PRESENT: MAYOR NICOL, COUNCIL MEMBERS GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO AND DEPUTY MUNICIPAL CLERK MCMENAMY

ABSENT: NONE
Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Deputy Clerk, who had nothing to report for the Administrator.

There being no public comment the hearing was closed and the work session adjourned at 7:35 p.m. on a motion by Councilman Shaak and seconded by Councilman Garruzzo.

ABSENT: NONE

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the July 8th, 2013 meeting were approved on a motion by Councilwoman Scott seconded by Councilman Nolan; all aye; no nays. Passed.

Councilman Garruzzo seconded by Councilman Gorham, introduced Resolution 13-65 For Passage of the Consent Agenda.

Resolution:

Vote: Councilman Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed. (Councilman Garruzzo abstained from A & D)

Councilman Garruzzo spoke of the many years of service Lt. Krueger has dedicated to the Borough of Brielle. He read the resolution to promote Lt. Krueger to Captain. Afterwards, the Krueger family came forward and posed for a picture with the Chief and Councilman Garruzzo. Captain Krueger thanked the Mayor and Council for the promotion.

Councilman Shaak, seconded by Councilman Gorham introduced Resolution 13-66 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of July 22nd, 2013, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gorham, Nolan & Scott; all aye. No nays. Passed.

Mayor announces that the time had arrived for the introduction and passage on the first reading of a “Bond Ordinance providing for various water-sewer utility improvements and appropriating $3,800,000 therefor and authorizing the issuance of $3,610,000 bonds and notes to finance a portion of the costs thereof, authorized in and by the Borough of Brielle, in the County of Monmouth, New Jersey”

The hearing was opened on a motion by Councilman Garruzzo, seconded by Councilman Nolan: all aye.

Hearing no comments, the hearing was closed on a motion by Councilman Shaak, seconded by Councilman Garruzzo.

Councilman Garruzzo, seconded by Councilman Visceglia introduced Resolution 13-67 for passage on the final reading of the foregoing ordinance. Vote: Council members Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye, no nays. Passed.

Councilman Garruzzo, seconded by Councilman Nolan, introduced Resolution 13-68 To authorize publication of the foregoing Bone Ordinance in the Coast Star, in accordance with Local Bond Law. Vote: Council members Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye, no nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Councilwoman Scott who announced several aspects of how the public works yard is changing. A new red roll-off container has arrived for metal located next to cardboard. We took our first load of approximately 8 tons to be recycled. Outdoor firewood was expected to be available by the weeks end. The Borough has purchased a log splitter to help recycle the wood and make it available to the residents. We have a barrel available for small scrap metal pieces and you can contact the Borough for pickup of large metal pieces. Councilwoman Scott added to stay tune for upcoming details on disposal of latex paint and propane tanks.

Councilman Nolan advised of the Recreation Phillies/Dodgers Bus trip on August 18th, $45 includes bus and ticket. Also Flag Football sign-ups are on Thursday, July 25th. On August 6th, the Recreation Department, Library, Fire Department and the School will join together for “A night out against crime”. The Library is holding an event on Tuesday, July 23rd from 6:30 - 7:30 pm; Emerald Financial will conduct a class on maximizing social security income.

Councilman Garruzzo reiterated the excellent service Captain Krueger has displayed.

Councilmen Shaak, Gorham and Visceglia having no report, the Mayor opened the meeting to public comment.

The meeting was adjourned at 7:53pm on a motion by Councilman Garruzzo, seconded by Councilman Visceglia.

Resolution No.: 13-65-A
Date: July 22nd, 2013

RESOLUTION OF THE BOROUGH OF BRIELLE, COUNTY OF MONMOUTH, STATE OF NEW JERSEY, RESCINDING BOROUGH RESOLUTION 13-46-A

WHEREAS, the Borough Council of the Borough of Brielle, County of Monmouth, State of New Jersey (the “Borough”) previously adopted Resolution 13-46-A which Resolution approved an application for a Person-To-Person Transfer of Plenary Retail Consumption License #1308-33-012-011, from CB Brielle, L.L.C. (pocket license) to 2G2K, L.L.C. for premises located at 601 Union Avenue, Brielle, New Jersey; and

