MINUTES May 28th, 2013 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUNCIL MEMBERS GARRUZZO, GORHAM, NOLAN, SCOTT & VISCEGLIA, ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN SHAAK
Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who had nothing to report, but he advised the Council that John Devereux and the Board of Recreation were present to make a presentation to the LaPoint Family from the proceeds of the recent North vs. South completion. The check totaled $12,000.00.

Mr. Devereux noted that the event had tremendous support from the community and sponsors. Councilman Nolan called it a Great Event that brought everybody out to have a good time together. He added that the North had agreed to spot a few victories to the South, but next time the gloves were off.

The 10K Committee also presented a check for the amount of $2,500.00 to the LaPoint Family, combined photograph of the donations to the LaPoint family was then taken.

There being no public comment the hearing was closed and the work session adjourned at 7:38 p.m. on a motion by Councilwoman Scott and seconded by Councilman Nolan.

MINUTES May 28th, 2013 START: 7:39P.M.

PRESENT: MAYOR NICOL, COUNCIL MEMBERS GARRUZZO, GORHAM, NOLAN, SCOTT & VISCEGLIA., ATTORNEY MONTENEGRO AND ADMINISTRATOR NOLAN.

ABSENT: COUNCILMAN SHAAK

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the May 13th, 2013 meeting were approved on a motion by Councilman Nolan seconded by Councilman Gorham; all aye; no nays. Passed.

Councilman Garruzzo seconded by Councilman Nolan, introduced Resolution 13-53 For Passage of the Consent Agenda.

Resolution:
A. To extend Police Chief Michael Palmer’s professional service contract through 2015.
B. (see insertion).
C. (see insertion).
D. To authorize Carol McMenamy to be a signatory to the payroll & general account.
E. (see insertion).
F. (see insertion).

Vote: Councilman Garruzzo, Gorham, Nolan, Scott & Visceglia; all aye. No nays. Passed. Note: Councilman Garruzzo abstained on “B”, “C” “E”, “F” and "H".

Councilman Visceglia, seconded by Councilman Gorham introduced Resolution 13-54 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of May 28th, 2013, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Council members Garruzzo, Gorham, Nolan, Scott & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Councilwoman Scott who noted that the DPW & Shade Tree Commission, acting together, had accommodated 40 trees to Brielle residents. They had also planted Yews and mulch along Leslie & Ocean Avenues. Local residents had already advised of their approval.
Turning to recycling, new bins were being installed to take cartridges, batteries from electronic devises including button batteries and waste oil. Councilwoman Scott also cited a letter from a couple on Morgan Parkway who praised DPW for their work before, during and after “Sandy”.

Councilwoman Scott also cited ICHOPE, winners of the Governor’s cup, who had donated their $5000 award to the Food Bank. They also received a second $5000 award for their organization that they Page 45

dedicated to four scholarships annually to instill leadership in the new students. The Councilwoman cited that it had been an honor to serve on the application committee and she complimented candidate Gianforte whose daughter had been the driving force in the process.

In closing, she complimented John Belding on another splendid Decoration Day Observance.

Councilman Nolan advised that the library would host a summer reading program. Also the library would be having a book signing on July 1st featuring Dorothy Benton Franks.

Recreation would conduct their final sign-ups for summer recreation on June 1st outside the Borough Hall. After June 11th, there would be a late fee of $35.00.

Councilmen Garruzzo, Gorham & Visceglia having no formal report the meeting was adjourned at 7:53pm on a motion by Councilman Gorham, seconded by Councilman Visceglia.

BOROUGH OF BRIELLE RESOLUTION
Whereas, application has been made for the renewal of liquor license #1308-31-008-001, and

Whereas, the application is complete, the $2,225.00 fee due the Borough of Brielle and the $200.00 fee due to the State of New Jersey, Division Of Alcoholic Beverage Control have been received, and all municipal requirements have been met, and

Whereas, no objections to the renewal of this license have been received.

Now therefore be it resolved, that the application of Manasquan River golf Club for premises located at 847 Riverview Drive (PO box 505), Brielle, N.J., is hereby approved and the Municipal Clerk is authorized to issue the license for the license year July 1st, 2013 through June 30th, 2014.

Whereas, application has been made for the renewal of liquor license #1308-31-007-004, and

Whereas, the application is complete, the $1,620.00 fee due the Borough of Brielle and the $200.00 fee due to the State of New Jersey, Division Of Alcoholic Beverage Control have been received, and all municipal requirements have been met, and

Whereas, no objections to the renewal of this license have been received.

Now therefore be it resolved, that the application of Jonathon Ron, Inc. T/A Jonathon Ron Liquors for premises located at 629 Higgins Avenue, Brielle, N.J., is hereby approved and the Municipal Clerk is authorized to issue the license for the license year July 1st, 2013 through June 30th, 2014.

Whereas, application has been made for the renewal of Plenary Retail Consumption license #1308-33-012-011, CB Brielle LLC. T/A Charlie Browns Steakhouse, and

Whereas, the submitted application form is complete in all respects, the renewal fees for the borough of Brielle and the State of New Jersey Division of Alcoholic Beverages Control have been paid, and

Whereas, the applicant is qualified to be licensed according to all standards established by Title 33 of New Jersey Statues, regulations promulgated thereunder, as well as pertinent local ordinances and conditions

Now therefore be it resolved, that the Governing Body of the Borough of Brielle does herby approve, effective this date the renewal license #1308-33-012-011 t/a Charlie Brown’s Steakhouse for the license year July 1st, 2013 through June 30th, 2014, subject to the following special conditions which were imposed by the Brielle Planning Board to wit:

A RESOLUTION TO APPROVE
SHARED SERVICES AGREEMENT WITH MONMOUTH COUNTY


WHEREAS, The State of New Jersey has mandated the use of the MODIV Property Assessment Computer System for all New Jersey Municipalities; and,
WHEREAS, The Board of Chosen Freeholders of the County of Monmouth, in conjunction with the County Board of Taxation, is offering the County's MOD IV Property Assessment Computer System services to the municipalities; and,
WHEREAS, A Shared Services Agreement has been proposed for this purpose, pursuant to N.J.S.A. 40A:65-1 et seq.; and,
WHEREAS, It is in the best interest of the Borough of Brielle to enter into such an Agreement;

NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Brielle
that the agreement entitled, "Agreement Between the County of Monmouth and the Borough of Brielle for MODIV Property Assessment Computer Services", a copy of which is attached hereto, be approved for the First of January, 2012 through December 31, 2021; and,
BE IT FURTHER RESOLVED, That the Mayor and Clerk be and are hereby authorized and directed to execute the contract agreement.
