PRESENT: MAYOR NICOL, COUN.GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who requested permission to process the voucher for final payment on the 2010 Road Improvement Program and to execute Change Order #1 for a net decrease of $4,046.64.

There being no comments the work session was adjourned at 7:35 p.m. on a motion by Coun. Shaak, seconded by Coun. Nolan.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the May 9th meeting were approved on a motion by Coun. Garruzzo seconded by Coun Nolan; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Visceglia, introduced Resolution 11-47 for passage of the Consent Agenda.

Resolution:

C. To amend Resolution 11-43-F, to appoint Michael McArthur, as Water/Sewer
Plant Operator for the period June 1st through December 31st, 2011.
D. (see insertion).
E. (see insertion).
F. To appoint John O'Donnell, 1101 Aileen Road, as Alternate #1 to the Brielle
Planning Board.
G. To approve the final payment for the 2010 Road Improvement Program to authorize the Mayor & Clerk to execute Change Order #1 for a net decrease of $4,046.64.

Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed. (Note: Coun. Garruzzo abstained on "B" and Coun. Nolan abstained on "G")

Coun. Visceglia, seconded by Coun. Gorham, introduced Resolution 11-48 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of May 23rd, 2011, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for a hearing and further consideration of "AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED "LAND USE".

The hearing was opened on a motion by Coun. Garruzzo, seconded by Coun. Shaak.

The Administrator explained that the ordinance brought the Borough into compliance with NJDEP mandates on storm drains, inlets and dumpsters.

The hearing was closed on a motion by Coun. Scott, seconded by Coun. Visceglia.

Coun. Garruzzo, seconded by Coun. Gorham, introduced Resolution 11-49 for passage and adoption on second and final reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Garruzzo, Shaak by Coun. Gorham, introduced Resolution 11-50 to authorize publication of passage and adoption in the Coast Star according to law. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of “AN ORDINANCE TO AMEND CHAPTER TWO, SECTION SEVENTEEN (2-17) ENTITLED LENGTH OF SERVICE AWARDS PROGRAM (LOSAP).

Coun. Garruzzo, seconded by Coun. Gorham, introduced Resolution 11-28 for passage on introduction and first reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott & Visceglia; all aye. No nays. Coun. Shaak abstained. Passed.

Coun. Garruzzo seconded by Coun. Nolan introduced Resolution 11-29 to authorize publication of the foregoing ordinance in the Coast Star Newspaper for a hearing to be held at 7:30 p.m., at Borough Hall, 601 Union Lane, Brielle, New Jersey, on June 13th, 2011. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then read the following Proclamation:

Whereas, the State of New Jersey proclaimed May 15th through May 21st, 2011 as Public Works Week, and
Whereas, public works infrastructure, facilities and services are of vital importance to sustainable communities and to the health, safety and well-being of the people of New Jersey and its municipalities, and

Whereas, such facilities and services could not be provided without the dedicated efforts of public works professionals, engineers, managers and employees from State and Local Government and the private sector, who are responsible for and must plan, design, build, operate and maintain the

transportation, water supply, sewerage and refuse disposal systems, public buildings and other structures and facilities essential to serving our residents, and

Whereas, the year 2011 marks the fifty-first annual National Public Works Week sponsored by the American Public Works Association, and

Whereas, the Borough of Brielle was not made aware of this event until Thursday, May 19th, 2011, and
Whereas, the Governing Body appreciates the efforts made on behalf of all Brielle Residents by the Department of Public and they would be remiss not to recognize that effort.

Now Therefore Be It Proclaimed, that May 23rd through May 27th, 2011 be observed as Public Works Week in the Borough of Brielle.

Mayor Nicol then called for committee reports and recognized Coun. Scott who cited the success of Clean-Up week, but lamented the quantity of items, ranging from children’s play-sets, to furniture and clothing, that had been left at the curb for collection. She felt that many of these articles could have been put to good use.

In closing Coun. Scott reminded the public that, this weekend, the Historical Society would conduct its sixth annual "Decoration Day" observance and urged residents to participate. She added that this year's theme was the War of 1812.

