PRESENT: MAYOR NICOL, COUN. GARRUZZO, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUN. GORHAM

Mayor Nicol convened the work session in compliance with the Open Public Meetings and recognized the Administrator who advised that he had nothing to report.

There being no comments the work session was adjourned at 7:32pm on a motion by Councilman Nolan seconded by Councilwoman Scott.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of October 8th, 2012 were approved on a motion by Coun. Garruzzo, seconded by Coun. Nolan; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Shaak introduced Resolution 12-87 For Passage of the Consent Agenda.

B.To authorize the clerk to advertise for bids for the provision of a Model Year 2013 Hook Lift Truck with attachments.

Coun. Visceglia, seconded by Coun. Shaak, introduced Resolution 12-88 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of October 22nd, 2012, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto.

Vote: Coun. Garruzzo, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for committee reports and recognized Coun. Scott who advised that the truck being bid was for recycling and it would have an impact on the way the center was operated. Dual handling and transfer of the material would be eliminated and the old twenty-five year old bins would be replaced by modern containers.

Councilwoman Scott also noted her recent tour of the DPW yard with 12 seven year old cub scouts who showed remarkable knowledge of the recycling process and its importance. The Councilwoman also noted that she had attended a recycling symposium last week where NJDEP and ANJR shared a number of municipal success stories with those in attendance. Awards were given and ANJR had created the new category of recycling society. Councilwoman Scott was pleased to note that she had been elected an emeritus member as a “sister” to the “mother” of recycling, Jean Clark. Both women had been instrumental in fostering recycling programs in their own communities and beyond.

In closing, the Councilwoman Scott stole from Councilman Nolan’s thunder and lauded the Board of Recreation for the Fall Festival where she viewed children at play in a variety of activities that personified the best tradition of American Family.

Councilman Nolan advised that the Library would host "Spooky Halloween with Fun on a String” at 3:30 pm on October 23rd. He also cited the success of Annual Fall Festival/Family Day held on Sunday, October 21st. He was pleased at the attendance, the music of the Glimmer Glass band, which played throughout the day and the chili cook-off contest. He added that of the sixteen entries, that included five restaurants, a Mr. Devereux was the professional winner, while a young lady named “Beth” carried the day with her chocolate chili.

Councilman Garruzzo reminded the assembly of the Halloween Curfew. Any minor under eighteen, unaccompanied by a parent, guardian, or adult having custody or care of such minor, either on foot or in a motor vehicle, within the confines of Brielle was subject to a curfew from 7:30 pm to 6:00 am during the period October 20th through November 1st. The sole exception is October 30th "Mischief Night" when the curfew would be in effect from 6:00 pm to 6:00 am.

Turning to Safety Tips, Councilman Garruzzo reminded children that they should never eat any treats until they are examined by an adult at home, never trick or treat alone, never enter a house or car of a stranger, trick or treat in your neighborhood and only visit the homes of people you know, stay on streets that are well lit and cross at the corner, never run across the street and look both ways before crossing, carry a flashlight and wear reflective tape to ensure visibility, and don’t wear dark clothing.
Councilman Shaak and Visceglia having no report and there being no questions from the public the meeting was adjourned at 7:48 pm on a motion by Councilman Shaak, seconded by Councilman Visceglia.

Resolution of the Borough of Brielle

Whereas, an application has been filed for a Person-To-Person Transfer of Plenary Retail Consumption License #1308-33-002-008 heretofore issued to Christopher Decresce/C.G. Mass, Inc. to LWC Holdings, LLC for premises located at 201 Union Lane, Brielle, New Jersey, and

Whereas, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term, and

Whereas, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as the pertinent local ordinances and conditions consistent with Title 33, and

Whereas, the Governing Body has no objection to this transfer as per the correspondence received from the Brielle Police Department, dated October 5th, 2012, and

Now Therefore Be It Resolved, that the Governing Body of the Borough of Brielle hereby approves the transfer of License #1308-33-002-008 from Christopher Decresce/C.G. Mass, Inc., to LWC Holdings, LLC for premises located at 201 Union Avenue Lane, Brielle, New Jersey.

A RESOLUTION TO AMEND BOROUGH OF BRIELLE RESOLUTION 12-13-E TO APPOINT A MUNICIPAL PROSECUTOR

Whereas, on January 9th, 2012, the Mayor & Council of the Borough of Brielle appointed the firm of Citta, Holzapfel & Zabarsky as Municipal Prosecutors, and

Whereas, the firm wishes to alter and expand the number of attorneys eligible to perform those duties for the Borough of Brielle.

Now Therefore Be It Resolved, that the following names to be added to the original enabling resolution:
Steven Zarbarsky, Esquire, Prosecutor
Christian Schlegel, Esquire, Alternate Prosecutor
Sean J. Spinello, Esquire, Alternate Prosecutor
Christopher Grenda, Esquire, Alternate Prosecutor

Be It Further Resolved, that said appointments be effective immediately.
