May 8, 2007 - Special Meeting
MINUTES: MAY 8th, 2007 START: 5:30 P.M.
PRESENT: MAYOR NICOL, COUN. BOLGER, GORHAM, NOLAN, SCOTT & SHAAK. ATTORNEY MONTENEGRO, ADMINISTRATOR NOLAN & THE HONORABLE JUDGE ALEXANDER D. LEHRER, J.S.C.
ABSENT: COUN. GARRUZZO
Mayor Nicol convened the meeting in compliance with the 48 Hour Provision of the Open Public Meetings Act (see Municipal Clerk's Affidavit of service).
Coun. Shaak, seconded by Coun. Nolan, introduced Resolution 07-59 to authorize an Executive Session (see insertion). Vote: Coun. Bolger, Gorham, Nolan, Scott & Shaak; all aye. No nays. Resolution Passed.
The Executive Session began at 5:31 p.m. and was adjourned at 6:59 p.m. on a motion by Coun. Shaak, seconded by Coun. Nolan.
Coun. Shaak, seconded by Coun. Nolan, introduced Resolution 07-60 to authorize the Borough Attorney to proceed in this matter has outlined in the conversations conducted in Executive Session. Vote: Coun. Bolger, Gorham, Nolan, Scott & Shaak; all aye. No nays. Passed.
The meeting was adjourned at 7:00 p.m. on a motion by Coun. Shank, seconded by Coun. Nolan; all aye.

RESOLUTION OF THE BOROUGH OF BRIELLE
Whereas, the Open Public Meetings Act permits the exclusion of the Public from a meeting in certain circumstances, and
Whereas, the Mayor & Council of the Borough of Brielle are of the opinion that such circumstances presently exist.
Now, Therefore, Be It Resolved, by the Mayor & Council of the Borough of Brielle, County of Monmouth, State of New Jersey, on May 8th, 2007 as follows:
1. The public shall be excluded from discussion and action upon the hereinafter specified subject matters:
