PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT & SHAAK. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.
ABSENT: COUN. VISCEGLIA.

Mayor Nicol convened the work session in compliance with the Open Public Meetings and recognized the Administrator who advised that he had nothing to report, but he asked for permission to add a resolution to the consent agenda to permit the Brielle Education Foundation to hold a gift raffle on Brielle Day.

There being no comments the work session was adjourned at 7:32pm on a motion by Coun. Scott, seconded by Coun. Garruzzo.

MINUTES AUGUST 13th, 2012 START: 7:33P.M.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT & SHAAK. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.
ABSENT: COUN. VISCEGLIA

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the July 23rd, 2012 were approved on a motion by Coun. Shaak, seconded by Coun. Nolan; all aye; no nays. Passed.

Coun. Scott, seconded by Coun. Nolan, introduced Resolution 12-75 For Passage of the Consent Agenda.

Resolution:
A. To support the “Drive Sober or Get Pulled Over” 2012 Statewide crackdown.
B. To authorize Birdsall Services Group to undertake a potable water system hydraulic study.
C. To appoint Glenn D. Lines, P.E.P.P as Deputy Code Enforcement Officer.
D. To authorize a Shared Service Agreement with the Borough of Sea Girt, whereby the Borough of Brielle shall provide Sea Girt with the services of a Code Enforcement Officer and a Zoning Officer.

I. To authorize the Tour De Cure to conduct their annual Bicycle Ride through Brielle on September 15th, 2012.

Coun. Gorham, seconded by Coun. Shaak, introduced Resolution 12-74 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of August 13th, 2012, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed.

Mayor Nicol then called for committee reports and recognized Coun. Scott who cited the DPW's preparations for Brielle Day. They included curb painting and edging. Coun. Scott also offered congratulations to Jack Tobin of Boy Scout Troop #63 who had been designated "Troop Leader of the Year"

Coun. Scott added that Mr. Tobin would be the first to give credit to his assistants and she also offered praise for former leader Nick Stango who, when faced with a reduced troop of only five scouts, managed to hold on until Troop #63 reached the current membership of 64 Scouts.

Coun. Nolan noted that the Library was preparing for Brielle Day and would begin its book sale on Thursday, September 6th. The sale would end on Brielle Day, September 8th, and a bag of books was just a dollar.

The Library was also conducting a raffle with the prize being tickets and transportation for two to a Broadway Play. The Late Summer Chess Club had begun on August 13th and would continue to the 16th. The fee was $60.00.

In closing, Coun. Nolan added that this year the Board of Recreation had moved the September 7th Brielle Dash to the park and he shared Coun. Scott's sentiments about Jack Tobin; he added that, when Spring Lake Heights was looking to join a Troop and could have gone anywhere, they selected Brielle, a definite mark of Troop #63's success.

Coun. Garruzzo informed the public that during the month of July the Police Department made 22 adult arrests. They included 1 aggravated assault, 1 for simple assault, 13 DWI, 2 for possession of narcotics, 1 for illegal possession of a handgun, 1 disorderly conduct and 3 warrant arrests. Coun. Garruzzo reminded the public that, as per resolution "A", the Police were cracking down on those who drove under the influence and he warned residents not to drink and drive.

Coun. Shaak cited the 125th Anniversary "Lighted Boat Parade" in Manasquan on August 21st and added that it was not too late for boaters to join the parade; it was a great event and he urged everyone to attend.

Coun. Gorham having no reports, the meeting was open to the public for comment.

Bill Williams, 709 Union Lane, was recognized and he voiced a concern over his landlord’s failure to address a problem of dying trees that adversely impacted on his quality of life. He said that the landlord was taking no responsibility and blaming the problem on feral cats.

While the Council examined pictures of the scene, Mayor Nicol asked Attorney Montenegro to address the issue. He in turn requested the Code Enforcement Officer, James Langenberger, to provide an update.

