MINUTES FEBRUARY 13th, 2012 WORK SESSION START: 7:33 PM

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, SCOTT & SHAAK. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NOLAN & VISCEGLIA.

Mayor Nicol convened the work session in compliance with the Open Public Meetings. The Administrator had no report, but he advised the Council that the Pine Box Derby recognition ceremony had been carried to February 27th and that the public hearing on the Ordinance revising regulations on real estate signs would have to be carried to February 27th as well. Since both Councilmen Garruzzo & Shaak held real estate licenses, they felt that they should abstain. This left insufficient membership to entertain passage.


There being no comments the work session was adjourned at 7:35 p.m. on a motion by Coun. Scott, seconded by Coun. Garruzzo.

ABSENT: COUN. NOLAN & VISCEGLIA

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the January 23rd, 2012 were approved on a motion by Coun. Scott, seconded by Coun Garruzzo; all aye; no nays. Passed.
Coun. , Garruzzo seconded by Coun. Scott, introduced Resolution 12-21 for passage of the Consent Agenda.

Resolution:
A. (see insertion).
B. To authorize Clean Ocean Action to conduct their 27th Annual Beach Sweep in Brielle on April 21st & October 20th, 2012.
C. (see insertion).
D. (see insertion).
E. (see insertion).
F. (see insertion).

Vote: Coun. Garruzzo, Gorham, Scott & Shaak; all aye. No nays. Passed. (Note: Coun. Shaak abstained on "D". William Brannick, 805 Schoolhouse Road inquired about "E" & "F". He was advised that they enabled the Borough to submit an application to the Local Finance Board to permit the refunding of bonds to address a $529,000 liability that arose from a large number of tax appeals that reduced the municipal ratable by $40 million dollars and created a cash flow problem.)

Coun. Shaak, seconded by Coun. Garruzzo, introduced Resolution 12-22 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of February 13th, 2012, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Scott, & Shaak; all aye. No nays. Passed.

On a motion by Coun. Shaak, seconded by Coun. Gorham, the public hearing scheduled on the Ordinance to amend Chapter Twenty-One was carried to February 27th, 2012. Vote: all aye; no nays. Passed

The Mayor then announced that the time had arrived for a hearing and further consideration of “AN ORDINANCE AMENDING CHAPTER 20 & CHAPTER 9 OF THE BOROUGH CODE".

The hearing was opened on a motion by Coun. Scott, seconded by Coun. Gorham.
The Administrator explained that the ordinance control a potential for rooming houses in single family residential districts and altered the definition of "family" to eliminate the potential for abuse.
The hearing was adjourned on a motion by Coun. Garruzzo, seconded by Coun. Scott.
Coun. Garruzzo, seconded by Coun. Shaak introduced Resolution 12-23 for passage and adoption on second and final reading. Vote: Coun. Garruzzo, Gorham, Scott & Shaak; all aye. No nays. Passed.
Coun. Scott, seconded by Coun. Gorham, introduced Resolution 12-24 to authorize publication of passage and adoption in the Coast Star according to law.
Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading, in compliance with Local Bond Law, of "REFUNDING BOND ORDINANCE OF THE BOROUGH OF BRIELLE, IN THE COUNTY OF MONMOUTH, NEW JERSEY, AUTHORIZING THE ISSUANCE OF NOT TO EXCEED $529,000 AGGREGATE PRINCIPAL AMOUNT OF REFUNDING BONDS, SERIES 2012, FOR THE PURPOSE OF PAYING AMOUNT OWING THE TAXPAYERS FOR TAXES LEVIED IN THE BOROUGH AND APPROPRIATING THE PROCEEDS OF SUCH REFUNDING BONDS TO SUCH PURPOSE".
Coun. Shaak, seconded by Coun. Garruzzo introduced Resolution 12-25 for passage and introduction on first reading of the foregoing ordinance. Vote: Coun. Garruzzo, Gorham, Scott & Shaak; all aye. No nays. Passed (Coun. Nolan & Visceglia absent).
Coun. Garruzzo, seconded by Coun. Gorham, introduced Resolution 12-26 To authorize publication of the foregoing Bone Ordinance in the Coast Star, in accordance with Local Bond Law, for a hearing to be held, at Borough Hall, 601 Union Lane, Brielle, New Jersey, at 7:30 pm on February 27th, 2012, in the Council Chambers. Vote: Coun. Garruzzo, Gorham, Scott & Shaak; all aye. No nays. Passed (Absent Coun. Nolan & Visceglia).
Mayor Nicol then read the following proclamation re: Read Across America.

