MINUTES JANUARY 10th, 2011 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT SHAAK & VISCEGLIA, ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE
Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report. Public Safety Garruzzo was then recognized and he introduced Kevin Williams, the new Probationary Patrolman to the public.
Coun. Garruzzo observed that, the Police Department had been down a man since the retirement of Sergeant Victor Tomkiel. Mr. Williams had ranked in the top one-third of his class of 64 recruits in the Ocean County Police Academy Class #85, as a Class II Officer. Mr. Williams had worked with the Point Pleasant Beach Police Department as a Class II Officer from January 26th, 2006 to May 27th, 2008. Mr. Williams had joined the Brielle Department on May 28th, 2008 and he has proven to be a dedicated and hardworking officer.
Patrolman Williams has made 31 drunk driving arrests, 4 drug arrests, 84 other arrests for a variety of violations, he has investigated 22 motor vehicle accidents and issued 1,300 vehicle summonses.
Coun. Garruzzo also lamented the passing of Canine Unit Bocce. Bocce and his handler, Patrolman Gary Olsen, graduated from the State Police Canine Academy in November 1997, having completed a 400 hour course in Narcotics Detection. This achievement was followed by the completion of a Tracking Course. Bocce served from November 1997 until his retirement in 2004. He participated in over 500 investigative searches and he assisted both federal and county law enforcement agencies. Bocce is credited with the seizure of $200,000 worth of narcotics and $173,000 in U.S. Currency.
Having retired to Patrolman Olsen's home in 2004, Bocce passed away, quietly at home on December 12th, 2010 with his family beside him.
Mayor Nicol welcomed Officer Williams to the Borough and added that he was joining one of the finest departments in Monmouth County. The Mayor also observed that Bocce always did his job without complaint. The Mayor also recognized Borough Police Chief Palmer and Chief Williams of Point Pleasant Beach, both of whom were in attendance.

Patrolman Gary Olsen was recognized and he thanked the Council for having had the opportunity to work with Bocce over the years as the K-9 Handler. He noted that Bocce was a great partner and he never had a bad day. Bocce was a true friend and he would be deeply missed.

There being no further comments the work session was adjourned at 7:40 p.m. on a motion by Coun. Visceglia, seconded by Coun. Shaak.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the December 27th, 2010 Meeting and the 2010 Executive Session Minutes were approved on a motion by Coun. Garruzzo seconded by Coun. Nolan; all aye. no nays. Passed.

Coun. Scott, seconded by Coun. Shaak, introduced Resolution 11-13 for passage of the Consent Agenda.

William Brannick, 805 Schoolhouse Road had asked for an explanation of "K" and the Administrator replied that there were unpaid legal bills for December 2010 and a pending bill for the expert witness in the tax appeal cases. Hence the transfer but any unexpended amounts would go into surplus.

Coun. Visceglia, seconded by Coun. Gorham, introduced Resolution 11-14 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of January 10th, 2011, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

The Mayor then called for committee reports and recognized Coun. Scott who reminded the public that snow was forecasted for Tuesday & Wednesday and she reminded the public to remove all vehicles from the street to facilitate plowing. Coun. Scott added that the costs for the last storm were still being tabulated.
Coun. Scott then exhibited the new Recycling Containers. Their distribution was on hold until the snow abated, but they will be delivered to the homeowners’ door and their usage is left to the resident's discretion as to whether they will utilize them for mixed paper or other recyclables.

Coun. Nolan advised the public that the second grant submission for improvements to Brielle Park, that included an upgrade of the bathrooms, had not been approved, but there was always the next round in 2011.
Turning to the Library, Coun. Nolan cited the Manasquan River Group of Artists upcoming exhibit that would include the works of some forty artists who competed for recognition. Other upcoming programs included, Clearing Clutter on January 18th, Better Bodes on January 11th' hosted by Calvin Thompson for a fee of $15.00 and also on the 11th from 4:00 pm to 5:00 pm Running Tall/Running Well for grades 4 through 8. The cost was $35.00.

