PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report.

There being no further comments the work session was adjourned at 7:31 p.m. on a motion by Coun. Shaak, seconded by Coun. Nolan.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the October 26th, 2009 Meeting were approved on a motion by Coun. Garruzzo seconded by Coun. Nolan; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 09-100 for passage of the Consent Agenda.

Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 09-101 TO TRANSFER FUNDS (SEE INSERTION). Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Visceglia, seconded by Coun. Shaak, introduced Resolution 09-102 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of November 9th, 2009, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak, & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of "An Ordinance to Amend Various Chapters of the Code of the Borough of Brielle relating to Fees".

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 09-103 for passage on introduction and first reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Nolan, seconded by Coun. Garruzzo, introduced Resolution 09-104 to authorize publication in the Coast Star for a hearing to be held on November 23rd, 2009, at 7:30 pm, at Borough Hall. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of "An Ordinance to Amend Ordinance No. 991 "An Ordinance Fixing the Salaries & Compensations of the Various Officers & Employees of the Borough of Brielle".

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 09-105 for passage on introduction and first reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 09-106 to authorize publication in the Coast Star for a hearing to be held November 23rd, 2009, at 7:30 pm, at Borough Hall. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Coun. Scott who apologized for her comment at the last meeting that the Coast Star had failed to report the deadline for brush collection in their article on the meeting; in the article they had cited the deadline and Coun. Scott regretted her comments of October 26th. Coun. Scott also noted that Brielle had more trees and more leaves than the average town and their collection was an on-going process. She reminded the public that leaves should be placed at the curb in a linear fashion and not in huge piles that posed a problem for vehicular traffic.

Coun. Nolan noted that the November 21st bus trip to Radio City was sold out, but offered that the Board of Recreation planned other excursions for the balance of the year. Coun. Nolan reminded the public that the annual Christmas Tree Lighting would be on December 6th and a new tree at a new location would be illuminated.

Coun. Nolan advised that basketball sign-ups for boys and girls grades one through eight will be held on November 18th from 7:00 pm to 8:30 pm at the Curtis House. The cost per child is $45.00, $80.00 for two and $95.00 for three or more children.

Turning to the Library, Coun. Nolan advised the public that the Library, in conjunction with the Monmouth County Food Bank, would be collecting food for the needy between November 2nd and November 20th.

Coun. Garruzzo, Shaak, Gorham and Visceglia having no reports the meeting was opened to the public. In absence of any public comment the meeting was adjourned at 7:55 pm, on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

Resolution Supporting Participation
In the Sustainable Jersey Municipal Certification Program
WHEREAS, a sustainable community seeks to optimize quality of life for its residents by ensuring that its environmental, economic and social objectives are balanced and mutually supportive; and
WHEREAS, the Borough of Brielle strives to save tax dollars, assure clean land, air and water, improve working and living environments as steps to building a sustainable community that will thrive well into the new century; and
WHEREAS, the Borough of Brielle hereby acknowledges that the residents of Brielle desire a stable, sustainable future for themselves and future generations; and
WHEREAS, the Borough of Brielle wishes to support a model of government which benefits our residents now and far into the future by exploring and adopting sustainable, economically-sound, local government practices; and
WHEREAS, by endorsing a sustainable path the Borough of Brielle is pledging to educate itself and community members further about sustainable activities and to develop initiatives supporting sustainable local government practices; and
WHEREAS, as elected representatives of Brielle, we have a significant responsibility to provide leadership which will seek community-based sustainable solutions to strengthen our community:
NOW THEREFORE BE IT RESOLVED, that to focus attention and effort within Brielle on matters of sustainability, the Borough of Brielle wishes to pursue local initiatives and actions that will lead to Sustainable Jersey Municipal Certification.

BE IT FURTHER RESOLVED, by the Borough of Brielle that we do hereby authorize William A. Burkhardt, Jr., Recycling Coordinator serve as Brielle's agent for the Sustainable Jersey Municipal Certification process and authorize him to complete the Municipal Registration on behalf of the Borough of Brielle.

RESOLUTION OF THE BOROUGH OF BRIELLE

WHEREAS, NJSA:40A58 PROVIDES FOR MAKING TRANSFERS BETWEEN 2009 BUDGET APPROPRIATION ACCOUNTS DURING THE MONTHS OF NOVEMBER & DECEMBER.

WHEREAS, IT HAS BECOME NECESSARY AT THIS TIME TO EXPEND FUNDS IN EXCESS OF THE SUMS APROPRIATED FOR THE PURPOSES SPECIFIED IN THE 2009 BUDGET, AND

WHEREAS, THE GOVERNING BODY MAY, BY RESOLUTION, TRANSFER EXISTING EXCESS TO AN APPROPRIATION DEEMED INSUFFICIENT.
