MINUTES JUNE 23rd, 2008 WORK SESSION START: 7:30 P.M.

PRESENT: MAYOR NICOL, COUN. BOLGER, GARRUZZO, GORHAM, NOLAN, SCOTT & SHAAK. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Mayor Nicol convened the work session in compliance with the Open Public Meetings Act and recognized the Administrator who advised that he had nothing to report, but he reminded the Council that the next meeting would be July, 14th, 2008 and he asked permission to add a resolution to the consent agenda to authorize a raffle. Council gave permission

Mayor Nicol then read the following Proclamation:


Whereas, the Borough of Brielle has been formed in compliance with the applicable statutes, and

Whereas, it is fitting and proper for a municipal corporation to recognize the achievements of its residents, and

Whereas, Alexander Yee has attained a class rank of No. I out of two hundred and thirty-nine students at Manasquan High School, and

Whereas, Alexander Yee has utilized his talents and abilities to mentor and tutor other students at the High School, and

Whereas, Alexander Yee has also assisted the people of his community through volunteerism, and

Whereas, such an achievement is indeed worthy of commemoration

Now, Therefore Be It Proclaimed, that June 23rd, 2008 be designated as Alexander Yee Day in the Borough of Brielle.


The work session was adjourned at 7:35 p.m. on a motion by Coun. Garruzzo, seconded by Coun. Nolan.

MINUTES JUNE 23rd, 2008 START: 7:36:P.M.

PRESENT: MAYOR NICOL, COUN. BOLGER, GARRUZZO, GORHAM, NOLAN, SCOTT, & SHAAK. ATTORNEY MONTENEGRO & ADMINISTRATOR NOLAN.

ABSENT: NONE.

Following a moment of silent prayer, a salute to the flag and a roll call, the Minutes of the June 9th, 2008 meeting were approved on a motion by Coun. Shaak seconded by Coun. Garruzzo; all aye; no nays. Coun. Gorham abstained. Passed.

Coun. Nolan, seconded by Coun. Garruzzo, introduced Resolution 08-68 for passage of the Consent Agenda.

Resolutions:

A. (see insertion).
B. (see insertion).
C. (see insertion).
D. To increase the fee for a water meter from $60.00 to $150.00 due to the current cost to the Borough of $130.00.
E. To accept a proposal from Birdsall Engineering to prepare the plans and specifications and to provide construction management services for the 2008 Capital Improvement Program at a cost of $79,850.00.
F. (see insertion).

Motions:

Vote: Coun. Bolger, Garruzzo, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed.


Coun. Gorham, seconded by Coun. Garruzzo, introduced Resolution 08-69 for Payment of Bills. Be It Resolved, that the following bills be paid, and that the Mayor or President of Council be authorized to draw orders on the Chief Finance Officer for payment of the hills of June 23rd, 2008, as reviewed by the Finance Committee and as listed on the Resolution and the Computer Bill List amended thereto. Vote: Coun. Bolger, Garruzzo, Gorham, Nolan. Scott & Shaak; all aye. No nays. Passed.

Mayor Nicol then called for committee reports and recognized Coun. Scott who lamented that the public continued to dump non-recyclable materials and trash at the Borough Yard. The Borough simply cannot provide round the clock surveillance of the Recycling Center. New signage was in place and Coun. Scott implored the public to leave their trash at home.

Whereas: on June 18th, 2008, Holiday Express, 968 Shrewsbury Ave., Tinton Falls, NJ 07724, submitted Raffle Application No. 2008-8, ID No. 343-4-36537 for an on-premise 50/50 Raffle, to be held at the Manasquan River Golf Club, 843 Riverview Drive, Brielle NJ 08730 on Monday, July 21st, 2008 at 12:00pm.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

The foregoing is a true copy of a Resolution passed by the Mayor & Council of the Borough of Brielle at a meeting held at Borough Hall, 601 Union Lane, Brielle, New Jersey, on June 23rd, 2008.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Whereas: the Brielle Police Department had indicated that it has no objection to granting this License.

Now, Therefore, Be It Resolved: that the Governing Body of the Borough of Brielle directs the Business Administrator to sign the Findings and Determination and the Municipal Clerk is to issue the required License on behalf of the Borough.

Coun. Nolan cited the appearance of F. Paul Wilson at the Library on June 25th @ 7:00 p.m.

Coun. Nolan added that the Library would hold a book sale on September 4th (9:00 a.m. to 8:00 p.m.), September 5th (12:00 p.m. to 5:00 p.m.) and on Brielle Day, September 6th (9:00 a.m. to 1:00 p.m.). The Library would again be showing films on Wednesdays during July & August.

Coun. Nolan also advised that the Library was starting a “homebound” program to provide library books to residents who were unable to come to the Library.

Coun. Nolan cited the success of Ira Jacobson’s appearance at the Library and his dissertation on his book “Quest For Excellence”. Coun. Nolan noted that Mr. Jacobson attributed part of his success to his Brielle location, but he also felt that he had helped to put Brielle on the map with his establishment.

In closing Coun Nolan advised that the Board of Recreation would hold their annual Family Day Picnic on Sunday, June 29th from 4:00 p.m. to 8:00 p.m. Music would be provided by “Joy”.

Coun. Garruzzo cited an award received by the Brielle Police Department from the National Guard. The award read “Employer Support of the Guard & Reserve presents Above & Beyond Award to the Borough of Brielle. Presented on behalf of the Men & Women of the National Guard & Reserve Forces, for outstanding service and continuing support to the National Defense”.

Coun. Shaak offered his congratulations to the Scouts and the Union Landing Historical Society for their Flag Day Ceremony. Coun. Shaak was gratified to see this important day revived.

Coun. Bolger advised the Council that his Committee would be meeting later in the week to review the sign ordinance with an eye toward revisions.

Coun. Gorham having no report the Chair opened the meeting to the public and recognized Mr. David Dupre, 1016 Riverview Drive, who expressed his thanks to the Department of Public Works for their efforts in preparing the 9/11 Memorial Site for the Flag Day Ceremony.

Mrs. Janice Ownes, 710 Union Lane, voiced her disappointment over the Council’s decision not to reduce the school budget in accordance with the wishes of the majority of the voters. She said that “she thought the Council would do something”.

Fran Miceli, 704 Schoolhouse Road, asked if the public would have input to the proposed revisions to the sign ordinance?

Coun. Bolger stated that the committee, that consisted of himself and Coun. Nolan & Shaak, would be meeting to discuss what to do next. The options would be to abolish the ordinance, revise it or leave it as is.

The Administrator interjected that any revisions would require an introduction, publication in the
local press and then a public hearing at which time the residents would be given an opportunity to be heard.

There being no further comments, the meeting was adjourned at 7:48 p.m. on a motion by Coun. Scott, seconded by Coun. Nolan.