Coun. Garruzzo provided the public with the annual Fire Company Report. The Company responded to 174 calls in 2010. In terms of man-hours, 1,890.83 were for fire calls, 2,060.37 for training and 2,503 for other activities.
The top ten responders were Andrew Kile, Chief Mike Johnston, Tim Shaak, Tim Beaton, Duane Danish, A.J. Roppoli, Jim Langenberger, Ethan Frazee, Jim Stenson and Jani Jasman.

Coun. Shaak reported that Ethan Frazee had graduated #1 from the Monmouth County Fire Academy, the third Brielle fireman in a row to achieve that distinction.

Turning to the First Aid Squad, Coun. Shaak noted that Jim Richeal had just successfully completed the EMT Course, the fourth volunteer in 2010 to do so. Coun. Shaak also thanked George Harms, of Harms Construction, for the donation of chains to the Fire Company. The chains would assist the company during snow emergencies.

In closing, Coun. Shaak thanked Legow Management of the Brandywyne Apartments for their donation of a new Cupola for the First Aid Building. They had donated the original cupola to memorialize a Brielle Resident killed in combat. Now, thanks to the efforts of Jim Langenberger, they had agreed to replace and rededicate a new cupola in memory of Ronald Kubik who was killed in Iraq.
Coun. Gorham had no report. Coun. Visceglia had no report, but he thanked his colleagues for his election as Council-President.

The meeting was opened to the public and James Langenberger, Representative to the M.R.H.C. #1, Who reminded the public that the annual Rabies Clinic would be held at the Fire House on Tuesday, January 12th @ 7:00 pm.

Borough Historian John E. Belding then took the annual Council Photograph.
William Brannick, 805 School House Road inquired as to the status of the generator at the First Aid Building and if the building had been utilized as a shelter during the recent blizzard.
Coun. Shaak replied that there had not been a need to use the building as a shelter and the generator was on-site. The generator was mounted on a diesel tank and had the capacity to run for several days without refueling.
Janice Hendricks, 615 Leslie Avenue, asked the Council how they had managed to hold their December 27th Meeting in a blizzard.
Mayor Nicol explained that some council members had four-wheel drive and other walked out to a main road to be picked up.
There being no further questions or comments the meeting was adjourned at 7:58 pm on a motion by Coun. Shaak, seconded by Coun. Garruzzo.

AWARDING A PROFESSIONAL CONTRACT


WHEREAS, the above entity has been formed pursuant to the applicable New Jersey Statutes; and


WHEREAS, in order to fulfill its statutory duties it is necessary that the Borough of Brielle retain the services of a Borough Attorney

WHEREAS, the Borough of Brielle has retained the services of the firm of Montenegro, Thompson, Montenegro & Genz, inasmuch as they are competent to fulfill the needs of the Borough of Brielle; and

WHEREAS, the Borough of Brielle wishes to establish the rate of compensation for and to be paid to said professional;

NOW, THEREFORE, be it resolved that as of this 10th day of January 2011, that;
1. Nicholas C. Montenegro of the firm of Montenegro, Thompson, Montenegro & Genz is hereby retain by the Borough of Brielle as the Municipal Attorney for the fiscal year 2011 to perform to the terms of the Agreement between the Municipal Attorney and the Borough of Brielle.


2. This Contract is awarded without competitive bidding as a "Professional Service" in accordance with N.J.S.A. 40A:11-5(1)(a) of the Local Public Contracts Law because same involves the retaining of professional services.


3. The Chief Administrative Officer has made a determination that, in accordance with the provisions of the non-fair and open process the value of the contract is determined to exceed the $17,500.00 threshold.

4. This contract is being awarded under the non-fair and open contract provisions of N.J.S.A. 19:44A-20.5.

5. The contractor is required to file a Business Entity Disclosure Certificate with the Borough of Brielle and a Political Contribution Disclosure Form.

