEW JERSEY.

The hearing was opened on a motion by Councilman Gianforte seconded by Councilman Nolan.

The Administrator explained that the ordinance would provide funding for the replacement of the Union Lane Water Main and the demolition of the existing water tank.

The hearing was closed on a motion by Councilman Gianforte seconded by Councilman Gorham.

Councilman Gianforte seconded by Councilman Gorham, introduced resolution 15-19 for adoption on passage and final reading. Vote: Councilmen Garruzzo, Gianforte, Gorham and Nolan; all aye. No nays. Passed

Councilman Nolan seconded by Councilman Gianforte, introduced resolution 15-20 to authorize publication of passage and adoption in the Coast Star according to Local Bond Law. Vote: Councilmen Gianforte, Gorham, Nolan; all aye. No nays. Passed

Mayor Nicol called for committee reports and recognized Councilman Gianforte who had no report. Councilman Nolan reminded the public that the Board of Recreation’s Annual Ski Trip would be held in February.

Councilman Garruzzo gave the year end police report citing 2,296 moving violation summonses and 98 parking summonses. There were 30 DWI arrests, 25 Indictable Offense arrests and 20 Disorderly Person arrests. There were also 27 summonses for Borough Ordinance Violations. Monies collected totaled $245, 355.50, with $121,408.77 going to the Borough.

Councilman Garruzzo also noted that the camera system for monitoring the Elementary School was up and running and monitoring would be on a constant basis. The Councilman also wanted the public to be aware of a new telephone scam where callers claimed to be from the IRS. A warning had been placed on the Brielle Facebook and residents were reminded to never reveal personal identification information over the telephone.

The meeting was then adjourned at 4:16 pm on a motion by Councilman Garruzzo seconded by Councilman Gorham.

Resolution No: 15-17-A
Date: January 26th, 2015

RESOLUTION OF THE
GOVERNING BODY OF THE BOROUGH OF BRIELLE

Whereas, the Borough of Brielle did advertise in the Asbury Park Press for bids for the replacement of the Union Lane Water Main and the Demolition of an existing Water Storage Tank, and

Whereas, bids were received by the Borough on January 7th, 2015, and

Whereas, the Bid Bond and Consent of Surety were found to be in order, and funds are available to undertake this work.

Now Therefore Be It Resolved, that the bid submitted by O.T.S. NJ., LLC 340 Bismark Road Jackson, N.J. 08527, in the amount of $1,047,325.00 is hereby accepted, subject to the final approval of the New Jersey Department of Environmental Protection.

Be It Further Resolved, that the Municipal Clerk is hereby authorized to initiate the contract upon receipt of said N.J.D.E.P. approval.

Vote: Councilmen Garruzzo, Gianforte, Gorham & Nolan; aye. No nays. None abstained.
Absent: Councilmen Shaak & Visceglia.

Resolution of the Borough of Brielle


Whereas: on January 9th, 2015 Brielle Fire Co. # 1 Inc., 509 Longstreet Ave, Brielle, NJ 08730 submitted Raffle Application No. 2015-1 ID No. 57-9-9394 for an off-site 50/50 raffle, to be held at Brielle Park 644 Union Lane Brielle, NJ 08730 on Saturday, September 12th, 2015 at 10am to 7pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

RESOLUTION OF THE BOROUGH OF BRIELLE

Whereas, the Borough of Brielle has formed in accordance with the applicable State Statutes, and

Whereas, the Governing Body has an obligation to provide for municipal court services, and such services require the appointment of a Municipal Court Judge, and

Whereas, Paul J. Capotorto is eminently qualified to serve as Municipal Court Judge for the Borough of Brielle

Now Therefore Be It Resolved, that Paul J. Capotorto is hereby appointed to serve Brielle as Municipal Court Judge for a three year term to commence January 1st, 2015 and to end on December 31st, 2017.
