MINUTES APRIL 14th, 2014 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCILMEN GARRUZZO, GIANFORTE, GORHAM, SHAAK, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NOLAN and VISCEGLIA

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator, who advised Council that he had nothing to report, however there was a need to add resolution “H” to the consent agenda and no need for Executive Session at the conclusion of the regular meeting.

Mayor Nicol then asked Councilman Gorham, who had first-hand experience of preeclampsia, his spouse having had the condition, to read the following Proclamation (see insertion). The proclamation was accepted by Stacy Nappi and Larry Bloomstein.

WHEREAS, Preeclampsia, including HELLP syndrome and eclampsia, is a dangerous condition of pregnancy that can, in its severest form, lead to maternal and/or infant mortality or premature birth with significant health risks for the mother and baby, and
WHEREAS, As many as 320,000 cases of preeclampsia are diagnosed in America every year with approximately 25% resulting in severe, life-threatening consequences to a pregnant woman and her baby, and
WHEREAS, Public education as to the signs and symptoms of preeclampsia, HELLP syndrome and eclampsia can help women recognize the condition and seek appropriate medical care, and
WHEREAS Prenatal education should include recognition of those signs and symptoms (spikes in maternal blood pressure, sudden swelling of face and hands, severe upper abdominal pain, blurred vision, persistent headaches, breathlessness), and
WHEREAS Many citizens of the Borough of Brielle have joined with the Preeclampsia Foundation to raise public awareness in order to minimize maternal and infant illness and death due to preeclampsia.
NOW, THEREFORE, I, Honorable Thomas B. Nicol, Mayor of the Borough of Brielle do hereby proclaim May, 2014, as

PREECLAMPSIA AWARENESS MONTH

In the Borough of Brielle, New Jersey. By This Action, let it be known that we support The Preeclampsia Foundation’s efforts to reduce maternal and infant illness and mortality due to Preeclampsia and Related Hypertensive Disorders of Pregnancy.


There being no further comment, work session was adjourned at 7:34 p.m. on a motion by Councilman Gianforte, seconded by Councilman Garruzzo.

ABSENT: NOLAN and VISCEGLIA

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the March 24th, 2014 Regular meeting were approved on a motion by Councilman Shaak seconded by Councilman Gorham; all aye; no nays. Passed

Councilman Garruzzo seconded by Councilman Shaak, introduced Resolution 14-42 for Passage of the Consent Agenda.

B. To approve an Eagle Scout Service Project re: Zachary Kristen Hauge.
C. To accept a proposal from PS&S for NJEIT Support, Additional Design Services Re-Bid of a Water Main Improvement on Union Lane. Project to include additional Construction Management services as required by NJEIT, at a cost not to exceed $56,000.00.

Vote: Councilmen Garruzzo, Gianforte, Gorham and Shaak; all aye, No nays. Passed Note: as a result of conflict “A” and “H” were treated separately

Councilman Shaak seconded by Councilman Gorham, introduced Resolution “A”. Vote: Councilmen Gianforte, Gorham, Shaak and Mayor Nicol aye. No nays. Passed Councilman Garruzzo abstained.

Councilman Shaak seconded by Councilman Gianforte, introduced Resolution “H”. Vote: Councilmen Garruzzo, Gorham, Shaak and Mayor Nicol aye. No nays. Passed Councilman Gianforte abstained.

Mayor Nicol then appointed Councilman Shaak to the Finance Committee for purposes of this meeting.

Councilman Gianforte seconded by Councilman Gorham introduced Resolution 14-43 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of Page 31

April 14th, 2014, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Councilmen Garruzzo, Gianforte, Gorham, and Shaak:

all aye. No nays. Passed

Mayor Nicol then called for committee reports. Councilmen Gianforte & Gorham had no reports.

Councilman Shaak informed the public that the Public Works Department would be working with the Elementary School’s Eco-Moms & Woman’s Club to provide 400 trees to residents to celebrate Earth Day and offset losses incurred during Hurricane Sandy. Seedlings will be distributed April 16th through 21st.

Mayor Nicol interjected that, due to Councilman Shaak’s good relations with NJDOT, the state had been repaving the exit and entry ramps along Route #35 after the harsh weather of the past winter. The Mayor thought that they were doing an excellent job.

Councilman Garruzzo cited the March Police Report and noted 16 adult arrests, 26 First Aid Calls, 5 Motor Vehicle accidents and 13 alarms answered.

There being no further public comment the meeting was adjourned at 7:50 p.m. on a motion by Councilman Gianforte seconded by Councilman Garruzzo.

Resolution No: 14-42-A Date: April 14th, 2014



Resolution of the Borough of Brielle



Whereas, an application has been filed for a Person-To-Person Transfer of Plenary Retail Consumption License #1308-33-012-011 heretofore issued to 2G2K, LLC for premises located at 601 Union Avenue, Brielle, New Jersey, and

Whereas, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current License term, and

Whereas, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as the pertinent local ordinances and conditions consistent with Title 33, and

Whereas, the Governing Body has no objection to this transfer and consents to the transfer taking effect as soon as the Division of Alcoholic Beverage Control concludes its review pursuant to N.J.S.A.33:1-20 AND N.J.A.C. 13:2-4.1.

Now Therefore Be It Resolved, that the Governing Body of the Borough of Brielle hereby approves the transfer of License #1308-33-012-011 from 2G2K, LLC, to Brielle Union Partners, LLC for premises located at 601 Union Avenue Brielle, New Jersey.

WHEREAS, an application was filed with the Brielle Planning Board for an informal hearing, and

WHEREAS, it has been found that this informal hearing is not eligible to be heard by the Board as it involves a Use Variance, and

WHEREAS, the applicants are not sure they want to come before the Board with a formal application at this time,

WHEREAS, it is the policy of Borough of Brielle to treat employees and prospective employees in a manner consistent with all applicable employment laws and regulations including, but not limited to Title VII of the Civil Rights Act of 1964, as amended by the Equal Opportunity Act of 1972, the Age Discrimination in Employment Act, the Equal Pay for Equal Work Act, the Fair Labor Standards Act, the New Jersey Law Against Discrimination, the Americans with Disabilities Act, the Family and Medical Leave Act, the Conscientious Employee Protection Act, the Public Employee Occupational Safety and Health Act, (the New Jersey Civil Service Act,) (the New Jersey Attorney General's guidelines with respect to Police Department personnel matters,) the New Jersey Workers Compensation Act, the Federal Consolidated Omnibus Budget Reconciliation Act (COBRA) and the Open Public Meeting Act; and

WHEREAS, the Mayor and Council has determined that there is a need for personnel policies and procedures to ensure that employees and prospective employees are treated in a manner consistent with these laws and regulations.

NOW, THEREBY, BE IT RESOLVED by the Mayor and Council that the Personnel Policies and Procedures Manual attached hereto is hereby adopted.

BE IT FURTHER RESOLVED that these personnel policies and procedures shall apply to all Borough officials, appointees, employees, volunteers and independent contractors. In the event there is a conflict between these rules and any collective bargaining agreement, personnel services contract or Federal or State law, the terms and conditions of that contract or law shall prevail. In all other cases, these policies and procedures shall prevail.

BE IT FURTHER RESOLVED that this manual is intended to provide guidelines covering public service by borough employees and is not a contract. The provisions of this manual may be amended and supplemented from time to time without notice and at the sole discretion of the Mayor and Council.

BE IT FURTHER RESOLVED that to the maximum extent permitted by law, employment practices for the Borough shall operate under the legal doctrine known as "employment at will."

BE IT FURTHER RESOLVED that Nicholas Montenegro is hereby appointed as (Employment Attorney/Advisor title) to advise the Borough in personnel matters.) Drafting note: Use this clause if the Employment Attorney or Employment Advisor is someone else than the General Counsel.

BE IT FURTHER RESOLVED that the Administrator and all managerial/supervisory personnel are responsible for these employment practices. The Deputy Clerk and the Borough shall assist the Administrator in the implementation of the policies and procedures in this manual.

Whereas: on April 2nd, 2014 The Order of the Evergreen Ocean County , 1405 Old Freehold Rd., Toms River, NJ 08753 submitted Raffle Application No. 2014-6 ID, No. 107-5-32239 for an on-site Gift raffle, to be held at Manasquan River Golf Club, 843 Riverview Drive Brielle, NJ 08730 on Monday, June 9th, 2014 at 12:30-8pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.
