MINUTES NOVEMBER 28th, 2011 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUN.GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had no formal report, but the need had arisen for an Executive Session re: Personnel. The Administrator also cited a typo on the agenda. The minutes being accepted were for 11/14/11 and not 10/24/11.

Mayor Nicol then read the following Proclamations.

Whereas, the Borough of Brielle has been formed in compliance with the applicable statutes, and

Whereas, it is fitting and proper for a municipal corporation to recognize the achievements of its residents, and

Whereas, each year the Manasquan Little Blue Warriors, Inc. make a vital contribution to the Borough of Brielle by instilling in our youth a respect for the traditional American and the spirit of competition, and

Whereas, on Oct. 16th, 2011 the Peewee Small Novice Cheerleaders placed 1st at the New Jersey Shore Pop Warner competition, and on Oct. 30th, again finished 1st in the Eastern Regional Qualifying competition and on Nov. 13th, they won the Eastern Regional finals and the right to compete in the National Pop Warner competition, and

Whereas, such an achievement is indeed worthy of commemoration

Now Therefore Be It Proclaimed, that November 28th, 2011 be designated as Manasquan Little Blue Warriors Peewee Cheerleader Day in the Borough of Brielle.

Now Therefore Be It Proclaimed, that November 28th, 2011 be designated as Manasquan Little Blue Warriors Midget Cheerleader Day in the Borough of Brielle.

The Pee Wee & Midget Cheerleaders were then presented with copies of the Proclamation and the Pee Wee Cheerleaders received a check, in the amount of $2,500.00, from the 10K Race Committee, to assist them in financing their trip to Disney World. Mayor Nicol emphasized that the funds were monies raised by the independent race committee and that no taxpayer funds were being used.

Terre Vitale, 1107 Shore Drive, thanked the Governing Body for their recognition and the committee for the donation. This sentiment was affirmed by Coach Janet Richardson. Mayor Nicol wished the team success and trusted that they would win the nationals.

There being no further comments the work session was adjourned at 7:42 p.m. on a motion by Coun. Scott, seconded by Coun. Shaak.

MINUTES NOVEMBER 28th, 2011 START: 7:43P.M.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the November 14th meeting were approved on a motion by Coun. Shaak seconded by Coun Nolan; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 11-87 for passage of the Consent Agenda.

Resolution:
A. To authorize the Mayor & Clerk to execute an agreement with Monmouth County for the provision of transportation services (SCAT/Special Citizens Area Transportation) for calendar 2012.
B. To authorize the Mayor & Clerk to execute an agreement with Associated Humane Societies for the provision of Animal Control Services in calendar 2012.

Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Visceglia, seconded by Coun. Shaak, introduced Resolution 11-88 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of November 28th, 2011, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for a hearing and further consideration of “AN ORDINANCE TO AMEND & SUPPLEMENT ORDINANCE NO. 1005 "AN ORDINANCE FIXING THE SALARIES & COMPENSATIONS OF THE VARIOUS OFFICERS & EMPLOYEES OF THE BOROUGH OF BRIELLE".

The hearing was opened on a motion by Coun. Scott, seconded by Coun. Nolan. The Administrator explained that the ordinance established salary ranges for 2012. The hearing was closed on a motion by Coun. Scott, seconded by Coun. Nolan.

Garruzzo, seconded by Coun. Nolan, introduced Resolution 11-97 for passage and adoption on second and final reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.
Coun. Shaak, seconded by Coun. Garruzzo, introduced Resolution 11-98 to authorize publication of passage and adoption in the Coast Star according to law. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia: all aye. No nays. Passed.
The Mayor then called for committee reports and recognized Coun. Scott who reminded the public that leaf collection ended on December 12th and brush collection would resume on the 16th. Once again she informed the public that brush and leaves had to be segregated at the curb to prevent damage to the leaf machines.
Coun. Nolan advised that the Board of Recreation's Bus Trip to Lancaster Pennsylvania had been cancelled due to low public response. On a more positive note the annual Christmas Tree Lighting Ceremony would be held at 6:00 pm on Sunday, December 4th.
Coun. Nolan cited Ms. Kelly Pretz book signing at the Library, 3:00 to 4:40 pm, on November 29th of her book "Rain At Midnight".
Coun. Nolan cited the Library's Fall Running Camps with GP Pearlberg from 3:30 to 4:15 pin on Tuesdays and Thursdays for six weeks. Strength Training under the direction of Calvin Thompson will be on Tuesday & Thursday, 10:00 am to 10:45 am. The Library was also seeking letters of interest from residents interested in serving as Board Members as new vacancies shall exist in 2012.

Coun. Garruzzo informed the public that fourteen car burglaries had taken place over the holiday weekend in the area of Borrie, Lake, Green & Harris Avenues. In each case the vehicles were unlocked. A Red Alert was issued on Sunday, November 27th, 2011 advising residents to lock their vehicles. Chief Palmer informed Coun. Garruzzo that the Police were reaching out to both Monmouth County & Wall Township in an effort to obtain the use of a "tracking dog" to assist in the investigation.

There being no further public comments, Coun. Garruzzo, seconded by Coun. Shaak, introduced Resolution 11-99.

Whereas, the Open Public Meetings Act permits the exclusion of the Public from a meeting in certain circumstances; and

Whereas, the Borough Council of the Borough of Brielle is of the opinion that such circumstances currently exist. Now Therefore Be It Resolved, by the Borough Council of the Borough of Brielle, County of Monmouth, State of New Jersey, on November 28th, 2011, as follows:

The Public shall be excluded from discussion of and action upon the hereinafter specified subject matters.

The general nature of the subject matter to be discussed is as follows: "Personnel".

It is anticipated at this time that the above stated subject matters will be made public when the need for confidentiality no longer exists.

Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed,

The Executive Session began at 8:02p.m. and ended at 8:48 p.m.. The session was adjourned on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

Coun. Gorham, seconded by Coun. Scott, introduced Resolution 11-99 Be It Resolved, to authorize the termination of Department of Public Employee Steven Davis, effective this date. Mr. Davis shall remove all personal property from his locker and return any keys and/or municipal property now in his possession by 3:30 pm Tuesday, November 29th, 2011. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

The meeting was adjourned at 8:52p.m. on a motion by Coun. Shaak seconded by Coun. Garruzzo.
