MINUTES NOVEMBER 8th, 2010 WORK SESSION START: 7:30 PM
PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT & SHAAK .ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.
ABSENT: COUN VISCEGLIA.
Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that the Borough had received bids for the 2010 Road Improvement Program on November 4th.
The Engineer had completed his review and the recommendation was to award the bid to Lancha Construction Corporation, 49 W. Grochowiak Street, South River, N.J. for a price of $130,368.50.
The Administrator also expressed his thanks to the First Aid Squad and Brielle Fire Company No. 1 for their assistance before, during and after the election on November 2nd.
The Administrator also cited the presence of Ms. Tina McDermott, who had completed her course work to obtain her certification as Municipal Clerk. Ms. McDermott was already serving the Borough as Water/Sewer Rent Collector, Purchaser and Assistant C.M.F.O. she continued to be an asset to the Borough and her latest certification was essential to the Borough's succession plan.
There being no further comments the work session was adjourned at 7:35 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

ABSENT: COUN. VISCEGLIA.
Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the October 25th, 2010 Meeting were approved on a motion by Coun. Shaak seconded by Coun. Nolan; all aye; no nays. Passed.
Coun. Shaak, seconded by Coun. Garruzzo introduced Resolution 10-82 for passage of the Consent Agenda.
A. To authorize the award of a professional service contract to BRB Valuation &
Consulting services for the defense of tax appeals as per their proposal for a time frame to begin on this date, but not to exceed twelve months.
B. (see insertion.)
Vote: Coun. Garruzzo, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed. (Note: Coun. Nolan abstained on Resolution "B". William Brannick, 805 Schoolhouse Road inquired as to "A" and was advised that the Borough was required to retain an "expert" to assist in the defense of tax appeals at the superior court level.)
Coun. Garruzzo, seconded by Coun. Shaak, introduced Resolution 10-83 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of November 8th, 2010, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, & Shaak; all aye. No nays. Passed.

Mayor Nicol then called for committee reports and recognized Coun. Scott who reminded the public that brush collection was on hold until December 15th while leaf collection was taking place. The Councilwoman also noted that the Brielle Elementary School, as part of its community service program, would assist residents who needed assistance raking leaves. Interested parties should contact Superintendent Carlson's Office.
Coun. Nolan cited the Brielle Library's Baby Sitting Program and reminded the public that registration for Biddy Basketball would take place on November 10th. The annual Christmas Tree Lighting was scheduled for December 6th and the annual trip into New York City would be on December 12th. The price is $10.00.
Coun. Garruzzo advised the public that the Borough was in receipt of a number of complaints regarding solicitors. He assured the public that the matter had been addressed and the activity was legal. While the Police had been notified that the event would take place, some of the canvassers had failed to display proper identification. The sponsors had been contacted by Sgt. Seidel of the Brielle Police and Ms. Hopkins from the Administrator's office. They had both been assured that remedial steps would be taken in the event of a future canvass.
Neither Coun. Shaak or Gorham having reports, the Chair recognized William Brannick, 805 Schoolhouse Road, who inquired as to the status of 2010 tax appeals and their potential impact on the Borough. He quoted a 2009 loss of $20 million dollars in ratables.
The Administrator advised that the figure was correct, but that it was too early to gage the impact of the 2010 appeals. The Borough would have a clearer picture once the Borough Auditor completed the Annual Financial Statement in January 2011.
The meeting was adjourned at 7:50 pm on a motion by Coun. Shaak, seconded by Coun. Garruzzo.

Resolution of the Borough of Brielle
Whereas, the Borough of Brielle did advertise in the Asbury Park Press for bids for "2010 Roadway Improvement Program Partially Funded by NJDOT Municipal Aid", and
Whereas, bids were received by the Borough on November 4th, 2010, and
Whereas, the lowest responsible bidder was Lancha Construction Corporation, 49 W. Grochowiak Street, South River, N.J. 08882, in the amount of $176,276.00, and
Whereas, the Bid Bond and Consent of Surety were found to be in order, and funds are available to undertake this work.
Now Therefore Be It Resolved, that the bid submitted by Lancha Construction Corporation of South River, N.J. is hereby accepted, contingent upon and subject to the approval of the New Jersey Department of Transportation, and the Municipal Clerk is hereby authorized to initiate the contract.
Vote: Coun. Garruzzo, Gorham, Nolan, Scott, & Shaak; all aye. No nays. None abstained.
