PRESENT: MAYOR NICOL, COUNCIL MEMBERS GARRUZZO, GORHAM, SCOTT, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO AND DEPUTY MUNICIPAL CLERK MCMENAMY

ABSENT: NOLAN
Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Deputy Clerk, who had nothing to report for the Administrator.

There being no public comment the hearing was closed and the work session adjourned at 7:35 p.m. on a motion by Councilman Gorham and seconded by Councilman Garruzzo.

ABSENT: NOLAN

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the June 10th, 2013 meeting were approved on a motion by Councilwoman Scott seconded by Councilman Visceglia; all aye; no nays. Passed.

Councilman Garruzzo seconded by Councilman Visceglia, introduced Resolution 13-57 For Passage of the Consent Agenda.

Resolution:

Vote: Councilman Garruzzo, Gorham, Scott, Shaak & Visceglia; all aye. No nays. Passed. Note: Councilman Garruzzo abstained on “B” and Nolan abstained on “A”.

Councilman Visceglia, seconded by Councilman Shaak introduced Resolution 13-58 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of June 24th, 2013, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gorham, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Councilwoman Scott who announced there would be no recycling pick up on July 4th. She added that residents could drop off their recyclables during the week. Councilwoman was happy to report the availability of free firewood to the residents which keeps the cost of dumping the wood down. She continued with the installation of a new water fountain behind the Curtis House near the playground and the donated oil tank which will be utilized to collect waste oil to be recycled. Councilwoman shared the web site for reporting a street light outage or receiving power outage information (www.firstenergycorp.com). Councilwoman closed with information to come about a fall compositing workshop.

Councilman Garruzzo started his report by thanking Manasquan and Wall Police Departments and Monmouth County Prosecutors office for helping in the investigation. He praised Sgt.

McWilliams and Patrolman Sofield who were the first officers to security the scene and tend to the victim. Councilman Garruzzo recognized Lt. Krueger, Detective Sgt. Stewart and Patrolman Meixsell for handling the different aspects of the investigation. Further, He thanked Sgt. Olsen and Sgt. Mechler for assisting late night with the shift duties.

Councilman Shaak had no report but he shared his appreciation of the excellent work the Police Department and EMS squad did during the events of last week.

Councilmen Gorham & Visceglia having no formal report, the Mayor opened the meeting to public comment.

Dan Healy, 643 Woodland Ave. asked if the Public Works could cut back the vines growing over his fence from Borough property. Councilwoman Scott assured Mr. Healy the Borough would take care of the situation and directed him to speak with Bob McArthur after the meeting.

Briana Townsend from The Coast Star asked when the contract with Birdsall would have expired. Mayor Nicol responded December 31st, 2013.

The meeting was adjourned at 7:44pm on a motion by Councilman Gorham, seconded by Councilman Visceglia.

RESOLUTION OF THE BOROUGH OF BRIELLE, COUNTY OF MONMOUTH, STATE OF NEW JERSEY, TERMINATING BIRDSALL SERVICES GROUP AS BOROUGH ENGINEER

WHEREAS, the Borough of Brielle, County of Monmouth, State of New Jersey (the “Borough”) previously contracted with Birdsall Services Group, Inc., as the municipality’s professional engineering firm which contract, a Professional Services Agreement, commenced on or about January 1, 2013; and

WHEREAS, due to recent events involving the financial solvency and professional integrity of Birdsall Services Group, the Borough has determined that it is in the best interests of the municipality to terminate the professional engineering services of Birdsall Services Group, effective June 24, 2013; and

WHEREAS, the Borough shall appoint an Interim Borough Engineer for the remaining balance of the Professional Services Agreement entered into with Birdsall Services Group, which interim period shall commence June 24, 2013; and

NOW, THEREFORE, BE IT RESOLVED, this 24th day of June, 2013, by the Borough Council of the Borough of Brielle, County of Monmouth, State of New Jersey, as follows:

1. The services of the Borough’s Professional Engineer Birdsall Services Group, are hereby terminated effective immediately; and
2. The Borough shall appoint an Interim Borough Engineer whose term shall expire on the same date as that which is set forth in the existing Professional Services Agreement awarded to Birdsall Services Group, which date is December 31, 2013; and
3. The appointment of Interim Professional Engineer shall not result in any additional expenditure of funds by the Borough, as the Interim Engineer shall be limited to the same duties and responsibilities set forth in the Borough’s existing Professional Services Agreement previously executed between the municipality and its former professional engineering firm, Birdsall Services Group.
4. The Borough Council authorizes and directs the Mayor, Borough Clerk, Borough Attorney, and the Borough’s professional staff to execute any and all necessary documents in order to implement the intent of this Resolution.
5. A certified copy of this Resolution shall be forwarded by the Borough Administrator to the following:
(a) Mayor Thomas B. Nicol
(b) Borough Attorney Nicholas C. Montenegro, Esq.
(c) Birdsall Services Group

RESOLUTION OF THE BOROUGH OF BRIELLE, COUNTY OF MONMOUTH, STATE OF NEW JERSEY, APPOINTING ALAN P. HILLA, JR., P.E. OF LEON S. AVAKIAN INC., TO SERVE AS BOROUGH ENGINEER FOR THE BALANCE OF THE REMAINING CONTRACT TERM PREVIOUSLY OCCUIPIED BY BIRDSALL ENGINEERING

WHEREAS, the Borough of Brielle, County of Monmouth, State of New Jersey (the “Borough”) previously contracted with Birdsall Services Group, Inc., as the municipality’s professional engineering firm; and

WHEREAS, recently, Birdsall Services Group was removed as the Borough Engineer, as per the decision of the Governing Body on June 24, 2013; and

WHEREAS, the Borough is in need of a temporary replacement to serve the municipality’s civil engineering and planning projects currently underway; and

WHEREAS, the Borough has reviewed the professional credentials and experience of Leon S. Avakian, Inc., 788 Wayside Road, Neptune, New Jersey and is satisfied with same; and

WHEREAS, the Borough has determined that the engineering firm of Leon S. Avakian, Inc. is qualified to immediately assume the duties and responsibilities of an interim Borough Engineer; and

NOW, THEREFORE, BE IT RESOLVED, this 24th day of June, 2013, by the Borough Council of the Borough of Brielle, County of Monmouth, State of New Jersey, as follows:

1. Alan P. Hilla, Jr., P.E., of Leon S. Avakian, Inc. is hereby appointed as Interim Borough Engineer to serve the remaining contract term previously held by Birdsall Services Group; and
2. The appointment of Interim Engineer shall expire on the same date as that which is set forth in the existing Professional Services Agreement awarded to Birdsall Services Group, which date is December 31, 2013; and
3. Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.
