MINUTES JUNE 22nd, 2009 WORK SESSION START: 7:30 P.M.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report.

There being no further comments the work session was adjourned at 7:31 p.m. on a motion by Coun. Shaak, seconded by Coun. Garruzzo.

PRESENT: MAYOR NICOL, COUN. GARRUZZO, GORHAM, NOLAN, SCOTT, SHAAK & VISCEGLIA. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Following a moment of silent prayer, wherein longtime First Aid Squad Member & Trustee Larry Morgan was remembered, a salute to the flag and a roll call, the Minutes of the June 8th, 2009 Meeting were approved on a motion by Coun. Scott seconded by Coun. Nolan; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 09-66 for passage of the Consent Agenda.

Resolution:

Motions:

Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Coun. Visceglia, seconded by Coun. Shaak, introduced Resolution 09-67 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of June 22nd, 2009, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Garruzzo, Gorham, Nolan, Scott, Shaak & Visceglia; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for a hearing and further consideration of "AN ORDINANCE VACATING A PORTION OF MORGAN PARKWAY WITHIN THE BOROUGH OF BRIELLE, COUNTY OF MONMOUTH, STATE OF NEW JERSEY”.

The hearing was carried to July 13th, 2009 to permit the completion of a Title Search on a motion by Coun. Scott, seconded by Coun. Nolan.

Borough of Brielle Resolution

Whereas, an application has been made for the renewal of Liquor License #130833-002-008 C.G. Mass, Inc. T/A Sand Bar, and

Whereas, the application is complete, the $1,866.00 fee due to the Borough of Brielle and the $200.00 fee due to the State of New Jersey, Division of Alcoholic Beverage Control, being received and all Municipal requirements have been complied with, and

Whereas, no objections to the renewal of this license have been received.

Now Therefore Be It Resolved, that the application of C.G. Mass, Inc. T/A Sand Bar, for premises located at 201 Union Lane, Brielle, N.J., is hereby approved and the Municipal Clerk is authorized to issue said license, for the license year July 1st, 2009 through June 30th, 2010, subject to the following conditions hereby imposed by the Governing Body of the Borough of Brielle:

1.) The conditions imposed by the Brielle Planning Board Resolution, dated May 6th, 1995 and incorporated into the text of this resolution as Addendum #1 (attached) shall continue to apply to this liquor license and shall be strictly enforced. The license holder shall abandon the area known as the west deck for service and/or consumption of food and alcoholic beverage and any other business purpose. The applicant shall not place any tables, chairs or similar devices on the west deck.

2.) No alcoholic beverage is to leave the licensed premises in an open container. The management of the Sand Bar is required to monitor all points of ingress or egress to ensure that this condition is met.

All doors and windows of the Sand Bar shall be kept closed after 7:00 p.m. (Prevailing Time) whenever live, canned or amplified music is played.

Resolution of the Borough of Brielle

Whereas: on June 3rd, 2009, Friendly Sons of Saint Patrick of the Jersey Shore, P.O. Box 254, Spring Lake, NJ 07762, submitted Raffle Application No. 2009-10, ID No. 475-8-37707 for an on-site 50/50 raffle, to be held at the Manasquan River Golf Club on Monday, August 3rd, 2009, from 6pm to 9pm with a rain date of Tuesday, August 10th, 2009.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

Certification

The foregoing is a true copy of a Resolution passed by the Mayor & Council of the Borough of Brielle at a meeting held at Borough Hall, 601 Union Lane, Brielle, New Jersey, on June 22nd, 2009.

Mayor Nicol then called for committee reports and recognized Coun. Scott who cited the success of the "Shredding Day", but she added that there were a number of disappointed people as the truck was filled and a number of potential users had to be turned away. Coun. Scott and Superintendent Burkhardt had stayed until noon to offer an explanation as to what had transpired. The County had scheduled another day in Manasquan for November 7th
Coun. Scott also noted that many people brought items that did not need to be shredded, but could be disposed of at the Recycling Center. This non-confidential material took up valuable space in the truck unnecessarily.

Coun. Scott pointed out that plastic covers were not accepted, but fortunately most users brought paper of high quality that was readily accepted. The Councilwoman also reminded the public that the project was sponsored by Monmouth County and the County had failed to inform the Borough that there was a 150 pound limit per person. Some people arrived with vast amounts of paper and they were turned away. In some instances, where the material was non-confidential, these people were directed to the Recycling Center.

In closing, Coun. Scott noted that the event had been covered by the Wall Street Journal and she looked forward to viewing that article when it was published.

Coun. Nolan noted that the Library had initiated the annual "Summer Reading Program" and that Brigit Carlson & Jason Lorenzo were the winners of the $500.00 Jean Wetzel Scholarship Award.

Turning to Recreation, Coun. Nolan advised that Flag Football sign-up would be held on July 10th. He also reminded the public that summer had arrived and motorists should be mindful of the increased pedestrian and bicycle traffic throughout the Borough. Coun. Shaak praised the Fire Company for their prompt response to a recent fire on Forrest Road that curtailed the fire and kept damage to a minimum.

Coun. Shaak also commented on the passing of Larry Morgan who had been a member of the Brielle First Aid Squad for forty-one years. A memorial service was scheduled for Saturday, June 27th; he added that Larry had been a true asset to the community and would be sorely missed.

Coun. Garruzzo, Gorham & Visceglia had no reports and the meeting was open to the public. The Chair recognized Edith Nowels, 637 Holly Hill Drive, who noted that, had he lived her husband Bill, a former Borough and Planning Board Attorney, would have celebrated his 100th Birthday on this date.

However, her reason for coming before the Council was the presence of what she believed was a fungus that was attacking trees along Holly Hill Drive. Ms. Nowels added that she had alerted the Borough of the problem and two men had visited the site, but as yet no remedial steps had been taken.

Coun. Scott asked if the Shade Tree Commission had been made aware of the problem? Ms. Nowels said the gentlemen had been from the Public Works Department.

Ms. Nowels had samples of the fungus in a shoe box and Superintendent Burckhardt took custody of the material and promised to investigate further.

There being no further comment the meeting was adjourned at 7:50 p.m. on a motion by Coun. Scott, seconded by Coun. Garruzzo.
