ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report.

There being no comments the work session was adjourned at 7:32 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the April 25th, 2011 meeting were approved on a motion by Coun. Shaak seconded by Coun Garruzzo; all aye; no nays. Passed.

Coun. , Garruzzo, seconded by Coun. Nolan, introduced Resolution 11-43 for passage of the Consent Agenda.

Resolution:

F. To appoint Michael McArthur as Water/Sewer Plant Operator for the period July 1st through December 3rd, 2011.

Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Coun. Shaak & Visceglia abstained on "B" and "D". Passed. (William Brannick, 805 Schoolhouse Road, asked about "F" & "G" and the Administrator explained that Superintendent Burkhardt was retiring as of June 30th. While Mr. Robert McArthur was qualified to assume his duties he was still securing the necessary operator's license re: water plant/sewer pump stations. Michael McArthur has the required license and would simply assist us as a consultant pending Robert's satisfactory completion of the licensing program.

Coun. Visceglia, seconded by Coun. Gorham, introduced Resolution 11-44 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of May 9th, 2011, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of "AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED "LAND USE".

The Administrator explained that the ordinance brought the Borough into compliance with N.J.D.E.P. Regulations.
Coun. Garruzzo, seconded by Coun. Visceglia introduced Resolution 11-45 for passage and introduction on first reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Garruzzo, seconded by Coun. Gorham, introduced Resolution 11-46 to authorize publication of the foregoing Bond Ordinance, in the Coast Star, for a hearing to be held at 7:30 p.m., at Borough Hall, on May 23rd, 2011.Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

The Mayor then called for committee reports and recognized Coun. Scott who reminded the public that Clean-Up Week would take place May 16th through May 20th on residents’ regular day of collection, a final sweep of the Borough would take place on Friday. Coun. Scott reiterated that no recyclables, scrap metals or white goods, fluorescent light bulbs or electronic devices such as televisions and computers would be taken as all these items were now mandated for recycling. Coun. Scott noted that residents should follow the simple rule that, if it was collected at the Recycling Center, than it could not be placed out for clean-up.

Turning to the school budget, Coun. Scott cited the budget's failure to be passed for the year 2010-2011 and cited the Chamber of Commerce for their financial sponsorship of school programs that would have been curtailed due to the failed budget. Superintendent Carlson had contacted Coun. Scott and Kathy Schmidt of the Chamber, during the Arbor Day Ceremony, and informed them of the desire of the 8thgrade classes to repay that kindness. To that end, they had developed a plan, along with the Student Government, to undertake a community service project that would feature plantings throughout the Borough.
Coun. Nolan reminded the public of that the Library would conduct their "Insectopia" forum for grades K through 3 on May 10th, between the hours of 3:30 and 5:30 pm. On May 9th a babysitting "networking" event would also be held at the Library.

Turning to Recreation, Coun. Nolan advised the public that sign-ups were now being held at Curtis House for the June 5th benefit for Justin Condoluci. The event world be an athletic competition between North & South Brielle Residents from 8:00 am to 5:00 pm. Events for both children and adults would feature softball, basketball, kick ball and culminate with a tug-of-war. Coun. Nolan hoped that it would become an annual event to benefit families in need.

Coun. Garruzzo informed the public that during the month of April the Police made fourteen arrest. They included two D.W.I., one theft, six warrants, one false report and three criminal mischief arrests.

The Police also reported that all FEMA Reports had been submitted and that Reverse 911 was scheduled to become operational by May 12th.
Coun. Shaak cited the Community Development Committee's on-going endeavor to remediate deficiencies at the Brielle Motor Court in conjunction with the Code Enforcement Officer.

Coun. Shaak also cited the Blood Drive to be held at the First Aid Building on May 10th between the hours of 4:00 & 8:00 pm.
Coun. Gorham & Visceglia having no reports the Chair opened the meeting to the public and recognized Jack Sheehan, 719 Schoolhouse Road, who complained about noise from motor cycles as the drivers gunned their machines and then hit the air brakes in an effort to produce reverberations as they passed under the Route #35 Bridge. He asked for relief. Coun. Garruzzo advised that he would discuss the issue with Police Chief Palmer to ascertain what steps could be taken.

William Brannick, 805 Schoolhouse Road, asked Coun. Scott how a resident could dispose of "white goods"? Coun. Scott advised that they had to call the DPW and the item, which should be left at the curb, would be collected.

There being no further comments, the meeting was adjourned at 7:55 pm on a motion by Coun. Garruzzo, seconded by Coun. Gorham.

Resolution No: 11-43-A
Date: May 9th, 2011

BOROUGH OF BRIELLE RESOLUTION

WHEREAS, N.J.S.A. 40A: 5-4 requires the governing both of every local unit to have made an annual audit of its books, accounts and financial transactions, and
WHEREAS, the Annual Report of Audit for the year 2010 has been filed by a Registered Municipal Accountant with the Municipal Clerk of the Borough of Brielle, Thomas F. Nolan as per the requirements of N.J. S. 40A: 5-6, and a copy has been received by each member of the governing body, and
WHEREAS, R. S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs, and
WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled "Comments and Recommendations; and
WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled "Comments and Recommendations" as evidenced by the group affidavit form of the governing body attached hereto: and
WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and
WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as Stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board, and
WHEREAS, failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52 -to wit:
R.S. 52:27BB-52 - A local officer or member of a local governing body who, after a date fixed for compliance, fills or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fine not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year. or both, in addition shall forfeit his office.
NOW, THEREFORE BE IT RESOLVED, that the Mayor & Council of the Borough of Brielle. hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.
