MINUTES JULY 27th, 2009 WORK SESSION START: 7:30 P.M.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report, but he requested permission to add two resolutions to the Consent Agenda. One added a raffle approval and the other authorized the release of a Tax Lien. Council gave their permission to add the resolutions.

There being no further comments the work session was adjourned at 7:31 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the July 13th, 2009 Meeting were approved on a motion by Coun. Garruzzo seconded by Coun. Nolan; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Shaak introduced Resolution 09-71 for passage of the Consent Agenda.

Resolution:
A. To appoint James F. Langenberger as the Borough's Representative to the Monmouth Regional Health Commission No. 1.
B. (see insertion).
C. (see insertion).
D. (see insertion).
E. To authorize the release of a Tax Lien, in the amount of $24,272.24 ($24,072.24 for redemption and $200.00 for the premium) to Crusader Lien Services for TTL 2008-3, 1 Crescent Drive, Brielle.

Motions:

Vote: Coun. Garruzzo, Gorham Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed. (Note: Coun. Shaak abstained on "D".

Coun. Visceglia, seconded by Coun. Nolan, introduced Resolution 09-72 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of July 27th, 2009, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had come for the introduction and passage on first reading of "AN ORDINANCE FOR DETERMINING POSITIONS ELIGIBLE FOR THE DEFINED CONTRIBUTION RETIREMENT PROGRAM".

Coun. Scott, seconded by Coun. Garruzzo introduced Resolution 09-73 for passage on introduction and first reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Whereas: on July 20th, 2009, Monmouth Medical Center Foundation, 300 Second Avenue, Long Branch, NJ 07740, submitted Raffle Application No. 2009-12, ID No. 266-4-31468 for an off-site raffle, to be held at the Manasquan River Golf Club on Monday, October 5th, 2009, at 8pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

Certification

The foregoing is a true copy of a Resolution passed by the Mayor & Council of the Borough of Brielle at a meeting held at Borough Hall, 601 Union Lane, Brielle, New Jersey, on July 27th, 2009.

Coun. Garruzzo, seconded by Coun. Gorham, introduced Resolution 09-74 to authorize publication in the Coast Star for a hearing to be held on August 10th, 2009 at 7:30 pm at Borough Hall. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of “AN ORDINANCE TO RESCIND CHAPTER XIX OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED "FLOOD PLAIN MANAGEMENT” AND TO REPLACE IT WITH A NEW CHAPTER TO BE ENTITLED “THE FLOOD DAMAGE PREVENTION ORDINANCE”.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 09-75 for passage on introduction and first reading. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 09-76 to authorize publication in the Coast Star for a hearing to be held on August 10th, 2009 at 7:30 p.m. at Borough Hall. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then called for Committee Reports and recognized Coun. Scott who advised the public that seasonal brush collection was on schedule. The Councilwoman also noted that she had been meeting with Recycling Coordinator Burkhardt and the Administrator to review the current Recycling Ordinance and to bring it into compliance with the County Solid Waste Master Plan, promulgated in February 2009, and the State Recycling Enhancement Act. Many of the changes were minor and a number of items currently recycled on a voluntary basis would now become mandatory. Coun. Scott and her Committee would be working toward having an ordinance ready for introduction by August.

Coun. Scott also cited her on-going war on "volcanoes" and was somewhat dismayed that the brochures provided to the public were not being actively circulated. She urged the public to enlighten both their neighbors and landscapers working in town to avoid "volcanoes" and preserve trees.

The Councilwoman also noted her "war on vines" that was choking both trees and shrubs and she urged citizens to help address this growing problem both for the health of the trees and the beauty of the Borough.

Coun. Nolan cited the Brielle Library's on-going computer education classes and the July 30th presentation "Everything Asia". He added that "Mark the Magician" would be appearing at the Library on August 11th.

Turning to Recreation, Coun. Nolan reminded the public that the Brielle Dash would be held on September 11th and it was always a great event. The Library & Board of Recreation had teamed up to host a movie in the park to be held sometime in August. The Board of Recreation was also pursuing Green Acres funding for improvements to Brielle Park.

In closing, Coun. Nolan congratulated Coun. Visceglia for his Three Hour & Seventeen Minutes finishing time in the New York City Triathlon over the weekend.

Coun. Garruzzo advised the public that, as per a request made at the prior meeting, he had reviewed the use of the Fire Company Rescue Boat with both the Fire Chief and the President of the Fire Company and it was his determination that the boat had been used properly. Coun. Garruzzo added that the boat was utilized to assist in surrounding waters and routine maintenance runs were required to ensure that the boat was ready for use. He had shared his findings with his colleagues and it was the consensus of Council that nothing untoward had taken place.

Neither Coun. Shaak, Gorham or Visceglia had reports and the meeting was opened to the public.

The Chair recognized William Brannick, 805 School House Road, who noted that in a recent newspaper article it was stated that health benefit costs in New Jersey could rise as high as 20%. What impact would this have on the municipal budget?

The Administrator advised that Brielle was in the Central Jersey Health Insurance Fund and their increase should be much less; he added that just three weeks ago the Borough had received a $55,000 rebate check from the fund. Unfortunately, those municipalities in the State Health Benefit Fund could experience a substantial increase and this could increase the membership of the CJHIF.

Mr. Brannick asked about the defined contribution ordinance and asked what employees would be affected?

The Administrator advised that, in Brielle, the new regulations would impact only the Administrator and the Municipal Judge. However, the current appointees had been grandfathered as the new regulations took place in July 2007 and both individuals had been appointed in advance of that date.

Mr. Brannick asked Coun. Nolan why the Board of Recreation had stopped the concerts in the park series?

Coun. Nolan replied that attendance had been small and the Board felt that one "big" event, such as a movie in the park would be a more productive use of resources.

There being no further comment the meeting was adjourned at 7:42 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.
