MINUTES DECEMBER 14th, 2009 WORK SESSION START: 7:30 P.M.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY SCOTT THOMPSON & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report, but asked permission to add a resolution to the consent agenda to extend the Borough's Interlocal Agreement with Manasquan for the joint utilization and maintenance of a Water/Sewer Jet- Vac through 12/31/2014. Council gave their authorization.

There being no further comments the work session was adjourned at 7:31 p.m. on a motion by Coun. Shaak, seconded by Coun. Nolan.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the November 23rd, 2009 Meeting were approved on a motion by Coun. Scott seconded by Coun. Gorham; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Shaak introduced Resolution 09-115 for passage of the Consent Agenda.

Resolution:
A. To authorize the redemption of Tax Sale Certificate 2007-05 Re: Block 77.01, Lot 3, in the amount of $42,753.25, to Crusader Lien Services.
B. To authorize the redemption of Premium Tax Sale Certificate 207-05 Re: Block 77.01, Lot 3, in the amount of $18,000, to Crusader Lien Services.
C. (see insertion).
D. (see insertion).
E. To authorize a payment schedule re: Water/Sewer Account #240-0.
F. To extend the inter-local agreement for the shared utilization and maintenance of a water/sewer jet-vac through December 31st, 2014.

Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 09-116 TO TRANSFER FUNDS (see insertion). Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Visceglia, seconded by Coun. Shaak, introduced Resolution 09-117 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of December 14th, 2009, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Mayor Nicol then read the following Proclamations:

National Drunk and Drugged Driving (3D) Prevention Month 2009

WHEREAS, motor vehicle crashes kill over 40,000 people and injure three million every year, at a cost to society of some $150 billion annually; and

WHEREAS, alcohol-related crashes account for approximately 40 percent of those deaths and injuries; and

WHEREAS, the December holiday season is traditionally one of the most deadly times of the year for alcohol-impaired driving; and

WHEREAS, for thousands of families across the nation, the December holidays bring a somber reminder of the loved ones they lost to an impaired driver during a previous holiday season or at any time during the year; and

WHEREAS, community-based programs involving consumer education, effective laws, and strong police enforcement have proven to be successful in reducing impaired driving; and

WHEREAS, organizations from every state are joining together to "Take a Stand Against Impaired Driving" this December by supporting anti-impaired driving programs and policies; and

WHEREAS, the community of Brielle is a partner in that effort to make our roads and streets safer;

NOW, THEREFORE, I, Mayor Thomas B. Nicol, do hereby proclaim December 2009 as National Drunk and Drugged Driving Prevention Month in Brielle and hereby call upon all citizens, government agencies, business leaders, hospitals, schools, and public and private institutions in Brielle to promote awareness of the impaired driving problem, to support programs and policies to reduce the incidence of impaired driving, to promote safer and healthier behaviors regarding the use of alcohol and other drugs, and to provide opportunities for all to participate in "Take a Stand Against Impaired Driving" this December holiday season and throughout the year.

ARBOR DAY CELEBRATION

Whereas, The State legislature has designated the last Friday in April as Arbor Day, and

Whereas, It is the purpose of this designation to encourage the planting of shade and forest trees, to encourage the harvesting of forest crops by approved conservation measures, and to encourage the protection of forests from the

scourge of devastating fires, insects, and diseases that destroy the beauty and usefulness of our woodlands as well as endangering the wildlife that inhabit them, and

Whereas, public endorsement of the foregoing measures, through the observance of Arbor Day, will help to preserve the natural resources of our forests and ensure that this heritage endures for future generations.

Now Therefore, Be it Proclaimed, that Friday, April 30th, 2010 be observed as Arbor Day in the Borough of Brielle, and the Governing Body hereby urges all Brielle residents to plant one or more trees in honor of the day and to actively participate in all sponsored Arbor Day activities within the Borough of Brielle.

Mayor Nicol then read his annual Christmas Resolutions:

WHEREAS, The Borough of Brielle has been formed in accordance with applicable statures, and

WHEREAS, the Governing Body of Brielle seeks to ensure the well-being of all its residents, and

WHEREAS, It is in the best interests of the aforesaid Brielle residents that there be a white Christmas.

