MINUTES NOVEMBER 10TH, 2008 WORK SESSION START: 7:30 P.M.

PRESENT: MAYOR NICOL, COUN. BOLGER, GARRUZZO, GORHAM, NOLAN, SCOTT & SHAAK. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report, but asked to add a motion to the consent agenda to authorize the May 16th & 17th National Multiple Sclerosis "Coast The Coast" bike ride through Brielle. Council gave their approval. The Administrator also asked to remove Resolution 08-97-C as a Tax Clearance Certificate had been received.

There being no further comments the work session was adjourned at 7:33 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

PRESENT: MAYOR NICOL, COUN. BOLGER, GARRUZZO, GORHAM, NOLAN, SCOTT & SHAAK. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the October 27th, 2008 Regular Meting were approved on a motion by Coun. Garruzzo seconded by Coun. Nolan; all aye; no nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan introduced Resolution 08-97 for passage of the Consent Agenda.

Resolutions:

Motions:

To approve a request by the National Multiple Sclerosis Society to conduct their annual "Coast The Coast" Bike event in Brielle on May 16th & 17th, 2009.

Vote: Coun. Bolger, Garruzzo, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 08-98 TO TRANSFER FUNDS. (see insertion). Vote: Coun. Bolger, Garruzzo, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed.
Coun. Gorham, seconded by Coun. Shaak, introduced Resolution 08-99 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the bills of November 10th, 2008, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Bolger, Garruzzo, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed.

Mayor Nicol then announced that the time had arrived for the introduction and passage on first reading of a "AN ORDINANCE TO RESCIND CHAPTER 14 OF THE CODE OF THE BOROUGH OF BRIELLE ENTITLED "FIRE PREVENTION" AND TO CREATE A NEW CHAPTER 14 TO REPLACE AND UPDATE THE PREVIOUS ORDINANCE".

Coun. Scott, seconded by Coun. Gorham, introduced resolution 08-100 for passage on introduction and first reading of the foregoing ordinance. Vote: Coun. Bolger, Garruzzo, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 08-101 to authorize publication of the foregoing ordinance in the Coast Star Newspaper for a hearing to be held at 7:30 p.m., at Borough Hall, 601 Union Lane, Brielle, New Jersey, on November 24th, 2008. Vote: Coun. Bolger, Garruzzo, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed.

Mayor Nicol then called for committee reports and recognized Coun. Scott who reminded the public that the Borough would not be picking up brush during the balance of leaf season. Leaf season ended on December 15th.

Coun. Scott, on behalf of the various groups who utilized Curtis House, thanked Mayor Nicol for funding the replacement of the floor in the Community Room. Coun. Scott also cited the cooperation between the Public Works painter and the Civic Groups that used the building. The painter had accommodated the various events scheduled by the groups and the project remained on schedule.

Coun. Scott also cited the Seniors Movie Programs held on the third Monday of the month at 2:00 p.m. Currently the Seniors were screening a three part film on President John Adams. Popcorn and Candy were free.

Coun. Nolan advised that the annual Christmas Tree Lighting would take place on December 7t'' @ 6:00 p.m. Hot chocolate would be served. The Board of Recreation was also in the process of scheduling the annual Holiday Bus Trip. The date would be announced in the near future.

Turning to the Library, Coun. Nolan stated that the "Lizard Guys" would make a presentation on November 18th @ 3:30 p.m. and at 7:00 p.m., on the same date, Susan Maes & Bill Ryan would make a presentation of "Saving For College".

Coun. Garruzzo having no report, Coun. Shaak thanked the voters of Brielle for their support in his re-election campaign and their support for his running mate, John Visceglia. Coun. Shaak added that he was both "honored" and "humbled" by the experience. Coun. Shaak then cited the on-going water main replacement and road improvements on Cherokee Lane & Brown Street.

Be It Resolved, by the Mayor & Council of the Borough of Brielle that Mary Lou Hartman be and is hereby appointed to the position of Tax Assessor of the Borough of Brielle effective July 1st, 1992 through June 30th, 1996.

RESOLUTION OF THE BOROUGH OF BRIELLE

WHEREAS, NJSA:40A58 PROVIDES FOR MAKING TRANSFERS BETWEEN BUDGET APPROPRIATION ACCOUNTS DURING THE MONTHS OF NOVEMBER & DECEMBER, AND

WHEREAS, IT HAS BECOME NECESSARY AT THIS TIME TO EXPEND FUNDS IN EXCESS OF THE SUMS APROPRIATED FOR THE PURPOSES SPECIFIED IN THE 2008 BUDGET, AND

WHEREAS, THE GOVERNING BODY MAY, BY RESOLUTION, TRANSFER EXISTING EXCESS TO AN APPROPRIATION DEEMED INSUFFICIENT.

While there had been some "bumps" along the way, the contractor had met with the Borough's Professional Staff and it appeared that the problems had been resolved. It was anticipated that the project would be concluded by December 15Th

Coun. Shaak also noted a NJDOT drainage project in progress on Route #35 adjacent to the Schoolhouse Road overpass.

Coun. Bolger congratulated Coun. Shaak and Mr. Visceglia on their election and added that they had run a "good, clean campaign". Coun. Bolger went on to say that it had been a privilege to serve the people of Brielle for three years and that he had done "his best"; he had "faith and trust" that his colleagues would move forward without him. He added that he had a firm belief in the democratic process.

Turning to Veterans Day, Coun. Bolger thought it appropriate to acknowledge Borough Police Officer Todd Gerlach's service in Iraq and urged everyone to "keep him in our prayers".

Coun. Bolger noted that regretted not having followed through on a program to honor Brielle's Veterans, in particular the "Greatest Generation", but he was working working with Dave Dupre on an idea to rectify that omission. Meantime he urged residents to thank Rick Scott, who saw service in World War II, and Bud Cain, who served in Korea, for their service to our country. If you see either of them, he said, say "thanks".

Coun. Gorham having no report, David Heskin, 613 Valley Road, advised the Council that his home and vehicle had been covered in shaving cream on "Mischief Night" and a friend who lived on Borrie Avenue had been "egged" on Election Night.

Mr. Heskin found these incidents upsetting and while he had discussed the matter with Chief Palmer he thought it appropriate for the Council to take a pro-active position to address the problem. He noted that, in Point Pleasant, Law Enforcement Officers had visited "My Space" where local youth bragged of their adventures and where easily apprehended. Mr. Heskin also thought it appropriate for the Council to make a joint effort with the School.

Coun. Garruzzo noted that the Borough had strictly enforced the Halloween Curfew, but added that the Police could not be everywhere. He reminded the public that the best thing to do was call the police when vandalism was in progress so that the perpetrators could be caught in the act. Coun. Garruzzo added that residents should never be reluctant to call the police as it was their job to respond.

Coun. Bolger interjected that, on the same evening, a tragedy had taken place in Toms River. He believed that it was a matter of public safety and he believed that the Council should take a hard look at revamping the curfew ordinance to make it more effective and to avoid a potential future tragedy.

Coun. Scott offered that Brielle had a very stringent curfew ordinance and the restrictions had been disseminated to the public in the Fall Newsletter. Coun. Scott added that in today’s Asbury Park Press there had been a letter to the Editor that lamented the apparent resurgence of destructive behavior and property damage on mischief night.

There being no further comments the meeting was adjourned at 7:55 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Shaak.