WHEREAS, pursuant to N.J.S.A. 33:1-20 and N.J.A.C. 13:2-4.1 through 4.6, a municipal issuing authority may not transfer a license to or from any corporation, organization or association in which any of its members holds a direct or indirect interest; and

WHEREAS, a current member of the Governing Body is a member of the applicant entity and therefore, such relationship creates a conflict of interest and requires the New Jersey Division of Alcoholic Beverage Control to assume jurisdiction of the said license transfer; and

NOW, THEREFORE, BE IT RESOLVED, this 22nd day of July, 2013, by the Borough Council of the Borough of Brielle, County of Monmouth, State of New Jersey, as follows:
1. Resolution 13-46-A is hereby rescinded.
2. The Borough Council authorizes and directs the Mayor, Borough Clerk, and Borough Attorney, to execute any and all necessary documents in order to implement the intent of this Resolution.
3. A certified copy of this Resolution shall be forwarded by the Borough Administrator to the following:
(a) N.J. Division of Alcoholic Beverage Control Licensing Bureau
(b) Mayor Thomas B. Nicol
(c) Borough Attorney Nicholas C. Montenegro, Esq.
(d) Timothy B. Neumann, Esq., Applicant’s Counsel

CERTIFICATION

RESOLUTION OF THE BOROUGH OF BRIELLE

WHEREAS: the need has arisen in the Borough of Brielle to provide for a Captain in the Brielle Police Department, and

WHEREAS: the Public Safety Committee has considered the recommendation of the Chief of Police.

NOW THEREFORE BE IT RESOLVED: that Lieutenant Thomas Krueger be promoted to the rank of Captain effective July 22nd, 2013.

Whereas: on July 8th, 2013 Ask Me About SPD, 638 Holly Hill Drive Brielle, NJ 08730 submitted Raffle Application No. 2013-14 ID, No. 57-5-40077 for an Off-Site raffle, to be held at 301 Union Avenue Brielle NJ 08730 on Saturday, Sept. 14th, 2013 at 12pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

RESOLUTION OF THE BOROUGH OF BRIELLE, COUNTY OF MONMOUTH, STATE OF NEW JERSEY, CONSENTING TO THE ISSUANCE AND TRANSFER OF PLENARY RETAIL CONSUMPTION LICENSE FROM CB BRIELLE, L.L.C. TO 2G2K L.L.C.

WHEREAS, an application has been filed for a Person-To-Person and Place-To-Place Transfer of Plenary Retail Consumption License #1308-33-012-011 heretofore issued to CB Brielle, LLC for premises located at 601 Union Avenue, Bridle, New Jersey; and

WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current License term; and

WHEREAS, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as the pertinent local ordinances and conditions consistent with Title 33; and

WHEREAS, the Governing Body has no objection to the aforementioned Plenary Retail Consumption License transfer from CB Brielle, L.L.C. to 2G2K, L.L.C., as per the correspondence received from the Brielle Police Department; and

WHEREAS, pursuant to N.J.A.C. 13:2-4.6, the Governing Body is not aware of any circumstances or provisions of law or local ordinance which would prohibit the issuance, renewal or the transfer, of the said Plenary Retail Consumption License; and

NOW, THEREFORE BE IT RESOLVED, that the Governing Body of the Borough of Brielle hereby consents to the transfer of License #1308-33-012-011 from CB Brielle, L.L.C., to 2G2k, L.L.C. for premises located at 601 Union Avenue, Brielle, New Jersey.

Resolution of the Borough of Brielle, County of Monmouth, New Jersey,
Authorizing the Shore Community Alliance the use of the $1000 Grant for Project PACKMAN program

WHEREAS, the Borough of Brielle, County of Monmouth, State of New Jersey recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages: and

WHEREAS, the Borough Council further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and

WHEREAS; the Borough Council has applied for funding from the Governor's council on Alcoholism and Drug Abuse through the County of Monmouth; and

NOW, THEREFORE BE IT RESOLVED on the 22nd day of July, 2013 by the Borough Council of the Borough of Brielle, in the County of Monmouth and State of New Jersey as follows:
1. The Borough Council does hereby authorize the Shore Alliance to use the “One Time Only” DEDR Funds for the Project PACKMAN Program.
2. The Borough Council acknowledges the terms and conditions for administering the Municipal Alliance grant, including the administrative compliance and audit requirements.
