MINUTES JULY 11th, 2011 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUN.GARRUZZO, GORHAM, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NOLAN.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had no formal report, but he requested authorization to add a resolution to the consent agenda to grant permission to the Jersey Shore Running Club to pass through Brielle on April 12th, 2012 between the period 9:30am to 10:30 am.

The Administrator also requested to add a resolution to clarify the recent transfer of Liquor License 1308-33-011-007. Finally he asked to add an authorization for the Mayor & Clerk to execute a Hold Harmless Agreement for the extension of an existing fence Across Borough property.

There being no comments the work session was adjourned at 7:33 p.m. on a motion by Coun. Scott, seconded by Coun. Gorham.

ABSENT: NOLAN.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the June 27th Meeting were approved on a motion by Coun. Shaak seconded by Coun Garruzzo; all aye; no nays. Passed.

Coun. Shaak, seconded by Coun. Garruzzo, introduced Resolution 11-63 for passage of the Consent Agenda.

Resolution:

A. (see insertion).
B. (see insertion).
C. To grant a waiver from the Municipal Noise Ordinance to the Brielle Elementary to facilitate the installation of solar panels during the Fall Term of 2011.
D. To permit the transfer of unused sick time from one employee to a fellow employee who has exhausted their sick time while recovering from an off-job injury.
E. To authorize the Jersey Shore Running Club to pass through Brielle on April 12th, 2012 as part of their Jersey Shore Relay Fund Raiser for Special Olympics.
F. (see insertion).
G. To authorize the Mayor & Clerk to execute a Hold Harmless Agreement with Brielle Holdings, LLC.

Vote: Coun. Garruzzo, Gorham, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Visceglia, seconded by Coun. Shaak, introduced Resolution 11-64 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of July 11th, 2011, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Scott, Shaak & Visceglia; all aye. No nays. Passed.

The Mayor called for committee reports and recognized Coun. Scott who noted that, while she had no formal public works report, she did wish to thank those volunteers who assisted in pruning at the Library. Special thanks were given to Library Board Association Member Paul Tartaglia, Shade Tree Commissioner & Garden Club Member Carol Eggert and Gail Walsh of the Garden Club for their efforts.
Coun. Garruzzo informed the public that the Police had made 11 arrests in June, 6 DWI, I Terrorists Threat, 3 warrants and 1 underage possession of alcohol. Officers had also issued 275 moving violations and 15 parking tickets. In addition 12 Motor Vehicle Accident investigations had been conducted, along with responses to 26 First Aid Calls and 27 Alarm Activation calls. Coun. Garruzzo noted that, while June had been busy, July was trending to be busier still.
Coun. Shaak cited the on-going effort to rectify property code violations at the Brielle Motor Court. The owners had been given sixty days to cure the violation and that time expired on June 30th. There were five outstanding violations remaining. Coun. Shaak noted that no new Certificates of Occupancy would be issued pending the resolution of this mater and he recommended to Council that the renewal of the license be withheld until all violations were cured.
Coun. Gorham & Visceglia having no reports, the Chair opened the meeting to the public and recognized William Brannick, 805 Schoolhouse Road. Mr. Brannick inquired as to the final disposition of former DPW Superintendent Burkhart’s municipal vehicle. The Administrator advised that it had been turned over to the Police in lieu of the new vehicle scheduled for purchase in 2011.
Mr. Brannick also asked why he saw current Superintendent McArthur at the Shop Rite on Saturday in his municipal vehicle? The Administrator promised to make an inquiry, but noted that, unlike state employees, those Borough employees who have permission to use municipal vehicles are permitted to make incidental trips.
Mr. Brannick did note that he had spoken with Mr. McArthur and asked him if he was working. Mr. McArthur had advised that he worked "twenty-four/seven".
There being no further comments, the meeting was adjourned at 8:05 pm on a motion by Coun. Scott, seconded by Coun. Garruzzo.

Resolution of the Borough of Brielle

Whereas: on July 8th, 2011 Wall Football Club, 1932 Toy Drive, Wall NJ 07719,submitted Raffle Application No. 2011-12 ID No. 279-5-36864for an on-site gift auction, to be held at Simko’s Grille, 403 Higgins Avenue, Brielle NJ 08730, on Saturday, August 20th, 2011, from 5 p.m. to 8 p.m.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

Whereas: on July 8th, 2011 Wall Football Club, 1932 Toy Drive, Wall NJ 07719,submitted Raffle Application No. 2011-13 ID No. 279-5-36864for an on-site 50/50 raffle, to be held at Simko’s Grille, 403 Higgins Avenue, Brielle NJ 08730, on Saturday, August 20th, 2011, from 5 p.m. to 8 p.m.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

Resolution of The Borough Of Brielle

Be It Resolved, that Resolution 11-47-D is hereby amended to reflect that the Transfer approved by the Governing Body on May 23rd was for a Person-To-Person Transfer of Liquor License #1308-33-011-007 from Thomas V. Whelan to Town House LLC.

This transfer should not have contained any reference to the breakdown by percent of the interest held by the principals in the LLC as100% of the license was transferred from Thomas V. Whelan to Town House LLC for the premises located at 110 Union Avenue (Route #71), Brielle, New Jersey.

Vote: Coun. Garruzzo, Gorham, Scoff, Shaak & Visceglia; aye. None opposed, none abstained. Absent: Coun. Nolan.