6. Funds for payment of this contract have been provided for in the 2011 Temporary Budget and shall be included in the 2010 Municipal Budget.

RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT FOR PROFESSIONAL SERVICES IN CONNECTION WITH THE FINANCING OF CAPITAL IMPROVEMENTS TN ACCORDANCE WITH THE ATTACHED AGREEMENT (CONTRACT AWARDED WITHOUT COMPETITIVE BIDDING PURSUANT TO THE LOCAL PUBLIC CONTRACTS LAW, N.J.S.A. 40A:11-1 ET SEQ.), AUTHORIZED BY THE BOROUGH OF BRIELLE, COUNTY OF MONMOUTH, NEW JERSEY.


WHEREAS, there exists a need for specialized legal services in connection with the authorization and the issuance of bonds and other obligations and other matters relating to capital financing by the Borough of Brielle, County of Monmouth, New Jersey (herein the "Borough"); and
WHEREAS, such specialized legal services can be provided only by a recognized Bond Counsel firm, and the law firm of Dilworth Paxson, LLP, Neptune, New Jersey, are so recognized by the financial community; and


WHEREAS, the services to be performed are "professional services" as defined in the Local Public Contracts Law, N.J.S.A. 40A:11-2(6), and therefore are excepted from the Local Public Contracts Law requirements for competitive bidding, pursuant to N.J.S.A. 40A:115(1)(a)(i); and


WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a)(i), requires the public advertisement of notice with respect to contracts for professional services awarded without competitive bids; and

WHEREAS, funds are or will be available for this purpose.

NOW, THEREFORE, BE IT RESOLVED BY THE BOROUGH COUNSEL OF THE BOROUGH OF BRIELLE, IN THE COUNTY OF MONMOUTH, NEW JERSEY AS FOLLOWS:

1. That the Borough Counsel hereby appoints the firm of Dilworth Paxson, LLP, Attorneys at Law, Neptune, New Jersey, to serve as Bond Counsel to the Borough In connection with the financing of capital projects, and awards the contract which is annexed hereto and made a part hereof (the "Contract"), in accordance with N.J.S.A. 40A:11-1 et seq.

2. That the Mayor or other appropriate official of the Borough, on behalf of the Borough, is hereby authorized and directed to execute the Contract and the Clerk is hereby authorized and directed to attest to the execution of said Contract for professional services in connection with the preparation of all bond ordinances and the authorization and issuance of all bonds, bond anticipation notes, tax anticipation notes or similar obligations and related matters of capital and debt financing by the Borough.

3. That no appropriation of funds is required at this time, payment coming from the proceeds of the sale of bonds, bond anticipation notes and tax anticipation notes or similar obligations or from capital authorizations or other appropriate budgeted items in accordance with the attached Contract.

4. That this Contract is awarded without competitive bidding as a professional service under the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a)(i), because legal services are a recognized profession licensed and regulated by law.
5. That a notice in accordance with this resolution and the Local Public Contracts Law, shall be published in the official newspaper or newspapers of the Borough.
6. That an executed copy of the Contract and a copy of this resolution shall be filed in the Office of the Clerk and be available there for public inspection in accordance with law.
7. That this resolution shall take effect immediately.

WHEREAS, IT HAS BECOME NECESSARY AT THIS TIME TO EXPEND FUNDS IN EXCESS OF THE SUMS APROPRIATED FOR THE PURPOSES SPECIFIED IN THE 2010 BUDGET, AND
WHEREAS, THE GOVERNING BODY MAY, BY RESOLUTION, TRANSFER EXISTING EXCESS TO AN APPROPRIATION DEEMED INSUFFICIENT.

NOW THEREFORE BE IT RESOLVED, (NO LESS THAN 2/3 OF THE FULL MEMBERSHIP OF THE GOVERNING BODY AFFIRMATIVELY CONFIRMING), THAT THE FOLLOWING TRANSFERS BE MADE BETWEEN APPROPRIATION ACCOUNTS IN THE 2010 BUDGET:
