MINUTES SPECIAL MEETING SEPTEMBER 30TH, 2008 START: 5:05 P.M.

PRESENT: MAYOR NICOL, COUN. BOLGER, GARRUZZO, NOLAN, SCOTT & SHAAK. ADMINISTRATOR THOMAS NOLAN.

ABSENT: COUN. GORHAM.

Following a moment of silent pray, a salute to the flag and a roll call, Mayor Nicol convened the meeting in compliance with the Special Meeting provision of the Open Public Meetings Act.

Coun. Garruzzo, seconded by Coun. Nolan, introduced Resolution 08-87.

Whereas, the Borough of Brielle did advertise in the Asbury Park Press and the Coast Star for bids for "Road & Drainage Improvements", and

Whereas, bids were received by the Borough on September 26th, 2008, and

Whereas, the lowest responsible bidder was the Defino Contracting Company, 28 Industrial Drive, Cliffwood Beach, N.J. with a bid of $537,000.00, and

Whereas, the Bid Bond and Consent of Surety were found to be in order, and funds are available to undertake this work.

Now, Therefore Be It Resolved, that the bid submitted by Defino Contracting Company, 28 Industrial Drive, Cliffwood Beach, N.J. is hereby accepted, and the Municipal Clerk is hereby authorized to initiate the contract.

Vote: Coun. Bolger, Garruzzo, Nolan, Scott & Shaak; aye. No nays. None abstained. Conn. Gorham absent.

Coun. Scott asked if the Borough had any prior experience with the bidder? The Administrator advised "no", but that the Borough Engineer had worked with him before in Tinton Falls.

Coun. Nolan asked if there was an “asphalt escalation clause in the bid”. The Administrator again replied "no", but added that coincidently the contractor had raised that issue in Tinton Falls, but the municipality had held firmly to the fact that there was no provision for such a clause in the bid specification.

Coun. Bolger asked about the timetable and was advised that it was anticipated that the work would be completed before the end of the year.

The meeting was adjourned at 5:10 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.