NOW THEREFORE BE IT RESOLVED, that there shall be snow in the borough of Brielle during the period December 24th through December 25th, 2009, and

BE IT FURTHER RESOLVED, That the Borough Clerk shall forward a copy of this Resolution to the appropriate “IMPLEMENTING” agencies.
WHEREAS, The Borough of Brielle has been formed in accordance with applicable statutes, and

WHEREAS, Chapter VII of the code of the Borough of Brielle entitled “traffic” is silent on the subject of sleighs and Reindeer, and

WHEREAS, The necessities of the Holiday season demand clarification of this deficiency.

NOW THEREFORE BE IT RESOLVED, That sleighs and Reindeer shall be permitted to land on rooftops in the borough of Brielle during the period December 24th through December 25th (inclusive), and

BE IT FURTHER RESOLVED, that no parking citations shall e issued to operators of the aforementioned vehicles provided that they fit the following description: “Little”, “Old”’ “Lively” & “Quick” & can produce valid identification that their name is “Saint Nick”.

Mayor Nicol then called for Committee reports and recognized Coun. Scott who praised the Chamber of Commerce for the festive seasonal wreaths that they used to decorate the lamp posts along Higgins Avenue.

Coun. Scott then cited her attendance at the meetings of the South Monmouth Community Alliance and added that the Alliance had also circulated a proclamation on drug and alcohol abuse, but added that their focus had been on under-age drinking; she urged Council to consider issuing that proclamation in addition to the 3D Prevention Month Proclamation issued earlier.

Coun. Scott also noted that the Alliance was promoting "Project Pac-Man" a series of concerts sponsored through the Sea Girt Youth Police Officer, and she added that the next event was scheduled for December 18th from 7:00 pm to 8:30 pm. There was no age restriction on attendance.

Coun. Scott advised the public that the Arbor Day Proclamation, while it might appear to be premature, Arbor Day being in April, was a necessity if the Borough wished to maintain its designation as a "Tree City USA".

Coun. Scott then cited the new mandatory recycling ordinance amendments and she advised the public that mixed paper recycling would begin in January 2010 the same day as newspaper collection. Brielle Residents would be supplied with a plastic container for that purpose by the Borough. The cost was being partially underwritten by donations, but residents could still drop off their recyclables at the Recycling Center.

The Councilwoman added that an extensive list of changes and amendments to the current ordinance would be distributed along with the new mixed paper containers later this month.

Coun. Nolan praised the Library/Board of Recreation & Fire Company for the efforts in making the annual Christmas Tree Lighting a success. Coun. Nolan also cited the Library's computer enrichment programs and the Board of Recreation's Biddy Basketball Program. In closing he reminded the public of the Board of Recreation's "Build a Snowman" contest and he extended Holiday Greetings to all assembled and congratulated the Manasquan High School Football program on another successful season.

Coun. Garruzzo advised the public that, during the month of November, there were twenty adult arrests. That number included 1 burglary, six DWI, three possessions of marijuana, two disorderly conduct and eight warrant arrests. There was also one juvenile arrest for underage possession of alcohol. The Department also solved a burglary that resulted in the arrest of Jason Pascale of Point Pleasant and assisted the Manasquan Police Department in apprehending the perpetrator of a commercial burglary that occurred in Manasquan on Thanksgiving Day.

In closing, Coun. Garruzzo also extended his holiday greetings to the public.

Coun. Shaak advised the public of a vendor who was going door-to-door selling furniture; he just wanted the public to be aware that the gentleman had a valid mercantile license and that the activity was a legitimate venture.

Court. Gorham & Visceglia had no report. Coun. Scott was recognized and she advised the public that the cost of the new mixed paper recycling containers was being partially underwritten by the proceeds from the recycling tonnage grant along with a number of sponsors who would be acknowledged once their pledges were received.

There being no comment from the public, the Mayor wished everyone a Healthy & Happy Holiday Season and the meeting was adjourned at 7:56 pm on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

Whereas: on Dec. 8th, 2009, Brielle PTO, 605 Union Lane, Brielle NJ 08730, submitted Raffle Application No. 2009-23, ID No. 57-5-22886 for an off-site 50/50 raffle, to be held at Simko’s Grill on Friday, January 29th, 2010 from 6:30pm to 10pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

WHEREAS, NJSA:40A58 PROVIDES FOR MAKING TRANSFERS BETWEEN 2009 BUDGET APPROPRIATION ACCOUNTS DURING THE MONTHS OF NOVEMBER & DECEMBER.
