MINUTES August 26th, 2013 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCIL MEMBERS GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO AND DEPUTY MUNICIPAL CLERK MCMENAMY

ABSENT: NONE
Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Deputy Clerk, who had nothing to report for the Administrator.

Liam Tobin presented his Eagle Scout project for Nienstedt Island. He shared the details of cleaning up and marking the trails, marking off the poison ivy, cleaning up the east side of the island, and mark different varieties of trees and plants. He will also post a sign with a map of the island, the history of the island and the rules of the island.

Councilman Nolan commented on the excellent presentation Liam had made to the Environmental Commission. Councilwoman Scott added her approval of the presentation.

There being no public comment the hearing was closed and the work session adjourned at 7:40 p.m. on a motion by Councilman Shaak and seconded by Councilman Visceglia.

ABSENT: NONE

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the August 12th, 2013 meeting were approved on a motion by Councilwoman Scott seconded by Councilman Nolan; all aye; no nays. Passed.

Councilman Garruzzo seconded by Councilman Gorham, introduced Resolution 13-71 For Passage of the Consent Agenda.

Councilman Nolan, seconded by Councilman Gorham introduced Resolution 13-72 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of August 26th, 2013, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gorham, Nolan, Scott Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Councilwoman Scott who announced upgrades to the public works yard. Two yellow roll-off containers have arrived for co-mingle recyclables. Blue containers will be arriving shortly for paper. We have already received $2000 for recycling comingles and $636 for recycling scrap metal. Also we will be adding more recycling containers to our local businesses. Councilwoman Scott added the Borough now charges $5 for the disposal of three latex paint cans or one propane tank, payable at Borough Hall. Councilwoman Scott announced bulk pickup week would be during the week of October 7th through the 11th. She continued with her report stating the cleanup that was taking place with the Jetvac, painting of the curbs and maintenance of Carpenter’s Park. She mentioned the updates to the Borough website under the Public Works section. Councilwoman Scott finished her report with praises to the department’s hard work in keeping the town well maintained.

Councilman Nolan announced the Library will be having their Annual Book Sale September 5th through the 7th. The Library will be hosting Pasta FaJoeLeone on October 10th with more details to follow. Councilman Nolan continued with the Recreation’s Brielle Day Dash being held on September 6th, opened to children 10 and under. Also the Coaster Derby is scheduled for September 28th.

Councilwoman Scott remembered one detail she had forgotten; the Borough Yard was accepting concrete for two weeks only.

Councilman Garruzzo, Shaak, Gorham and Visceglia having no report, the Mayor opened the meeting to public comment.

Bob Corbit 302 Brielle Avenue, addressed the mayor and council with an ongoing flooding problem near his home. He explained the water from Borrie and Woodland Avenues run down his street towards the creek. Since the storm, he added the water does not run through the pipes as well. He requested Public Works check and clean out the underground pipes. The Mayor responded that the superintendent of Public Works would contact him in the morning.

The meeting was adjourned at 7:55pm on a motion by Councilman Garruzzo, seconded by Councilman Visceglia.

RESOLUTION FOR RENEWAL OF MEMBERSHIP IN THE MONMOUTH MUNICIPAL JOINT INSURANCE FUND

WHEREAS, the Borough of Brielle is a member of the Monmouth Municipal Joint Insurance Fund; and

WHEREAS, said renewed membership terminates as of December 31st, 2013 unless earlier renewed by agreement between the Municipality and the Fund; and

WHEREAS, the Municipality desires to renew said membership;
NOW THEREFORE, be it resolved as follows:
1. The Borough of Brielle, agrees to renew its membership in the Monmouth Municipal Joint Insurance Fund and to be subject to the Bylaws, Rules and Regulations, coverages, and operating procedures thereof as presently existing or as modified from time to time by lawful act of the Fund.

2. The Mayor and Clerk shall be and hereby are authorized to execute the agreement to renew membership annexed hereto and made a part hereof and to deliver same to the Monmouth Municipal Joint Insurance Fund evidencing the Municipality's intention to renew its membership.

AGREEMENT TO RENEW MEMBERSHIP IN THE
MONMOUTH MUNICIPAL JOINT INSURANCE FUND

WHEREAS, the Monmouth Municipal Joint Insurance Fund (hereinafter the Fund) is a duly chartered Municipal Insurance Fund as authorized by NJSA 40A:10-36 et seq., and;

WHEREAS, the Borough of Brielle is currently a member of said Fund, and;

WHEREAS, effective December 31, 2013, said membership will expire unless earlier renewed, and;

WHEREAS, the Mayor and Council of the borough of Brielle has resolved to renew said membership;

NOW THEREFORE, it is agreed as follows:

1. The Borough of Brielle hereby renews its membership in the Monmouth Municipal Joint Insurance Fund for a three (3) year period, beginning January 1, 2014 and ending December 31, 2016*.
2. The Borough of Brielle hereby ratifies and reaffirms the Indemnity and Trust Agreement, Bylaws and other organizational and operational documents of the Monmouth Municipal Joint Insurance Fund as from time to time amended and altered by the Department of Insurance in accordance with the Applicable Statutes and administrative regulations as if each and every one of said documents were re-executed contemporaneously herewith.
3. The Borough of Brielle agrees to be a participating member of the Fund for the period herein provided for and to comply with all of the rules, regulations and obligations associated with said membership.
4. In consideration of the continuing membership of the Borough of Brielle in the Monmouth Municipal Joint Insurance Fund agrees, subject to the continuing approval of the commissioner of Insurance, to accept the renewal application of the Borough of Brielle.
5. Executed the 26th day of August, 2013 as the lawful and binding act and deed of the Borough of Brielle, which execution has been duly authorized by public vote of the governing body.

Monmouth Municipal
Joint Insurance Fund

Date: August 26th, 2013

Resolution for approval to submit a grant application and execute a grant contract with the New Jersey Department of Transportation for the Holly Hill Drive Phase II project.

Whereas, the State of New Jersey, Department of Transportation has notified all municipalities of the availability of funding under the Transportation Trust Fund Municipal Aid Program for the fiscal year 2014; and

Whereas, the Borough of Brielle is desirous of submitting an application under this program for the following purpose:

Improvements to Holly Hill Drive Phase II from Birch Drive (extended) to Riverview Drive

Now, therefore be it resolved that the Mayor and Council of Brielle formally approves the grant application for the above stated project.

Be it further resolved that the Mayor and Council along with the Clerk are hereby authorized to submit an electronic grant application identified as MA-2014-Brielle Borough-00065 to the New Jersey Department of Transportation on behalf of the Borough of Brielle.

Be it further resolved that the Mayor and Council along with the Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of Brielle and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.

BOROUGH OF BRIELLE
RESOLUTION

WHEREAS, the Borough is a party to an existing lease agreement entitled Existing Water Tower Site Lease Agreement dated May 23, 2006 whereby the Borough, as Landlord and New Cingular Wireless PCS, LLC, leased certain space upon the existing Borough water Tower located along Old Bridge Road and identified on the Borough Tax Map as Block 9-0 Lot 2.01; and

WHEREAS, the parties to the existing lease have negotiated an amendment for the purpose of replacing the 12 existing antennas along with additional radioheads to upgrade from 3G to 4G service; and

WHEREAS, the proposed lease is annexed hereto and has been approved by counsel for AT&T.

NOW THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Brielle as follows:

1. The foregoing recitals are incorporated herein by reference.

2. The Governing Body is authorized to execute the attached upon review and approval of the Borough Engineer and Borough Attorney.