Mr. Langenberger stated that he and a representation from the MRHC#1 had inspected the site that morning. As a result the owner would be receiving a letter that required the two dead trees be removed and the stumps ground on the other two. There were no specific health violations, but a litter of feral kittens was found living in an air conditioner and the MRHC#1 would be contacting the Mosquito Commission regarding caterpillars found at the site. The owner had until August 22nd to remediate the tree issue.

The Chair then recognized Pete Johner of JCP&L. Mr. Johner provided the Council with a list of phone numbers that would enable them to directly access JCP&L in the event of an emergency.

Mr. Johner also informed the Council of the First Energy "Stem" Classroom Grants program to assist teachers Pre-K through 12 in encouraging creativity in science, technology, engineering and mathematics education. The average grant was $500.00 per teacher. Mayor Nicol advised that he would share this information with the School.

Coun. Nolan was recognized and he noted that he had forgotten to mention that the Boy Scouts would sponsor a free movie in Brielle Park at 6:00 pm, Friday August 17th.
There being no further comments, the meeting was adjourned at 7:55 pm on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

Proclamation/Resolution
Supporting the Drive Sober or Get Pulled Over 2012 Statewide Crackdown

Whereas, impaired drivers on our nation's roads kill someone every 30 minutes, 50 people per day, and almost 18,000 people each year; and

Whereas, 25% of motor vehicle fatalities in New Jersey are alcohol-related; and

Whereas, an enforcement crackdown is planned to combat impaired driving; and

Whereas, the summer season and the Labor Day holiday in particular are traditionally times of social gatherings which include alcohol; and

Whereas, the State of New Jersey, Division of Highway Traffic Safety, has asked law enforcement agencies throughout the state to participate in the Drive Sober or Get Pulled Over 2012 Statewide Crackdown; and

Whereas, the project will involve increased impaired driving enforcement from August 17th through September 3rd, 2012; and

Whereas, an increase in impaired driving enforcement and a reduction in impaired driving will save lives on our roadways;

Therefore, be is resolved that the Borough of Brielle declares its support for the Drive Sober or Get Pulled Over 2012 Statewide Crackdown from August 17th through September 3rd, 2012 and pledges to increase awareness of the dangers of drinking and driving.

RESOLUTION OF THE GOVERNING BODY OF THE BOROUGH OF BRIELLE
AWARDING A PROFESSIONAL CONTRACT

WHEREAS, the above entity has been formed pursuant to the applicable New Jersey Statutes; and

WHEREAS, in order to fulfill its statutory duties it is necessary that the Borough of Brielle retain the services of a Municipal Prosecutor; and

WHEREAS, the Borough of Brielle has retained the services of Nicholas Moschella and the firm of Citta, Hozapfel & Zarbarsky inasmuch as he is competent to fulfill the needs of the Borough of Brielle; and

WHEREAS, the Borough of Brielle wishes to establish the rate of compensation for and to be paid to said professional;

NOW, THEREFORE, be it resolved that as of this 13th day of August 2012, that;

1. Citta, Hozapfel & Zarbarsky is hereby retained by the Borough of Brielle as its Municipal Prosecutor for the calendar year 2012 to perform to the terms of the Agreement between the Municipal Prosecutor and the Borough of Brielle.

2. This Contract is awarded without competitive bidding as a "Professional Service" in accordance with N.J.S.A. 40A: I1-5(I)(a) of the Local Public Contracts Law because same involves the retaining of professional services.

3. The Chief Administrative Officer has made a determination that, in accordance with the provisions of the non-fair and open process the value of this contract is determined not to exceed the $17,500.00 threshold.

4. This contract is not subject to the provisions of N.J.S.A. 19:44A-20.5

5. Funds for payment of this contract have been provided for in the 2012 Temporary Budget and shall be included in the 2012 Municipal Budget.

6. The Borough of Brielle Clerk shall cause the attached Notice to be published in the Coast Star.
