MINUTES NOVEMBER 22nd, 2010 WORK SESSION START: 7:30 PM

PRESENT: MAYOR NICOL, COUN. GARRUZZO, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: COUN. GORHAM.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report, but he requested permission to add a resolution "E" to add Brian Dreher, 509 Magnolia Avenue, Brielle to the list of Class II Specials.

There being no further comments the work session was adjourned at 7:32 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

ABSENT: COUN. GORHAM.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the November 8th, 2010 Meeting were approved on a motion by Coun. Shaak seconded by Coun. Garruzzo; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 10-84 for passage of the Consent Agenda.

Resolution:
A. (see insertion).
B. (see insertion).
C. (see insertion).
D. To declare an emergency re: repair of a water main break on Ashley Avenue.
E. To add Brian Dreher, 509 Magnolia Avenue, Brielle, to the list of Class II Specials.

Vote: Coun. Garruzzo, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Visceglia, seconded by Coun. Garruzzo, introduced Resolution 10-85 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of November 22nd, 2010, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of "AN ORDINANCE TO AMEND & SUPPLEMENT ORDINANCE NO. 1001 "AN ORDINANCE FIXING THE SALARIES & COMPENSATIONS OF THE VARIOUS OFFICERS & EMPLOYEES OF THE BOROUGH OF BRIELLE".

Coun. Shaak, seconded by Coun. Scott, introduced Resolution 10-86 for passage on introduction and first reading of the foregoing ordinance. Vote: Coun. Garruzzo, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 10-87 to authorize publication of the foregoing ordinance in the Coast Star for a hearing to be held on December 13th, 2010 @ 7:30pm at Borough Hall. Vote: Coun. Garruzzo, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Coun. Scott who reminded the public that the Boy Scouts had made their annual paper collection on Saturday. This arrangement was mutually advantageous as it afforded the Scouts an opportunity to make money and freed the DPW to concentrate on leaf collection. Coun. Scott also noted that the Recycling Yard would be closed on Thursday & Friday, but would re-open on Saturday. Mixed paper collection would not take place on Thursday due to the Thanksgiving Holiday.

Coun. Scott lamented the fact that the Scout Collection, that included the Cub Scout Food Drive, had not been better publicized, but she hoped to address that issue in the future.

Coun. Scott also thanked the public for their efforts on behalf of the Community Alliance that resulted in a grant of $3,000 to upgrade the existing facility. In closing, Coun. Scott reminded the public of the Elementary School's program to assist seniors in raking leaves and added that she had taken advantage of the program and found the students to be polite and conscientious.

Coun. Nolan noted that the Union Landing Historical Society would be sponsoring a program on the Boardwalks of New Jersey on November 30th, at 7:30 pm at Curtis House. There would be a Children's Christmas Party at the Library on December 14th and the annual Tree Lighting would take place on December 5th. Coun. Nolan also thanked MRHC#1 Representative James Langenberger for keeping the Council updated on health related information.

Coun. Garruzzo had no report, but wished everyone a Happy Thanksgiving as did Coun. Visceglia.

Coun. Shaak cited the fact that the renovations to the First Aid Building were on schedule and, as Community Development Chairman, he noted that the issue of the Omni-Point Flag Pole was being resolved.

The meeting was opened to the public and Samuel F. Lugiano III, 532 Union Lane, voiced a concern over the use of the Emergency Signal in the middle of the night. Coun. Shaak explained that it was still the most effective means of alerting the Borough's Volunteers that there was an emergency.

Mr. Keith McEligot, 615 Brielle Avenue, supported Coun. Shaak's view and termed the signaling device as "effective".

There being no further comment the meeting was adjourned at 7:55 pm on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

Resolution No: 10-84-A

RESOLUTION TO CANCEL SMALL TAX BALANCES

WHEREAS, N.J.S.A. 40A:5-17.1 provides that a municipality may authorize the processing of tax refunds of less than Ten ($10.00) Dollars and the cancellation of tax delinquencies of less than Ten ($10.00) Dollars.

NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Englishtown that the Tax Collector is hereby authorized to process, without any further action on the part of the Governing Body, any property tax refund of less than ($10.00) Dollars; and,

BE IT FURTHER RESOLVED, that the Tax Collector is hereby authorized to process, without further action on the part of the Governing Body, the cancellation of any property tax delinquency of less than Ten ($10.00) Dollars; and,

BE IT FURTHER RESOLVED, that a Certified Copy of this Resolution be provided by the Municipal Clerk to the Tax Collector and the Chief Financial Officer.

Resolution of the Borough of Brielle

Whereas: on November 10, 2010, Brielle PTO, 605 Union Lane, Brielle NJ 08730, submitted Raffle Application No. 2010-16 ID No. 57-5-22886 an Off-site 50/50 raffle, to be held at Simko’s on Friday, January 28, 2011 from 7:00 to 9:00 p.m.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

The foregoing is a true copy of a Resolution passed by the Mayor & Council of the Borough of Brielle at a meeting held at Borough Hall, 601 Union Lane, Brielle, New Jersey, on November 22, 2010.
