PRESENT: MAYOR NICOL, COUN.GARRUZZO, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUN. GORHAM.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report, but he asked permission to add a resolution to the consent agenda to authorize the submission of 2010 tonnage grant and to certify the taxes paid under the Recycling Enhancement Act. Permission was granted.

There being no further comments the work session was adjourned at 7:32 p.m. on a motion by Coun. Scott, seconded by Coun. Nolan.

ABSENT: COUN. GORHAM.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the February 28th, 2011, meeting were approved on a motion by Coun. Garruzzo seconded by Coun Nolan; all aye; no nays. Passed. (Note: Coun. Garruzzo abstained.)

Coun. Garruzzo seconded by Coun. Nolan, introduced Resolution 11-21 for passage of the Consent Agenda.

D. To authorize the renewal of a trailer license for Brielle Motor Court, for calendar
year 2011.

Coun. Visceglia, seconded by Coun. Shaak, introduced Resolution 11-22 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of March 14th, 2011, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of “CALENDAR YEAR 2011 "AN ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK"
Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 11-23 for passage on introduction and first reading of the foregoing ordinance. Vote: Coun. Garruzzo, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 11-24 to authorize publication in the Coast Star for a hearing to be held on April 11th, 2011 at 7:30 p.m. at Borough Hall. Vote: Coun. Garruzzo, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Finance Chairman Visceglia was recognized and he observed that the Council was introducing a budget with a 9/10 cent increase in the municipal rate. The increase fell within the 2% CAP on both appropriations and the tax levy. The Governing Body believed that the budget was cost effective and would permit the Borough to maintain the level of municipal services that the residents of Brielle expected and one that ensures the quality of life that characterizes the community. Coun. Visceglia trusted that the public will concur with the Council's assessment.

Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 11-25 for the introduction of the municipal budget.

The Chair then called for committee reports and recognized Coun. Scott who reminded the public that leaf season would resume on April 1st. Residents were asked to separate leaves from brush to facilitate the collection process.

Coun. Scott also noted that one of the real benefits of recycling was not simply the revenue generated by the recycling tax and the tonnage grant, but in the amount of material removed from the waste stream. Therein lie the true savings and the added benefit to the environment.

In closing, Coun. Scott cited the recent Flute Concert at the Library and she urged residents to take advantage of the Library and its programs.

Coun. Nolan also praised the concert and he advised the public that the Red Cross would be conducting a program that ranged from safety to CPR at the Library on March 15th. The Red Cross would also conduct a "Baby Sitting Club" seminar on March 26th for young students. Coun. Nolan added that the Library would close at 5:00 p.m. on March 17th and re-open on March 20th to permit renovations to the lobby area.

Coun. Garruzzo had no report, but advised the public that Chief Palmer was in attendance at a FEMA Seminar and hopefully he would return with news of funding from that agency of expenses incurred by the Borough during the December 2010 and January 2011 snow events.

Coun. Shaak and Visceglia had no reports.

The meeting was opened to the public and the Chair recognized William Brannick, 805 Schoolhouse Road, who cited a recent article in the Asbury Park Press that indicated that summonses issued by the Brielle Police Department were down 20% as compared to an increase in neighboring communities.

Coun. Garruzzo advised that he would review the matter with Chief Palmer. The Administrator added that the statistics reflected the fact that many towns, and this was the thrust of the article, were seeking to increase revenue by an increase in traffic tickets. The Brielle Police continued to provide for the public safety, but the issuance of tickets was in accord with prior years.

Mr. Brannick asked if the Borough had considered the installation of "Red Light" cameras? Coun. Garruzzo stated that they had not, but it was worth looking into.

Mr. Brannick asked if the proposed municipal budget would be posted on the web-site? The Administrator said it would be posted later in the week, but hard copies were available at Borough Hall for public inspection.

The meeting was adjourned at 7:50 p.m. on a motion by Coun. Shaak, seconded by Coun. Garruzzo.

RESOLUTION NO: 11-23 DATE: MARCH 14th, 2011


RESOLUTION OF THE BOROUGH OF BRIELLE

Municipal Budget of the Borough of Brielle, County of Monmouth for the Calendar Year 2011.

Be It Resolved, that the following statements of revenue and appropriations, in the amount of $5,827,611.00 shall constitute the Municipal Budget for the Fiscal year 2011;

Be It Further Resolved, that said budget shall be published in the Coast Star in the issue of March 31st, 2011, and be given a hearing on April 11th, 2011 at 7:30 p.m. at Borough Hall.

The Governing Body of the Borough of Brielle does hereby approve the following budget for introduction as the Municipal Budget for the Fiscal Year 2011:

Whereas: on March 7th, 2011, Bayshore Community Hospital Foundation, 727 N. Beers Street, Holmdel NJ 07733, submitted Raffle Application No. 2011-4, ID No.217-4-36769 for a on-site 50/50 cash raffle, to be held at the Manasquan River Golf Club on Monday, May 16th, 2011 at 7 pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

RESOLUTION OF THE BOROUGH OF BRIELLE

WHEREAS, The Mandatory Source Separation and Recycling Act, P.L. 1987 c.102, has established a recycling fund from which tonnage grant may be made to municipalities in order to encourage local source separation and recycling programs; and

WHEREAS, It is the intent and the spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and to expand existing programs; and

WHEREAS, The New Jersey Department of Environmental Protection and Energy has promulgating recycling regulations to implement the Mandatory Source Separation and Recycling Act; and

WHEREAS, The recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants, including but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and

WHEREAS, A resolution authorizing the Borough of Brielle to apply for such tonnage grants for calendar year 2010 will memorialize the commitment of this municipality to recycling and to indicate the assent of the Borough of Brielle to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and

WHEREAS, Such a resolution should designate the individual authorized to ensure the application is properly completed and timely filed.

NOW, THEREFORE BE IT RESOLVED by the Governing Body of the Borough of Brielle hereby endorses the submission of the recycling tonnage grant application to the New Jersey Department of Environmental Protection and Energy and designates William A. Burkhardt, Jr. to ensure that the application is properly filed; and

BE IT FURTHER RESOLVED that the monies received from the recycling tonnage grant be deposited in a dedicated recycling trust fund to-be used solely for the purposes of recycling.

Resolution No: 11-21-G

TAX IDENTIFICATION STATEMENT

WHEREAS, The Recycling Enhancement Act, P.L.2007, chapter 311, has established a recycling fund from which tonnage grants may be made to municipalities in order to encourage local source separation and recycling programs; and

WHEREAS, There is levied upon the owner or operator of every solid waste facility (with certain exceptions) a recycling tax of $3.00 per ton on all solid waste accepted for disposal or transfer at the solid waste facility.

WHEREAS, Whenever a municipality operates a municipal service system for solid waste collection, or provides for regular solid waste collection service under a contract awarded pursuant to the “Local Public Contracts Law”, the amount of grant monies received by the municipality shall not be less than the annual amount of recycling tax paid by the municipality except that all grant moneys received by the municipality shall be expended only for its recycling program.


NOW THEREFORE BE IT RESOLVED by the Borough of Brielle that the Borough of Brielle hereby certifies a submission of expenditure for taxes paid pursuant to P.L.2007, chapter 311, in 2010 in the amount of $6,168.00. Documentation supporting this submission is available at 601 Union Lane, Brielle, NJ and shall be maintained for no less than five years from this date.