Coun. Nolan advised that the Library would hold a workshop on July 25th, for grades five through eight on song writing. The event was limited to fifty participants, so Coun. Nolan urged early registration.

Coun. Nolan also reminded the public that the "Brielle North-South Challenge" would be held on June 5th and would feature competitive sports such as volleyball, basketball and culminates in a tug of war between participating resident. The dividing line was Higgins Avenue, and all proceed would go to benefit the Condoluci Family. Coun. Nolan hoped that this would become an annual event to raise money to assist families in need.

Coun. Garruzzo advised the Council that he had spoken with Chief Palmer regarding the concern voiced by Mr. Sheehan of Schoolhouse Road over noise from motor cycles. The Chief advised Coun. Garruzzo that, effective August 1st, 2010, motorcycles were no longer required to be inspected by the State. However, the Police would continue to do whatever was in their power to remediate the problem.

Coun. Shaak advised that the Fire Company had responded to a structural fire over the weekend that, unfortunately, left an elderly resident homeless. On a positive note, eight

volunteer E.M.S. Personnel had participated in the Boy Scout Jamboree held over the weekend. Between ten and thirteen thousand scouts participated in the event that was held in the Sea Girt Army Camp. Coun. Shaak noted that Eagle Scout and current First Aid Volunteer Richard Schwarz, Jr. had addressed the crowd with a very memorable speech. The event is held every two years.

Neither Coun. Gorham nor Visceglia having reports and there being no public comment, the meeting was adjourned at 7:55 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

WHEREAS, APPLICATION HAS BEEN MADE FOR THE RENEWAL OF LIQUOR LICENSE #1308-44-007-004, AND

WHEREAS, THE APPLICATION IS COMPLETE, THE $1,620.00 FEE DUE TO THE BOROUGH AND THE $200.00 FEE DUE TO THE STATE OF NEW JERSEY, DIVISION OF ALCOHOLIC BEVERAGE CONTROL RECEIVED, AND ALL MUNICIPAL REQUIREMENTS HAVE BEEN MET, AND

Whereas, an application has been received for the renewal of Plenary Retail Consumption License #1308-33-012-010, Charlie Browns Of Brielle, Inc. T/A Charlie Browns, and

Whereas, the submitted application form is complete in all respects, the renewal fees for the Borough of Brielle and the New Jersey Division of Alcoholic Beverage Control have been paid, and

Whereas, the applicant is qualified to be licensed according to all standards established by Title 33 of New Jersey Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions.

Now Therefore Be It Resolved, that the Governing Body of the Borough of Brielle does hereby approve, effective this date, the renewal of License #1308-33-012-010 T/A Charlie Browns for the license year July 1st, 2011 through June 30, 2011, subject to the following special conditions which were imposed by the Brielle Planning Board to wit:

Resolution of The Borough Of Brielle

Whereas, an application has been filed for a Person-To-Person Transfer of Plenary Retail Consumption License #1308-33-011-007 heretofore issued to Thomas V. Whelan for premises located at 110 Union Avenue (Route #71), Brielle, New Jersey, and

Whereas, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current License term, and

Whereas, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as the pertinent local ordinances and conditions consistent with Title 33, and

Whereas, the Governing Body has no objection to this transfer as per the verbal recommendation received from the Brielle Department of Police on May 12th, 2011.

Now Therefore Be It Resolved, that the Governing Body of the Borough of Brielle hereby approves the transfer of 55% of License #1308-33-011-007 from Thomas V. Whelan, LLC to Town House LLC for premises located at 110 Union Avenue (Route #71), Brielle, New Jersey.

Resolution of the Borough of Brielle

Whereas: on May 18th, 2011 Ocean Medical Center Foundation, 425 Jack Martin Blvd., Brick, NJ 07724 submitted Raffle Application No. 2011-10 ID No. 54-4-38544 for an on-site 50/50 raffle, to be held at Manasquan River Golf Club, 843 Riverview Drive Brielle NJ 08730 on Monday, June 20th, 2011, from 8am to 5:30pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.
