MINUTES JULY 25th, 2011 START: 7:32P.M.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had no formal report. However, he asked permission to appoint Stacey McGovern, 204 Lenape Trail as a School Crossing Guard with an effective date of 7/20/11.

William Brannick, 805 Schoolhouse Road asked if Ms. McGovern was a Brielle resident and the Administrator advised that she was.

There being no comments the work session was adjourned at 7:31 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the July 11th meeting were approved on a motion by Coun. Shaak seconded by Coun Garruzzo; all aye; no nays. Passed. (Note: Coun. Nolan abstained).

Coun. Shaak, seconded by Coun. Garruzzo introduced Resolution 11-65 for passage of the Consent Agenda.

Resolution:
A, (see insertion).
B. To authorize payment schedules for the following water/sewer accounts #289,762,
1138 & 1062.
C. (see insertion).
D. To appoint Stacy McGovern, 204 Lenape Trail, Brielle as a School Crossing Guard, effective 7/20/11.

Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed. (Note: At the behest of William Brannick, 805 Schoolhouse Road, the Administrator explained that "C" called for a $.25 adder per gallon over the posted tank price per gallon as posted daily by the State of New Jersey.

Coun. Visceglia, seconded by Coun. Shaak introduced Resolution 11-66 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of July 11th, 2011, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

The Mayor then announced that the time had arrived for the introduction and passage on first reading of “AN ORDINANCE TO RESCIND CHAPTER TEN OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED `SWIMMING POOL”.

Coun. Gorham, seconded by Coun. Garruzzo, then introduced Resolution 11-67 for passage on introduction and first reading of the foregoing ordinance. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all ayes. No nays. Passed.

Coun. Nolan, seconded by Coun. Scott, introduced Resolution 11-68 to authorize a hearing to be held at 7:30 pm, on August 22nd, 2011, @ 8:00 pm, at Borough Hall. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia: all ayes, no nays. Passed.

The Mayor then called for committee reports and recognized Coun. Scott who informed the public that she had been working with Recycling Coordinator Burkhardt regarding recycling compliance.

Mr. Burkhardt had developed a triplicate form that would enable him to, at first, issue a warning and ultimately, if compliance was not obtained, a summons, to the violator, along with copies to the County and to the Borough. Random checks would begin shortly.

Coun. Nolan advised that the Library was hosting an art show that featured the works of five artists. The works would be on display for three weeks and the Library would receive a 10% commission for each sale.

A singer/songwriter workshop for grade 5 and above was currently being held and the response was positive. Patrons were also being advised to vote for Brielle as the best library in a contest sponsored by the Asbury Park Press. Votes could be cast at bestofaap.com. Coun. Nolan felt it would be a good way to honor the Library on its upcoming anniversary.

Turning to Recreation, the public was told that the Borough had received a $250,000 grant from the County, the municipality had provided the match and the Board of Recreation had provided additional funds. Bids for the project would be received on August 2nd and work was anticipated to start right after Bridle Day.

In closing Coun. Nolan reminded the public that Flu-Shots would be given at Curtis House on September 30th
There being no further council reports, the public was recognized and Keith McEligot, 615 Brielle Avenue asked if the police kept a record of summons issued for cell phone use violations? Coun. Garruzzo advised that he did not know off-hand, but he would ask Chief Palmer.

Sam Lugiano, 532 Union Lane, voiced a similar concern over cell phone use along with speeding on Union Lane and failure to stop at the Route 35/71 off-ramp. Mr. Lugiano cited the police for their prior efforts, but felt that it was a disaster waiting to happen and he had an on-going concern over his small children.

Coun. Garruzzo felt that the commencement of the Fall Term at the Elementary School would have a calming effect on traffic flows and cited the police car kept parked by Curtis House as a disincentive to speed, but he promised that he would discuss the matter further with Chief Palmer and every effort would be made to address the situation.

Resolution No: 11-65-A Date: July 25th, 2011

Resolution of the Borough of Brielle

Whereas: on July 13th, 2011 Monmouth Medical Center Foundation, 300 Second Avenue, Long Branch, NJ 07740, submitted Raffle Application No. 2011-14 ID No. 266-4-31486 for an off-site 50/50 raffle, to be held at Manasquan River Golf Club 843 Riverview Drive, Brielle, NJ 08730 on Monday, October 3rd, 2011, from 6 p.m.-10 p.m.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

RESOLUTION NO: 11-65-C
DATE: JULY 25TH, 2011

RESOLUTION OF THE BOROUGH OF BRIELLE

WHEREAS, the Borough of Brielle did advertise for bids for the provision of diesel fuel and gasoline with bids to be received on July 20th, 2011 and

WHEREAS, bids for both gasoline and diesel fuel were received and the low-bidder was Point Bay Fuel for the provision of both gasoline and diesel fuel.

NOW THEREFORE BE IT RESOLVED, that the Administrator is hereby authorized to accept bids, a copies of which is amended to this resolution, submitted by Point Bay Fuel, Inc., 71 Irons Street, Toms River, New Jersey, for the provision of both diesel fuel and gasoline @ a .2500 cent "adder" above the posted price on the New Jersey State Treasury website which is employed by the State of New Jersey to establish pricing for State Bid Contracts and is considered to be a accurate reflect of true market value for products such as gasoline and diesel fuel.

Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. None abstained. None absent.