Whereas, the citizens of the Borough of Brielle stand firmly committed to promoting reading as the catalyst for our students’ future academic success, their preparation for America’s jobs of the future, and their ability to compete in a global economy; and


Whereas, the Borough of Brielle has provided significant leadership in the area of community involvement in the education of our youth, grounded in the principal that educational investment is the key to the community’s well-being and long-term quality of life; and

Whereas, NEA’S Read across America a national celebration of reading, will be conducted on March 2, 2012, which would have been the 108th birthday of Theodor Seuss Geisel, better known as Dr. Seuss; and

Whereas, Read across America-NJ is being conducted statewide by the New Jersey Education Association, in partnership with the New Jersey State League of Municipalities, the New Jersey Library Association, and their local affiliates across the state to promote reading and adult involvement in the education of our community’s students:


Now Therefore, Be It Resolved, that the Mayor & Council of the Borough of Brielle calls on the citizens of Brielle to assure that every child is in a safe place reading together with a caring adult on March 2, 2012;

And Be It Further Resolved, that this body enthusiastically endorses NEA’S Read Across America and Read Across America-NJ and recommits our community to engage in programs and activities to make America’s children the best readers in the world.
The Mayor then called for committee reports and recognized Coun. Scott who had no report.
Coun. Garruzzo informed the public that during the month of January 2012, the Police Department arrested 15 adults and 3 juveniles. The adult arrests include 2 burglary, 2 simple assault and 2 for burglary of motor vehicles. The juvenile arrests include 1 for burglary and 2 for simple assault.
Coun. Shaak & Gorham having no reports and there being no public comment. The meeting was adjourned at 7:48 pm on a motion by Coun. Garruzzo, seconded by Coun. Shaak.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

BOROUGH OF BRIELLE COUNTY OF MONMOUTH

RESOLUTION OF THE BOROUGH OF BRIELLE, IN THE COUNTY OF MONMOUTH, NEW JERSEY, MAKING APPLICATION TO THE LOCAL FINANCE BOARD PURSUANT TO N.J.S.A. 40A:2-51
WHEREAS, the BOROUGH OF BRIELLE, IN THE COUNTY OF MONMOUTH, NEW JERSEY (the "Borough") desires to make application to the Local Finance Board for its review and/or approval to finance tax appeals, pursuant to N.J.S.A. 40A:2-51; and

WHEREAS, the Borough believes:

(a) it is in the public interest to accomplish such purpose;
(b) said purpose is for the health, wealth, convenience or betterment of the inhabitants of the local unit or units;
(c) the amounts to be expended for said purpose or improvements are not unreasonable or exorbitant;
(d) the proposal is an efficient and feasible means of providing services for the needs of the inhabitants of the local unit or units and will not cause an undue financial burden to be placed upon the local unit or units;
NOW, THEREFORE, BE IT RESOLVED by the BOROUGH COUNCIL OF THE BOROUGH OF BRIELLE, IN THE COUNTY OF MONMOUTH, NEW JERSEY as follows:

Section 1. The application to the Local Finance Board is hereby approved, and the Borough Attorney and Bond Counsel, along with other representatives of the Borough, are hereby authorized to represent the Borough in matters pertaining thereto.

Section 2. The Local Finance Board is hereby respectfully requested to consider such application and to record its findings, recommendations and/or approvals as provided by the applicable New Jersey Statute.

Resolution No. 12-21-F
RESOLUTION OF THE BOROUGH OF BRIELLE, IN THE COUNTY OF MONMOUTH, NEW JERSEY, AUTHORIZING THE FINANCING OF AMOUNTS OWING TO TAXPAYERS FROM TAX APPEALS FOR TAXES LEVIED IN THE BOROUGH THROUGH SPECIAL EMERGENCY NOTES, AND ACKNOWLEDGING THE APPROVALS REQUIRED BY THE DIVISION OF LOCAL GOVERNMENT SERVICES IN CONNECTION THEREWITH


WHEREAS, the Borough of Brielle, in the County of Monmouth, New Jersey (the "Borough") intends to finance through special emergency notes, amounts owed by the Borough for tax appeals, to the owner of specific property for taxes levied in the Borough; and

WHEREAS, at the direction of the New Jersey Division of Local Government Services ("DLGS"), the Borough shall finance not to exceed 75% of the total of $685,296 tax appeals through the issuance of special emergency notes, in the amount of $529,000 (including costs of issuance) to be paid over five years; and

WHEREAS, the Borough has requested the approval of DLGS to finance tax appeal payments to avoid a cash deficit for which no adequate provision was made in the Borough's 2011 budget; and

WHEREAS, the Borough acknowledges that such financing may only occur one time as determined by DLGS, and that the Borough intends to undertake a revaluation of property in the Borough to stabilize any future overpayments due to tax appeals; and

WHEREAS, in connection with the approval by DLGS of the financing of the tax appeals by the Borough, DLGS has required that any additional hiring of staff by the Borough during the calendar year 2012, shall be first approved by DLGS; and

NOW, THEREFORE, BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF BRIELLE, IN THE COUNTY OF MONMOUTH, NEW JERSEY, AS FOLLOWS:

Section 1. The Borough of Brielle, in the County of Monmouth, New Jersey (the “Borough") is hereby authorized to finance $529,000, as approved by a refunding bond ordinance adopted on February 13, 2012, for amounts owed by the Borough to the owners of property due to tax appeals, for taxes levied in the Borough, and for which no adequate provision was made in the Borough's 2011 budget.
Section 2. The Borough acknowledges that such financing may only occur one time as determined by DLGS, and that the Borough intends to undertake a revaluation of property in the Borough to stabilize any future overpayments due to tax appeals.

Section 3. The Borough hereby acknowledges and agrees to submit for approval to DLGS any requests for the hiring of staff by the Borough during the calendar year 2012.
