PRESENT: MAYOR NICOL, COUN.GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had no formal report.

There being no comments the work session was adjourned at 7:35 p.m. on a motion by Coun. Shaak, seconded by Coun. Nolan.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the September 26th meeting were approved on a motion by Coun. Nolan seconded by Coun. Garruzzo; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 11-79 for passage of the Consent Agenda.

Resolution:
A. To approve a reimbursement for overpayment of taxes in the amount of 3,750.00 Re: Block 104.01, Lot 1.
B. (see insertion).
C. (see insertion).
D. (see insertion).
Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Visceglia, seconded by Coun. Shaak, introduced Resolution 11-80 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of October 10th, 2011, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

The Mayor read the following Proclamation:

WHEREAS, New Jersey municipalities, counties, and regional planning entities continually face changes in their communities and natural environment, and

WHEREAS, community planning and plans can help manage this change in a way that provides better choices for how people work and live; and

WHEREAS, community planning provides an opportunity for all residents to be meaningfully involved in making choices that determine the future of their community; and

WHEREAS, the full benefits of planning requires public officials and citizens who understand, support, and demand excellence in planning and plan implementation; and

WHEREAS, the American Planning Association has designated the month of October as Page 94

National Community Planning Month throughout the United States of America and its territories to highlight the contributions of sound planning and plan implementation, and

WHEREAS, the celebration of National Community Planning Month gives us the opportunity to publicly recognize the participation and dedication of the members of planning and zoning boards and other citizen planners who have contributed their time and expertise to the improvement of the Borough of Brielle, New Jersey; and

WHEREAS, we recognize the many valuable contributions made by professional planners in Brielle, New Jersey and extend our heartfelt thanks for the continued commitment to public service by these professionals;

NOW, THEREFORE, BE IT RESOLVED THAT, the month of October 2011 is hereby designated as Community Planning Month in the Borough of Brielle, Monmouth County, New Jersey in conjunction with the celebration of National Community Planning Month.

Mayor Nicol then called for committee reports and recognized Coun. Scott who reminded the public that leaf season would begin October 15th. Leaves, and only leaves, no brush, should be left at the curb for collection until brush collection was resumed on December 15th.

Coun. Nolan cited the two evenings of Flag Football "under the lights" on Friday & Saturday. He also advised that the Fall Festival would be held on Sunday, October 23rd between the hours of 12:00 noon and 3:00 pm. The event would feature a Chili Cook-off and Lemonade by Sara D. For additional information residents could contact Director John Devereaux @ (732) 223-5936.

Coun. Nolan informed those assembled that the Environmental Commission would be conducting a seminar on the construction and use of Rain Barrels in the near future.

Coun. Nolan noted that the Library was holding a Fall Running Camp with Coach C.P. Pearlberg on Tuesdays and Thursdays from 3:00 to 4:15 pm. The price was $45.00. Also on Tuesdays & Thursdays, between 10:00 am and 10:45 am, Calvin Thompson would conduct strength training, cost $15.00.
Coun. Nolan then cited the presence of Leslie Naughton, Brielle Librarian who advised the Council and he advised the Council that the Asbury Park Press had named the Brielle Library the best in Monmouth County. Coun. Nolan noted that under Ms. Naughton’s stewardship and that of the Board of Trustees and the employees the number of patrons the volumes in circulation had tripled.

Coun. Garruzzo informed the public that the Police Department would be hosting Operation Medicine Cabinet, a day of amnesty to dispose of unused, unwanted and expired medications in the home. The operation is scheduled for October 29th, 2011 between the hours of 10:00am and 2:00pm. Residents can bring medications to the Police Headquarters where an Officer will be posted to accept them. The medications will then be disposed of in a safe and non-hazardous manner.

Coun. Garruzzo also reminded the public to be sure to lock their motor vehicles. While the Police were close to solving the case, some additional vehicles had been robbed.

Coun. Shaak advised that he had ignored such advice to his cost as he left his car door open and he became a victim.

Coun. Shaak thanked Assemblyman Rible & State Senator Kean for their assistance in having dead trees removed from Route #35 and on Route #70 near Mariner's Cove.

Coun. Shaak also cited the on-going battle with trailer park over code violations. He explained that summonses had been issued, but only after notices of violation had been issued and time granted to cure the deficiency. The owners continued to ignore the violations and summonses had been issued. The matter was now in the hands of the court.

Coun. Gorham & Visceglia having no reports, the Chair opened the meeting to the public and recognized Coun. Scott who cited her own experience with theft. The Councilwoman had left her front door open and someone had entered her house and proceeded to consume Halloween candy; she too urged residents to be diligent.

There being no further comments, the meeting was adjourned at 7:45 pm on a motion by Coun. Shaak, seconded by Coun. Gorham.

Resolution No: 11-179-B
Date: October 10th, 2011

RESOLUTION OF THE
GOVERNING BODY OF THE BOROUGH OF BRIELLE
AWARDING A PROFESSIONAL CONTRACT

WHEREAS, the above entity has been formed pursuant to the applicable New Jersey Statutes; and

WHEREAS, in order to fulfill its statutory duties it is necessary that the Borough of Brielle retain the services of an expert to defend tax appeals; and
WHEREAS, the Borough of Brielle has retained the services of BRB Valuation & Consulting Services inasmuch as he is competent to fulfill the needs of the Borough of Brielle; and
WHEREAS, the rate of compensation for the professional is attached to the amended contract document;
NOW, THEREFORE, be it resolved that as of this 10th day of October 2011, that;

1. BRB Valuation & Consulting Services is hereby retained by the Borough of Brielle as its tax appeal expert for 2011 tax appeals.
2. This Contract is awarded without competitive bidding as a "Professional Service" in accordance with N.J.S.A. 40A: 11-5(1)(a)and(i) of the Local Public Contracts Law because same involves the retaining of professional services.

3. The Chief Administrative Officer has made a determination that, in accordance with the provisions of the non-fair and open process the value of this contract is determined not to exceed the $17,500.00 threshold.

4. This contract is not subject to the provisions of N.J.S.A.19:44a-20.5.

5. The Borough of Brielle Clerk shall cause the attached Notice to be published in the Coast Star.

Resolution of the Borough of Brielle

Whereas: on October 4th, 2011, Order of Friendly Sons of Shillelagh, 815 16th Avenue, Belmar, NJ 07719, submitted Raffle Application No. 2011-23 ID No. 30-6-34036, for an on-site 50/50 cash raffle, to be held at Rella’s Restaurant, 110 Union Avenue, Brielle NJ 08730 on Sunday, November 13th, 2011 from 1pm to 5pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

Certification

The foregoing is a true copy of a Resolution passed by the Mayor & Council of the Borough of Brielle at a meeting held at Borough Hall, 601 Union Lane, Brielle, New Jersey, on October 10th, 2011.

Box 61, Brielle, NJ 08730 submitted Raffle Application No. 2011-79-D ID, No. 57-5-37135 for an on-site 50/50 raffle, to be held at Manasquan River Golf Club, 843 Riverview Drive Brielle NJ 08730 on Monday, November 3rd, 2011, from 6;30pm to 9:30pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.
