MINUTES June 10th, 2013 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCIL MEMBERS GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN.

ABSENT: NONE
Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator, who had nothing to report, but he advised the Council that John Devereux and the Board of Recreation was present to make a presentation to Robert Paturzo and Grace Neilsen.

Mr. Devereux cited their individual projects, but most important was the fact that these endeavors had a positive impact on the community.

The Mayor also was impressed by their community oriented activities.

The Administrator then informed the Council that the wrong liquor license should be up for renewal, it should be the ShipWreck, LLC #1398-33-005-004.

There being no public comment the hearing was closed and the work session adjourned at 7:40 p.m. on a motion by Councilman Nolan and seconded by Councilman Garruzzo.

MINUTES June 10th, 2013 START: 7:42P.M.

PRESENT: MAYOR NICOL, COUNCIL MEMBERS GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN.

ABSENT: NONE

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the May 28th, 2013 meeting were approved on a motion by Councilman Nolan seconded by Councilman Gorham; all aye; no nays. Passed. Councilman Shaak abstained.

Councilman Shaak seconded by Councilman Visceglia, introduced Resolution 13-55 For Passage of the Consent Agenda.

Resolution:

Vote: Councilman Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed. Note: Councilman Garruzzo abstained on “B” and Nolan abstained on “A”.

Councilman Visceglia, seconded by Councilman Gorham introduced Resolution 13-56 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of June 10th, 2013, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Councilwoman Scott who argued the public to attend the Annual Flag Day Ceremony at the 9/11 Memorial. Councilwoman Scott also cited her attendance at the Eagle Scout Court of Honor.

Councilman Nolan advised that the Vacation Reading Club would begin. Also the library would be having a book signing on July 1st at 7:00 pm featuring Dorothy Bennett Franks author of “The Last Original Wife”.

The Zoom Balloon Museum would be a part of the June 26th Brielle Elementary Summer Carnival.

Turning to recreation, Councilman Nolan announced that the trip to Philadelphia for a Phillies/Braves baseball game was August 4th and the cost was $45.00. Summer recreation would Page 48

begin on June 25th and run through August 2nd , 2013.

Councilman Nolan also cited his attendance at the Court of Honor and he praised scouting in general throughout Brielle.

Councilman Garruzzo reminded the public that increased traffic flow meant increased accidents in the summer. In May, there were 11 motor vehicle accidents. There were 11 adult arrests, five DWI, one simple assault and five warrant arrests. Officers also responded to 19 first aid calls. Investigations included one assault, one fire, six theft reports and a death investigation.

Councilmen Gorham & Visceglia having no formal report the meeting was adjourned at 7:52pm on a motion by Councilman Gorham, seconded by Councilman Visceglia.

Resolution No.:13-56-B

BOROUGH OF BRIELLE RESOLUTION
Whereas, application has been made for the renewal of liquor license #1308-33-005-004, and

Whereas, the application is complete, the $2,225.00 fee due the Borough of Brielle and the $200.00 fee due to the State of New Jersey, Division Of Alcoholic Beverage Control have been received, and all municipal requirements have been met, and

Whereas, The Governing Body has been made aware of noise concerns at this location and the holders of the license have agreed to the imposition of conditions to address these concerns.

Now therefore be it resolved, that the following conditions are hereby imposed on license #1308-33-005-004, Ship Wreck, LLC T/A Ship Wreck Grill:

1. All doors & windows shall be kept closed whenever any live music is played
2. Regarding the use of the deck area, all conditions imposed by the Brielle Planning Board regarding the limitation of service on the deck, as stated in their resolution(8/9/95) and further memorialized in the municipal resolution 96-46-E which authorized a place-to-place transfer to permit utilization of the deck, shall be incorporated into this resolution as addendum #1
3. In the event there is any modification of the conditions imposed by the Planning Board the Municipal resolution shall mirror these conditions but it shall be the applicant’s responsibility to advise the Governing Body of any such change to ensure that the exact language is incorporated into addendum # 1.

Now therefore be it resolved, that application of Ship Wreck, LLC T/A Ship Wreck Grill for premises located at 720 Ashley Avenue Brielle, N.J., is hereby approved and the Municipal Clerk is authorized to issue the license for the license year July 1st, 2013 through June 30th, 2014.

BOROUGH OF BRIELLE RESOLUTION
Authorizing the execution of a commodity resale agreement with the County of Monmouth
Whereas, N.J.A.C. 5:34-7.15 authorizes local contracting units to enter into Commodity Resale Agreements for the purchase of certain commodities from other contracting units:

Whereas, the County of Monmouth has authorized the renewal of the Monmouth County Commodity Resale System (SYSTEM IDENTIFIER 99174-MCCRS), for the period of September 30, 2013 through September 30, 2018; and

Whereas, it would be in the best interest of this Municipality to become or remain a member of the Monmouth County Commodity Resale System for that period.

Now therefore be it resolved, by the Governing Body of the Borough of Brielle that the Mayor and Municipal Clerk be and they are hereby authorized to execute the attached Commodity Resale Agreement with the County of Monmouth.

Be it further resoled, that the Municipal Clerk forward a certified copy of the Resolution, along with the executed Commodity Resale Agreement to Stephen G. Callas, Director, Office of Shared Services, County of Monmouth, Hall of Records Annex, First Floor, 1 East Main Street, Freehold, New Jersey 07728.
