PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, & SCOTT. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.
ABSENT: COUN. SHAAK & VISCEGLIA
Mayor Nicol convened the work session in compliance with the Open Public Meetings. The Administrator had no report and he advised the Governing Body that the winner of the annual “Snowman” contest was not present and the matter would be carried to the April 23rd meeting.
There being no comments the work session was adjourned at 7:34 p.m. on a motion by Coun. Nolan seconded by Coun. Garruzzo.

ABSENT: COUN. SHAAK & VISCEGLIA.
Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the March 26th, 2012 were approved on a motion by Coun. Nolan, seconded by Coun Garruzzo; all aye; no nays. Passed.
Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 12-46 for Passage of the Consent Agenda.
Resolution:

C. To approve Change Order No. 1, Improvements to Brielle Park, to authorize a net decrease of $432.99.
D. (see insertion)
E. To authorize the "adopt a spot" program for the Borough of Brielle.
Vote: Coun. Garruzzo, Gorham, Nolan, Scott; all aye. No nays. Passed. (Note: Coun. Nolan abstained on "D". William Brannick, 805 Schoolhouse Road made an inquiry on "C” and the Administrator advised that it reduced the original contract price on the Improvements to Brielle Park project by $432.99. As to "E" Coun. Scott explained that it was being fostered by the Chamber of Commerce. She had already met with a business owner who specialized in landscaping. He had a professional plan to make substantive improvements to a key intersection and it was hoped that it would become the catalyst for future enhancement projects throughout the Borough.)
Coun. Garruzzo, seconded by Coun. Gorham, introduced Resolution 12-36 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of April 9th, 2012, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for a hearing and further consideration of "AN ORDINANCE TO AMEND SECTION 9-1.3A OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED "CONSTRUCTION PERMIT FEES".
The hearing was opened on a motion by Coun. Garruzzo, seconded by Coun. Nolan; all aye.
The Administrator explained that the ordinance brought the Borough into conformity with the fee structure of the other three members of the shared construction service agreement and increase revenue for the Borough.
The hearing was closed on a motion by Coun. Scott, seconded by Coun. Gorham; all aye.
Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 12-48 for passage and final adoption of the foregoing ordinance. Vote: Coun. Garruzzo, Gorham, Nolan, Scott; all aye. No nays. Passed.
Coun. Scott, seconded by Coun. Gorham introduced Resolution 12-49 to authorize publication of passage and adoption in the Coast Star according to law. Vote: Coun. Garruzzo, Gorham, Nolan, Scott; all aye. No nays. Passed.
Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of “AN ORDINANCE TO AMEND CHAPTER THIRTEEN OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED”PARKS & RECREATIONAL FACILITIES”.”
Coun. Garruzzo, seconded by Coun. Gorham, introduced Resolution 12-50 for passage on introduction and first reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott; all aye. No nays. Passed.
Coun. Garruzzo seconded by Coun. Nolan introduced Resolution 12-51 to authorize publication of the foregoing ordinance in the Coast Star Newspaper for a hearing to be held at 7:30 p.m., at Borough Hall, 601 Union Lane, Brielle, New Jersey, on April 23rd, 2012. Vote: Coun. Garruzzo, Gorham, Nolan, Scott; all aye. No nays. Passed.
Mayor Nicol then called for Committee Reports and recognized Coun. Scott who reminded the public that brush season had resumed, no leaves would be taken after the 15th. Shredder Day was Saturday May 5th and Clean-up week would be held May 14th through 18th on the regular day of collection. Coun. Nolan reminded everyone that the Library's 90th Anniversary would be held in June. A concert featuring Mezzano-soprano Frances Devine and bass-baritone Richard Cassell will perform musical works from Broadway at 5:30 pm on April 26th.
Turning to Recreation, Coun. Nolan cited the success of the annual egg-hunt and advised the public that sign-ups for the North/South competition would be held on April 21st. Tennis sign-ups would be at Curtis House on April 10th.
Coun. Garruzzo informed the public that Traffic Safety Officer Mechler was working with the NJDOT to resolve the problems with "Jake Breaking" and gunning motorcycles under the School House Road #35 Overpass. A DOT Crew would investigate and the Borough would be advised of their findings.

WHEREAS, alcohol is a primary factor in the four leading causes of death for young persons ages 10-21 and

WHEREAS, almost 100,000 persons die each year from alcohol-related causes: drinking and driving crashes, other accidents, falls, fires, alcohol-related homicides and suicide and

WHEREAS, approximately 15 million current drinkers in the United States are dependent on alcohol; and

WHEREAS, adolescents use alcohol more than tobacco or illicit drugs; and

WHEREAS, young people begin drinking, on average, at 13.1 years of age; and

WHEREAS, young people who begin drinking before age 15 are four times more likely to develop alcohol dependence than those who begin drinking at age 21; and

WHEREAS, alcohol is involved in fifty percent of criminal assault, traffic, theft, fraud, vandalism and sex crime cases in the juvenile justice system. Older friends and siblings are the primary source by which underage youth obtain alcohol. Providing alcohol to minors is against the law, and that together we should work to keep it out of their hands, and

WHEREAS, it is imperative that we join with others in advancing efforts to strengthen the enforcement of our underage drinking laws, and build partnerships among local agencies, elected officials, law enforcement, businesses, schools and communities to prevent underage drinking and alcoholism;

NOW, THEREFORE, I, Mayor Thomas B. Nicol join the National council on Alcoholism and Drug Dependence, Inc. (NCADD) and The New Jersey Division of Alcohol Beverage Control and do hereby proclaim that April 2012 is Alcohol Awareness Month in The Borough of Brielle.

Whereas: on March 26th, 2012 Ocean Medical Center Foundation, 425 Jack Martin Blvd., Brick, NJ 08724 submitted Raffle Application No. 2012-6 ID No. 54-4-38544 for an off-site 50/50 raffle, to be held at Manasquan River Golf Club, 843 Riverview Drive Brielle, NJ 08730 on Monday, June 18th, 2012 at 8pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

The foregoing is a true copy of a Resolution passed by the Mayor & Council of the Borough of Brielle at a meeting held at Borough Hall, 601 Union Lane, Brielle, New Jersey, on April 9th, 2012.
